bhatnagar1
Hi Guys, Me and my family have moved to Adelaide recently (April 2014) on Visa subclass 574 (Postgraduate Research Sector) valid for 3 years. My wife is the primary applicant of this visa as she is pursuing her PHD from University of Adelaide and my status is dependent spouse. Now I will appreciate if someone can guide me if 1. my wife can be a primary applicant for PR visa as we want to proceed for PR 2. Or do I (with over 15 years of corporate experience) need to apply as primary applicant and get my skills assessed. Thanks
MaggieMay24
Either one of you can be the primary applicant if you have a job on the relevant occupation list and meet the points criteria for a visa.
bhatnagar1
Thanks for your response. Please advise based on below facts. 1. My wife(Age 34years) has got double Masters Degree (MA & Mphil) but she has experience of just 5 years in last 10 years and has a gap of approx 5 years in immediately preceding last 5 years. As she took a break because of our new born child at that time. However she is more qualified than I am. Can she claim points based on that? In short my wife has more qualification but less work experience in immediate preceding last 10 years. 2. I (Age 40 years) have 15 years of corporate experience and a Graduate with PG Diploma in Mgmt. More work experience and less qualification. Now why we are getting confused is that we are of the opinion that since once my wife has already been through immigration once for processing her current visa, her age, her IELTS score of 8 etc. It might be easier for her to apply and honestly though I have documentary evidence of my past work experience it will be too much of paper work. I will appreciate your response. Thanks again

bhatnagar1
You haven't said if either of you are employed in an occupation on the SOL or CSOL? Thanks. Pumpkin
Thanks. I do have my occupation listed in SOL & CSOL (Corporate services manager) & my wife as well (Research and development manager). I don't see either of those occupations on the SOL, are you sure you did? What is the occupation code?

Pumpkin
Please note

132111 Corporate Services Manager

https://www.migration.sa.gov.au/snol_data That is not the SOL. That is the South Australia state sponsorship list, it is very important to understand the difference. This is occupation is not on the SOL as I said, the good news is that it is on a state sponsorship list though, which means that a state sponsored visa might be possible if you can secure sponsorship. So in order to decide who should be the main applicant, you should see who can pass skills assessment, who can pass points test and who is eligible for and can get state sponsorship. Ozmaniac
Your occupation is not on the SOL so it is not eligible for an Independent 189 visa. It is on the CSOL meaning that it is only eligible for employer (457, 186 or 187) or state sponsored (190 or 489) visas. https://www.migration.sa.gov.au/snol_data is the list of occupations for which South Australia is willing to offer sponsorship for suitable applicants. They appear to be the only state willing to sponsor that occupation. Before you can apply to South Australia for sponsorship, you will need a positive skills assessment from VETASSESS and 60 points on the points test (which can include the 5 or 10 points you get for state sponsorship). Check to see if you meet the VETASSESS requirements: http://www.vetassess.com.au/Skills-Assessment-for-Migration/General-Occupations/Nominate-an-Occupation
