  1. Hi Folk,

My visa was granted on shore in April (due to the legislative changes with Covid). Just the 309… we are now awaiting the 100. It advises in the 100 is granted 2 years after applying, which for me would be July this year! Woohoo! Has anyone here had experience of what happens? Do they contact you and ask heaps of questions or what? Any help appreciated. 🔆

    Hi all,

I was just wondering if anyone has been able to find more information about the COVID-19 waiver for offshore applicants who happen to be onshore when their partner visa is granted? The official statement that it will be implemented "in early 2021" is so vague, it's really useless.

It did make me wonder though whether they are holding off on granting any 309/100 visas for applicants that are currently onshore until this legislation comes into force. Or maybe I am just deluding myself that there is some kind of rationale for the lack of communication and the frustrating delays.

    Cheers, Anais

I am on shore and awaiting more news regarding this. I got a ready to grant letter in March I booked to leave 1st April but it was all cancelled due to covid. So my application is READY!
I’m just waiting and hoping they sort it before may as that’s when my health check expires 😣

There's some hope @Poppysunday! Early 2021!!!. Extract of guidance just published earlier today below:

Some categories of visa require applicants to be outside of Australia at the time the visa is granted. The Department is aware that the travel restrictions and limitations associated with COVID-19 are affecting visa applicants, particularly applicants for family visas who have come to Australia.

It is intended that changes will be implemented in early 2021 that would allow certain family visas, which have been applied for outside Australia, to be granted while the visa applicant is in Australia.  This temporary concession will be for people who are in Australia and are not able to travel offshore to be granted the visa due to COVID-19 related border closures.

The concession will apply to certain applicants for the following Family visa subclasses:

    • Child (subclass 101) visa
    •  Adoption (subclass 102) visa
    •  Dependent Child (subclass 445) visa
    •  Prospective Marriage (subclass 300) visa
    • Partner (subclass 309) visa

Further information will be available in early 2021.

So happy!! I was waiting for the news articles to be released. Such a huge weight of our shoulders if it does actually happen!

For those interested, there is a Private Member's Bill being presented to Parliament next week by Labor's Julian Hill MP to temporarily change the partner visa rules so those who applied offshore but are stuck onshore do not have to leave to get a decision.

It is probably likely that the Bill may not proceed as it will need the support of the Liberal Government. However, it may mean the Immigration Minister Alan Tudge, who has the ability to issue the concession without the Parliament Bill, will be under some pressure to do so, given the number of stranded Australians who cannot re-enter Australia due to lack of quarantine places.

The response on the parliamentary petition that was circulating a few months ago is also due in the next Parliament.

Yesterday there was some news coverage in Australia:

    https://www.sbs.com.au/news/call-for-australian-partner-visa-rule-change-so-applicants-don-t-have-to-fly-offshore-during-pandemic

    https://www.9news.com.au/national/partner-visa-australia-the-regulation-forcing-partners-to-make-expensive-and-risky-flights-overseas/423ee84e-f54d-4208-a1ec-679c4ed3099d

This is me! I am praying that this gets put through. I would have to get new police and health checks done when I can eventually fly. We can’t afford for me to leave and come back, I also have a small child. It’s so distressing everyday. I don’t hold much hope put for it being passed. The migration law is so ridiculous and old.

Hey everyone just wondering if anyone is in the same position as me and my husband. We're currently in oz me and kids have our australian passports, but my husband can here on a visitor visa got his email to leave to be granted his 309/100 and we booked him to Bali for 5 days then of course it got canceled. Now with everything trying to get back to normal here in oz WA he wants to try and leave and come back so he can work does anyone have any info that there came across and managed to leave to come back. He's currently now on a bridging visa waiting on another visitor visa.... bloody more money tip to anyone here applying for another visitor visa again the price goes up from $100 odd dollars to $365 it's shocking money after money...

I am the same here I’m on a 600 and had my email to leave. I had flights booked to NZ. Looks like they are going to allow travel to NZ fairly soon and some Pacific islands possibly. I’m not sure when but maybe in the next 3/4 months. I’ve got until September until I’ll need to do more documents.

    Hi everyone

just a quick question to all. Has anyone applied for a visa 600 in the past couple of months while waiting for their grant and if so how long did it take to receive the visa 600?

we still want to make the move by end of May as i am pregnant and want to travel early before birth but still waiting on grant so thinking of applying for 600 for my husband.

    Thanks in advance 🙂

I applied for my 600 visa in December and it took 11 days. I flew out 6th feb thankfully. I got an email one week after being in Australia that they were ready to grant my 309/100. I had booked a trip to New Zealand on the 1st April but it all got cancelled. I’ve got until September to fly out 🙃🙃🙃

Yeah my husband is and he's to leave so wee booked a flight to Bali for Friday and sir Asia cancelled it. Apparently the government is aware of this but their is nothing in place. My husband's medical and police check run out in July and was told they can't freeze it and he will need to do his medical and police e check here and then upload again and wait to be told to leave again. Spent all day yesterday on the phone utter nightmare

I was due to leave for NZ on the first april. Been told I have until September to leave. I am contacting the Australian immigration minister for help!

Is there anyone in Oz on a 600 awaiting the 309/100 partner to be approved. Curious to know what will happen in the circumstance you get asked to leave for a decision to be made on partner visa given the current circumstances.

I am here at the moment in this circumstance. I have until September to leave! I have contacted the immigration minister for help

  9. Just had my email to leave Australia for my visa to be granted

applied out of London  22nd July 2019. No RFI. Flew out on a 600.

question for anyone who has flown out for their visa to ge granted. Letter says allow 5 days but I’m pretty sure everyone got theirs as soon as they flew out, I only want to leave for a few days with having quite a young baby to get back too!

Any one been granted that golden email yet this year. I applied for my husbands visa 600 on the 28th and recieved it this morning only got granted 3 months totally gutted.

Oh no :( that’s so frustrating. What are your circumstances? I applied for a 600 before Xmas and got 12 months. I wonder why there can be such a stark difference:(

I just saw someone get refused a visitor visa because of lack of ties to their home country.
im about to submit our application but it doesn’t ask for anything like that. Has anyone else provided proof of ties or anything like that?

would rather address it somehow now before we submit.

Yeah it won’t ask for anything it’s up to you to prove it in your supporting documents.

I have a job here, we have a child and family here too but I didn’t really go into it much.

I guess it really depends on the individual processing your application

congrats @Poppysunday I'm applying for ours tomorrow, nearly done with this 19 page application, ahh lol. Haven't got to the end yet, so this question might be a bit premature.

Do you attach the documents after you submit it - similar to the spouse one?

I just attached them before I submitted the application. Did it all in one. There wasn’t a particular place I just uploaded them under the nessesary documents tab x

Congrats! We are applying this weekend too. Hoping we get something more then 3 months. Mind if I ask what kind of evidence you provided?

Bank statement showing savings (circa 6k)

    credit card funds availability

    letter from me explaining stay

    letter from partner (Aussie)

letter from my in laws advising we were staying with them for free etc

my passport, my partners aussie and British passport (he’s dual) and my daughters Aussie citizenship and passport

really easy application and we put exact days of a year x

I personally went for tourist stream as i think sponsored takes longer/requires a lot more evidence from sponsor and could include a security bond  (but i could be wrong).

@SmileyD in application it states whether you want 3.6.12 months. If you tick 12 months then explain in letter why, key dates etc. they may issue 12 month with condition of multiple entry but with max 3 month stay each time for example. That condition seems to be at their discretion.

There is no place where you select 3,6 or 12 months on the tourist 600 application. Only dates you plan to be in and fly out of Australia

Do you know if grants from April/May were from London?

It's just strange how the system works, London process is very slow by the looks of things!

Yes from London. It seems as though if you had an RFI and/or didn’t front loads there were big delays. However the few who went though in the spring had no RFI and front loaded so a straight grant.

  16. 11 minutes ago, Aussiebird said:

Are the applications from London being processed in Month order? Feb applications seem to be being granted this month, so ones that were lodged in May I'm assuming will be granted in the new year??

Haven't had any RFI so far so I'm hoping they have all the information they need.  The wait is so hard though!!!

It's  now 6 months since lodgement and seeing as this is the 2nd time I am sponsoring my husband for a partner visa I really thought it would have been granted by now!!

    Thanks everyone.

From the looks of things it really depends on the case worker and your application. As people have only just been granted from dec 18 and jan 19 still then some of February coming through.

But then there are a couple who applied in April/May and got straight grants with no RFI’s

@Poppysunday getting hotter here in Sydney so in for a treat. I think I will miss the cold in the UK especially during the heatwave that is imminent apparently

Ah nice! We’re going to be West if Sydney in the blue mountains so sometimes a little cooler ... a little.

How annoying with the three month condition! If we get stuck with that I am not hugely sure we will fly out. May have to stick it out in the UK until the 309 grant.

  18. 42 minutes ago, GRS said:

Yes i will be staying put in the aussie sun for 12 months (unless the grant for 309 comes earlier) Try not to worry @Poppysunday it will be fine.

I was surprised that @dasuw had a three month condition for 600 particularly from uk. I know some countries dont have option for 651 so the only tourist visa available is the 600 which is why in those circumstances there is a 3 month condition.

Pending 600 I have 80 days left in this miserable place 🙀

I cannot wait to get to the local outdoor pool where my in laws live and feel the beautiful sun on my face! Oh the joy!

@Poppysunday i think depends on what they grant you whether it is 3,6,12 months.

My 600  states “12 month from date of each arrival”. I explicitly stated my preference in my written letter as to why i was applying for 600 and not 651.

I’ve put in my statement I want a 12 month stay for my 30th birthday, other family celebrations and to spend our daughters next Christmas in Australia with our Australian family. I’ve said the only reason I’d leave within those 12 months would be on the chance that my 309/100 was granted! So if your 600 says that, you can stay for 12 months right? Because as your said before the condition to leave every three months is a 651 not a 600 right?
