Lost 457

Hi guys

major issue - I just came out to Perth last week to be with my partner, who's been here for a year now, on a 457. A day after my arrival they started to lay people off :(

Now, I've looked into the options, I believe him trying to get a 190 might be the best option. Will speak to an agent, but I thought, maybe anybody got some advice? Here's the situation:

I'm 26, just finished my studies in Events Management (CSOL), no post-qualification experience. He's 34, a Geologist (CSOL), years of experience. So neither of us could get a 189...

Not too keen on living in regional Oz, cause it'd be hard to find a job within the events industry, if there's no people lol

I wouldn't get a skills assessment cause of the lack of experience. Oh and btw, he's English, I'm German.

So if he'd get his skills assessed, get an English test done (just so we can get more points), and get nominated by one of the four states that have his occupation on their SMP, we could lodge an EOI in his name, me being the secondary. We'd have around 70 points then. The occupation ceiling for Geologists is 840... :/ What are the chances...

Also, anyone know how to get nominated? On some websites I read you'd tick a box in your EOI if you wanted nomination, on some pages I read you'll have to apply for it separately, before the EOI...?

Any advice would be appreciated!! Desperately want to stay here :/

Thanks!

From what you have posted the best thing for you to do is to apply for the 190 visa.

He will need his skills assessed by VETASSESS. If he can reach the pass mark of 60, you will get 5 points WA State Nomination. If he has 1 full year of 457 work experience, this will give 5 points and would likely not need the IELTS, as long as he has 5 years overseas work experiance that he can prove.

Age - 25

Work exper 5 years -10

Aus Work EX - 5

Degree qualified 15

State Nomination - 5

Geologist is still on WA State Migration Plan, but what you will need to do - is after you have Skills assessment, you lodge EOI. Then you apply direct to WA for State Nomination, once this is approved - you will get an invitation to apply.

Once you get an invitation you will be eligible for a bridging visa, while your application is being processed, this will kick in if the 457 runs out while your application is being processed.

For you to be considered Defacto on 190, it is a 12 month relationship requirement, therefore you will need to show more evidence than you did for the 457.

Or find another 457 sponsor or RSMS visa

I think the easiest way right now would be for your OH to find another job that will take over the 457 sponsorship. This is a very straightforward thing to do for most mining companies. If he is a geologist he should have no problem - you could ask Verystormy on here his department is desperate for geos!

From the date that his current company get his current visa cancelled, he has 28 days. But it usually takes 3 or 4 weeks for the cancellation to take effect so in reality you have about 7 weeks to find another job, which shouldn't be a problem.

Thanks for all the advice, guys!

lebourvellec, you said if he can reach the 60 points, he will get sponsorship. That sounds like a definite thing, is that the case that he'll certainly get it? I understood, that a sponsorship application could also be refused...

Also, in respect to sponsorship and the actual visa application later on, I've read that the more points you have the more likely it is to be successful. That's why I thought an IELTS might be good, even though not required, just to get additional points and therefore an advantage over the other applicants.

Ah okay, that's good then, I thought you'd only be eligible for a bridging visa as of the time you've lodged your application. So if we can get the bridging visa once he's been invited, do you think it's realistic to plan on not leaving the country at all? Like, if he loses his job now, then there's around 3 weeks until DIAC will know about it, and a further 4 until the visa is cancelled. So that leaves us with 7 weeks until we will have to have the bridging visa, therefore have been invited...however, I read somewhere that process would take 2 or 3 months :/ So what happens if our 457 is cancelled before my partner will be invited and we can get a bridging visa? Are we unlawful for that time being? Or is that a case for bridging visa C?

What I was also wondering, would the chances of getting a 489 be better than a 190? I'm just thinking that maybe less people want the 489, and that there's a high demand for 190...

Again regarding SS, what's going on with these numbers? I've read people saying "oh I've got 50, so my chances are good" and others were like "mine is 1349, so it's a long wait for me" ...?

Again, thanks so much for your help!

Sarah
