    Hey guys

Got my visa 187 In oct 2018 and soon after business was closed due to some employer issues ! So couldn’t start work at all ! Also i was working there before my visa got approved

I contacted him and told him I am happy to work if same business open again ! But nothing happened. So now what can I do ! There are not much jobs here, I searched jobs for 3 months, it’s hard to survive without job , can’t plan anything

Can  I move to any other city? Like Sydney or Melbourne?

Please  I really need some good advice.

What is your occupation. What kind of business? How long did u work before business closed? Which regional area are you?  Do you have proof that you have been actively looking for a job in the same area? Why Melbourne and Sydney? Why not another regional area?

Hi all . I have been a silent follower for a long time . it is time for me to share my story .

visa and RBC lodge at the same time in Dec 2016 . RBC approved Dec 2016 .

Family of 4 . I came with my wife and my two sons .

Office manager , 7 workers include 4 full time .

    QLD , LR country .

after 6 months my boss discover he has brain cancer , and decide to sell the company . the company was sold within 2 months to a bigger company with 60 workers . Since we are not doing exactly the same thing . the business is divided into 4 sections . It is a bit complicated . We are like a company inside a company . I still manage the previous company plus 50% of an other section . So I am in charge of 18 workers . I have increase the turnover of 40% last year . But my new boss is very ambitious and demanding . A lot of pressure , stress and tensions with the other managers turn the work condition into HELL . Sep 2017 , Immigration contact my MA to upload  new ABN , bass , ect ... from the new company . Since then , no news .

It has been now 25 months I am waiting desperately . Can't make any plan for the future like , buy a house , new car ect... Being on bridging visa so long turn the situation complicated and troublesome . My two sons are now going in university . It is hard to fill up their applications as the Uni administration is asking a lot of informations about their status : citizen , resident or international student . but it doesn't exist bridging visa status on the applications . So ???? What can I do . My MA said " nothing can do , just have to wait " . But My Patient reachs it's limit . Stress is at it max , going crazy and can't focus on my work properly . Don't know what to do . Fell like I have been forgotten . Your help would be appreciate .

Congrat to all that have got their visa so quick . And hope that all the others visa waiting from 2016 and 2017 will get their visa very soon .

    Hi all

    i lodge 187 in aug 2017

I m on BVE and my family is overseas they also included in my application

is it possible they can get visitors visa for 1 months.

Being that your family menbers are included in your application, it would be very difficult for them to meet the genuine temporary entrant (GTE) requirement which is attached to all temporary visas. In other words it would be too difficult to convince immi that they would return after visiting you. You may want to talk to a migration lawyer but they will most likely tell you the same thing.

Not true, he can leave as soon as the PR is granted on basis of bullying at the work place. It only matters that he remains in regional Australia and works in the nominated position (and this is only if there's a risk of the company reporting him, which I doubt they'll do cos then they'll face even bigger issues due to the bullying).

Yes he can leave after PR grant, but he needs to be able to show he made genuine effort to remain in the position. Bullying and harassment is a good enough reason to leave an employer. You just have to weigh the pros and cons of the available options.

    Good day everyone,
I have seen a lot of people getting the nomination and visa very fast... which is great news!!! Feels like immigration is speeding up, but today I checked in their website and the time remains 21-22 months. Do you know if this reflects the current processing time? I applied February 2018, and I am not expecting an answer anytime soon... but it would be nice to know the real processing time! Cheers

Processing time is updated monthly and because it is an average of the time taken to process all the Visas for that month, it is very unreliable. Some people get their visa in 10 months and others after 24 months. You will be surprised to get an answer soon because some applications from jan and feb 2018 have been processed. All the best.

Sorry to hear that. Please take it easy.

    Thanks for the response.

Is there anyway to switch the employer on the existing application given the circumstances? The new employer is offering the same position under the same terms, in the same location.

We have paid a lot of money for our application, MA fees etc. and have been told that we will lose it all to submit a new application with new MA fees as well.

It’s frustrating as we are expecting news of our visa soon.

I’ve done my best to resolve the issue but unfortunately, I’ve exhausted all avenues.

I am so sorry to hear this. Very pathetic. If you cannot resolve this issue at your workplace,  the only option unfortunately is to lodge a fresh application with a new employer. You will get a Bridging visa C with no travel rights if you were on a bridging Visa A. Your wellbeing is number one. If you have the resources, please move ahead because mind you, you will have to remain with same employer even after visa grant. All the best. Cheers.

My documents were actually requested from the agent not the immigration as my agent said I hadn't got a case officer yet, but they wanna make sure everything is perfect when a co picks up my file. Then one working day after I submitted the documents, my immi account status just changed to finalised. Maybe double check with your agent if you can update your documents, hope they might pick up your file straight away 🙂

Thank you very much for that piece of information. My agent updated my AFP and also submitted recent payslips, but said we cant update Medicals unless immi requests for it. My medical was completed in june 2017. So the medical is the only thing that is yet to be updated. Immi did not request anything. Once again your input really helped.

After Nomination approval, there is 99% chance of Visa grant. The few reasons for visa refusal are:

    1. Serious criminal history (that went to court)

    2. Serious Medical condition (that is likely to be burden to australia health system eg HIV/ AIDs, Kidney failure requiring regular dialysis.

    3. Character isssue including bogus/fake  documents and fake Certificates in your present or past applications.

    4. Qualification not matching position.

If you dont have any issue with those, you will sure get you Visa. I only know of one person that got refusal after successful nominatuon because he had Cert IV. But he won the case at the AAT.

    All the best guys!

    3 cases:

The Department of Immigration and Border Protection refused to grant the applicant a Regional Employer Nomination visa. The applicant claimed that he had the relevant qualifications and relevant work experience required for the visa. The AAT affirmed the decision under review.

Haly and Minister for Home Affairs (Migration) [2018] AATA 1051 The Department of Home Affairs refused the applicant's skilled visa on the basis that he did not pass the character test  due to a conviction of culpable homicide in South Africa. The Tribunal set aside the decision.

Kumar and Minister for Home Affairs (Migration) [2018] AATA 1105 The applicant’s Employer nomination visa was refused by a delegate of the Minister for Immigration and Border Protection as he did not pass the 'character test' due to an indecent assault offence. The Tribunal set aside the decision and in substitution decided the applicant should not be refused the visa.

He asks nominations. Btw if nomination is refused, the visa will be as well. To me it’s the same thing.

If you do read the article, it has a lot of useful information. The reason why 187 is risky because there are too many fake applications however I do not agree with how the immigration works. (Increases the processing time from 6 to 24 months, handle the case 2018 first instead of 2017, etc).

He asked visa refusal after nomination approval. So its not the same thing as visa refusal after failed nomination. The information is for people who have been waiting for visa after nomination approval .The purpose of this forum is to share important information and NOT to vent our frustrations.

Bhai seriously don’t talk negative because after 2 years my nomination is approved please please stop this conversation ,makes us negative!!!

That is not being negative. Information is power and having one in a thousand visa refused after nomination approval is actually being positive

I’m not sure about nomination but last year a lot of agents including my agent when they had a meeting with department of immigration, the refusal rating of 187 is 50% and 186 is 30%. While 2 years ago 187 is 13% and 186 is 8%. It’s everywhere on agent’s website, just need to google it

    https://www.google.com/amp/s/cruxmigration.com.au/2018/02/21/50-percent-of-rsms-application-being-refused-why/amp/

Those were nomination refusal, not visa refusal. Its very rare to have RSMS visa refused after nomination approval. Please see my previous post. Because it is a high priority visa it hard for the visa to be refused after nomination is approved. See possible reasons for visa refusal in my previous post.

    Cheers.
