MovingtoTasmania Posted August 9, 2014 Share Posted August 9, 2014 The problem with travelling to Aus on the TV and then applying is that the TV could come with a no further stay restriction so that's risky. The benefit would be that the partner would be put on a bridging visa and thus may be able to work but the processing times are longer. Applying offshore in the UK either online or paper doesn't affect processing times and I think you can only do online applications now. Link to comment Share on other sites More sharing options...
Guest Posted August 9, 2014 Share Posted August 9, 2014 If the baby is eligible for AUS citizenship by descent I'd get that and not put them on the partner visa application. There really is no need to include them on the application if they are eligible for AUS pp in their own right. It only takes about 6 weeks all up to organise that side of things. If you apply for a 3 month tourist visa you can see when it's granted re restrictions and then decide from there if you want to apply onshore. Alan Collett Posted August 9, 2014 Share Posted August 9, 2014 Onshore applications provide access to an appeals mechanism in the event that your application is unsuccessful. Also, a Bridging Visa would be issued which would allow you to remain lawfully in Australia pending a final decision on your visa application - and you could reasonably expect there to be no condition restricting your ability to work: applicants for partner visas can generally plan to work once the BV comes into effect. MovingtoTasmania Posted August 9, 2014 Share Posted August 9, 2014 If your daughter already has PR then she doesn't need to apply for a visa with her partner. She will need to sponsor the partner and the child for their visas as she is the PR.
