15 Jan 2019. My MA asked me to apply AFP ahead of time.

Good idea. I updated my AFP and payslips through my MA even though immi did not request for it. My MA said we cant do a new Medical until CO asks for it.  Nomination was approved on 1st November 2018.

Nom and Visa submitted in June 2017.

Childcare Group Leader, ACT. Still no correspondence from immi regarding Visa. I don't know what they are up to.

It’s not court just only toll fine more than 7 years after that I applied last January  AFP its all good  but just I Applied yesterday for another one it’s says all offences  just wondering now may be changed

Only matters that went to court are recorded for AFP clearance. I think you are good.

Many case files has been opened but just a fee grants out of all. What is happening people.

It appears they are slowing down on grants now but still approving Nominations. This is just the begining of the 2nd half of the financial year. Its too early for that.

The real stress starts when file gets open or nomination is cleared but visa not granted.

Don't worry good things are on its way.

No one knows whats the criteria and whats the system..

    I wish everyone gets PR.

    My good wishes

That is the truth. Nobody knows how they work. Its hard to predict how things would go based on the experience of others. Every case is different. We just have to encourage ourselves to stay calm and hope and pray for the best. I wish you all success.

I’ve just received an email from my MA informing me that my nomination was approved early January.
My status still says received and it may take another few months before they process my application any further but anyway, I’m really happy with the news.

How come no initial assessment or further assessment ?

Your visa file status would remain received after Nomination approval until a CO opens your file. If he asks for more docs it goes to initial assessment. If not the visa status becomes finalized when the visa is granted(that is of all docs have been submitted and up to date). Further assessment is when you have submitted any requested document.

You should add your wife in application and if you married after application than you need to wait for your decision and only Visitor Visa option till approved your case. No other Option unless She will come on Student Visa Or Any other categories. I hope my answer will help you. Good Luck...emoji1303.pngemoji1303.pngemoji1303.png

It would be extremely difficult for her to get any temporary visa including student visa. The best option is for you to wait till your RSMS is approved. As you have added your wife to your application, she would not be able to meet the genuine temporary entrant (GTE) requirement which goes with any temporary visa like visitor or Student Visa. That means you would not be able to convince the CO that she would return when her Visa expires. Please dont spend more time or resources on any temporary visa including student Visa.

    Hi guys

Is anyone experiencing 485 visa refusal because of  AFP. Reason my MA applied my visa without AFP and I did apply my AFS next day of lodgement application then straight away send to department of immigration. Then after 1 month case officer issued me to refusal. Because in 485 visa application we have to apply afp before application. Now my case in aat from 16 months and I’m on bridging visa A. But I applied 187 offshore as motor mechanic in dec 17.

Is anyone else has experience in 485 visa refusal due to late submission of afp ?

is any chances of success in att regarding this case?

    thanks

I have seen 2 cases of 485 visa refusal because of non submission of AFP with application. They won the case at AAT.

Hello brother, just wanted to know is this kind of cross verification is common for all application? And what are the chances of getting nomination approve? Please reply.

The Department does a lot of internal checks but the extent depends on whether or not there is a suspicion. So the check may vary from one applicant to another. Since the mistake was from your MA and not from you directly, I think your Nomination will go through if your MA is able to give a good explanation. How big the company is ( turnover) is important because they have already sponsored someone else on a 457. All the best.

so CO didn't even open the application yet? OMG why does it take so long?? very annoying.  I applied for new AFP on friday, so that will take some time also I need to attach criminal record from one more country and that may take a month, hopefully not longer. But none of it matters if the CO does not open the application for months.

    keep us updated.

Every case is different. Your file might be open by CO fast. We don't actually know how they work.

    Hi everyone,

I have been following this forum since 15 months and i have posted queries and got good response from readers.

Today i want to share my timeline. I have lodged my rcb and nominationDE offshore on may2017,position hairdress location nsw, rcb approved in 10 days and On 23rd jan 2019 my nomination file has opened after 20 months and case officer asked my MA few question like current staff, previous staff history, and immigration have called at work place, case officer have mention all my 8 years employment history and they have investigate all my work experience but apparently few businesses have shutdown and contact numbers are not in used,

The very big question a raise by case officer is that 2 months ago my lawyer have submitted business organisational chart in which they have mention one 457 visa holder as an australian citizen which is actually not a citizen and i came to know today after seeing the email from immigration and when i asked my MA she said it was by mistake so, i am worried about my file and i dont know what will be the decision from case officer and reply should be in 28days. Anyone have any idea in my case?

That is called "adverse information" in immi terms. Immi takes it very seriously. But the good thing is the adverse information is against your MA and not against you directly, but it may still affect your nomination if your MA is not able to do a very hard work to reverse it. Even if reversed, having someone on 457 and sponsoring another overseas employee becomes the next question. This can be argued if the business size is big. Your MA has a huge work to do.

When there is an adverse information against the visa applicant, it may lead to at least 3 years ban from applying for Australia visa. But this does not apply to you.

    Its a tricky situation.

So, keep praying and I believe your sincere prayers would be answered.

Can people tell me how did you know you got your nomination?? Did you agent send you some kind of proof/document or simply told you?

My agency claims i got nomination on 15 Jan 2019 but when I log into immi account there is no messages, status received, and when I asked my agency to send me some proof/document about nomination they don't reply...something doesn't add up in here..

Most MA would not send you the nomination approval letter, because it's actually for your employer. But they will send you an email or give you a call to let you know. You visa file status will remain as received until it allocated to a case officer. That is because the visa file is different from the nomination file. You won't see anything about nomination om the visa file. So i think everything is fine. You just have to relax and wait to hear from the CO when your visa file is allocated. This might take few weeks to months.
