MiloB Posted March 8, 2016 Share Posted March 8, 2016 Hi all, My partner from Norway has been in Australia for the past 6 months on a Student Visa studying a Cert III in Fitness. Her course ends on the 4th of April and her visa expires on the 15th of May. She has previously been in Australia on a WHV in 2014 but returned back to Norway for 4 months before taking up her student visa in Australia. Before she returns to Norway aain, she wants to study a 9 week Nursing Bridging course in Australia to be able to be registered as a nurse in Australia, but this starts on the 11th of April and a month before her student visa expires. So to do the full course, she will need to apply for a Visitor visa. My concerns are: 1) Can she apply for a Visitor visa while on her student visa and before her course is finished? If so, would the visitor visa conditions apply as soon as the course ends (note that the course ends a month before the student visa ends); 2) Could immigration think this is an attempt to return to Australia and apply for a Partner Visa and deny the Visitor visa? This is definitely not our intention as she intends to return to Norway, work for 4 months and then apply for a Skilled Migrants visa as a Nurse. If we supply with the visitor visa application a confirmation of Bridging course enrollment, a one way flight from Australia to Norway, and a confirmation of employment in Norway, would this avoid any suspicion? According to the border.gov.au: Your eVisitor lets you: enter Australia for up to three months during each visit during the 12 months from the date the eVisitor is granted have a holiday or visit family and friends in Australia study in Australia for up to three months in some circumstances Link to comment Share on other sites More sharing options...

Also having had a WHV, then a study visa and now proposing a visitor visa which as per Aus Gov site may allow study in some circumstances might raise a few alarm bells on long term intentions. Why not just either apply for a study visa extension or a new study visa for the course given the visitor visa looks pretty vague as far as study https://www.border.gov.au/Trav/Stud/More/Extending-Your-Stay If long term intention is to apply for PR best attempt go with the proper visa for the purpose and not as a visitor. Unfortunately she needs to complete this course so she can pass her skills assessment. So the only option really is to do this course on a tourist or visitor visa. Bit of a Catch-22. Ok but still chancing the study in some circumstances statement given immigration might not wear the fact is on back of a study visa that could possibly be extended. Also although i am not clear given different variations visitor visa 1)do they have to be applied for offshore 2)once granted probably cancels the study visa if still active at the time. End of day only immigration can really answer if the visitor visa is good enough plus of course whether the college will accept over a proper study visa.
