Our background is that we lodged a 176 (family sponsored) visa in May 2010 under my husband's occupation (Vocational Teacher - Non Trades), we are currently in the "notorious" Category 5 group due to be processed at the end of never!! :goofy: I am a Finance Manager in a large organisation, I have my AAT (Association of Accounting Technicians) and over 8 years experience with my employer and I work in an area which is quite specialised although I have past work experience of 14 years in different finance roles. My Husband's uncle runs a successful IT company in Australia and is interested in getting me over to work for his company on a 457 visa for a position which he thinks I am suitable for. My questions are: 1) would the 457 override our 176 and therefore the £3k we have paid so far be wasted? 2) Would the DIAC let me into Aus as a Finance Manager with just my AAT? 3) Would the fact that it is my Husband's uncle who's company would be sponsoring me have DIAC smell a rat? We do have a RMA but I thought that as these questions don't relate to our 176, he may not be able to help. Any help would be gratefully received. It will only override the 176 if the 176 gets issued before the 457. It is always the last granted visa that applies. Not when applied for 2) Would the DIAC let me into Aus as a Finance Manager with just my AAT? If they feel your qualifications and experience are suitable for the job whynot. 3) Would the fact that it is my Husband's uncle who's company would be sponsoring me have DIAC smell a rat? Its not uncommon for this to happen. The only thing you need to think about: does your uncle have a legitimate reason to recruit from overseas and not from the local workforc. If DIAC have no issues with that, then I cant see the family relationship being a major issue. We do have a RMA but I thought that as these questions don't relate to our 176, he may not be able to help. If you already have an agent, why not use him for the 457 as well? Or would they "bin" that one as we'd already (theoretically speaking of course) got a 457? With my husband's Uncle's company, they do bring people in on a 457 and have so many per year, to be brutally honest I have no idea what they're planning for me, but as long as I have a paid job and we're closer to my in-laws I am happy to do anything! DBC Posted July 9, 2012 Share Posted July 9, 2012 We're here on a 457 visa and have just completed our medicals for a PR visa. Once this is granted our 457 visa will be overridden. I think many people do this due to the long processing times of pr visas so don't worry. Companies will also tend to offer relocation packages along with the job which makes the move a bit cheaper!
