Advice needed for de facto lawyer specialising in British and Australian law .currently at home in UK can I separate without returning to Oz , no children involved only property and money to be settled . TIA , savemysanity

Unless the laws have changed in recent years, you don't even need to go to court if you can agree the split between the two of you, so no need to return to Oz. The law says you should split everything 50/50 but you don't have to, it's entirely up to you.

If there's investments involved, you'll have to pay the capital gains tax if you don't go to court, whereas you can defer it if you do. However it's only a deferment which means you have to pay it one day, so it's probably not worth the cost of flying back to Oz, lawyers etc.
