    Hi everyone,

Finally after 23 months of waiting, my Office Manager 187 Direct Stream Entry visa has been open.

The DHA has come back to me asking for some more documents which fortunately  I have and will be providing to them soon.

Does anyone know how long does it take to get a response once all the required documentation are provided to the DHA? do I have to wait the 28 days or there is a chance that they will come back to me earlier than that?

    Cheers

Hey, I follow another forum post on here called '187 Processing Times' and the Office Managers on there got their visa approved within a few days! Good luck ?

I believe they are doing exactly that. Certain occupations have not been touched or are getting the odd rejection/approval but hardly any! In my eyes this relates to Office Manager, Retail Manager, Chef and Cook. All other positions such as Childcare Room leader, Massage Therapist etc seem to get their answers much quicker.

I am an office manager waiting since October 2016 and there has not been ONE office manager with a rejection or approval since I joined this forum probably a year ago!

So no doubt I will be in a similar boat with Personal Assistant. What a joke!

Hi everyone, I applied in December 2016 as an office manager still no news. It seems like they are not touching office managers files at all. Anyone has a clue about it

Have you had any update? I'm not sure they would process applications in terms of 'positions'.

There’s only so much a person can take.

But I guess the imm departments never really saw us as human, they only take us as a tool to benefit only the Australians.

As they keep taking in the refugees and acting so kind to them,we are suffering so much and don’t even get to decide our own fate.

im guess the time will only increase to where they suck dry every bit of hope and life out of us,then they will decide our fate depends on not the fair judgement but only on how good the coffee they had in the morning.

    To hell with the system

I reckon they are trying to force people to leave the country or change their visa.

This is totally bullshit. Why we have to wait for  24 months. How they are processing 186 visa in 8 to 12 months and we need to wait and suffer. We can’t go overseas to visit our families. We all need to stand for it. We have not see any of us has granted 187visa recently. I think they stop processing 187visa.

Why can't you go home? You just need to apply for a Bridging Visa B. I'm just back from a month in Scotland (home)

Haha aren't we all though?! In saying that after 15 months of waiting I'm sure we have the right to be feeling a little impatient! It's difficult isn't it, especially when people say "think of the bigger picture" yes I understand that but the bigger picture is full of debt, set backs and increased waiting times from our point of view haha!

Do you have an MA? Speak to them about your concerns. After feeling like I was a nuisance to mine, he really pulled through yesterday and emailed back saying that asking questions is what they are there for and not too take too much advice from forums as each case is different. It's great hearing other people's perspective but unfortunately visas aren't black and white so it can get very overwhelming and confusing with all the different info and opinions. This was part of my update from my MA:

Once your visa is granted you are required to stay in the State for 2 years, not with your employer.  if you leave your employer to take up better opportunities but stay in WA you wont lose your visa.

Im going to trust his word as he is the registered MA out of the two of us, and he handled my application so knows it better than I do!

I hope things at work get better and your prospective family plans fall in to place ?

Yes bigger picture, when!? My MA has been great and they are always so supportive and helful but no one can help with the frustration the wait times cause. Yes agreed, I believe each state has different rules.

Thank you so much, that was really kind and I hope to see you post your good news on here soon! x

Seriously I don't think I can find your MA's statement anywhere within the legislation of RSMS visa. If he's so sure about it he might look for the statement anywhere, but here's the statement my MA sent to me.

    http://www9.austlii.edu.au/cgi-bin/viewdoc/au/legis/cth/consol_act/ma1958118/s137q.html

Section 137Q – Regional Sponsored Employment Visa Section 137Q cancellations concern visa holders sponsored under Regional sponsored employment.  Cancellation can turn on whether the visa holder failed to commence the employment referred to in the relevant employer nomination and whether the visa holder has made a genuine effort to commence that employment within the prescribed time frame. The visa can also be cancelled if the visa holder commenced the employment but left the job within 2 years.

    How is the Department notified?

,Generally speaking, the most common way for the Department to find out is through the employer notifying the Department that you have either failed to commence employment, or you terminated your employment before you have completed 2 years after the visa is granted.

The Department can also find out about the termination of your employment through information that it receives from other government departments, such as the Australian Taxation Office, the Australian Securities and Investments Commission, Centrelink etc.

As the visa holder, you are not under any specific obligation to notify the Department if your employment is terminated.

I think WA may have different rules but yes, I can't find it anywhere either.

Oh wow, as much as it's a shame you're going through the same rubbish, I'm also glad that someone is having a similar experience to mine! Haha. As doom and gloom as it is, I feel like there is just no happy ending at this point! I'm in Western Aus and have been regional for almost 3 years now ? how about yourself?

It sucks big time. Lets hope we get some news soon, like NOW - haha I'm so impatient. Regional Queensland for 2 and a half. At my sponsored job for nearly a year and I'm sooooo unhappy. I don't get great wages either which is depressing. Hope you are keeping well x

Hi everyone, new to this forum so excuse any rookie mistakes! ?

I applied for the 187 direct entry stream as a personal assistant in April 2017, RCB approved in the May. No case officer assigned and by reading this thread i'm guessing most people have had to wait around the 23 month mark?! I was only 4 months off the 17 month mark before the processing time changed, i'm beyond devastated!

In theory, my two years with my employer will be up in September, my migration agent said those two years begin from the moment of employment, whereas I've had other people say that is not true and that the two years begins from the visa being granted. In my time there so far I haven't been 38 hours and have been stuck on $22 an hour the whole time, as my employers have said it is based on whether or not I get the visa?! I also paid for every last inch of my visa and so being in this position for nearly two years now has left me in debt due to visa payments and only being on a basic wage and I have not progressed in my career half as much as I would have liked by now, with this particular company. Does anybody know where I could find the required wage and hours for my position, as I've been getting conflicting information on this as well.

Any advice would be massively appreciated, whenever I call my migration agent I'm made to feel like a nuisance and get no information whatsoever (again, understanding much cant be said on processing times as we're all in the dark!) Oh and to add to the mix i'm also pregnant and would like to marry my partner, but we are stuck in limbo with all this and I have no idea what my entitlements are and whether I will have to leave with the baby, and without my partner ? HELP! haha.

    Thanks in advance.

Commitment to work for 2 years from date of visa approval

    ,

In the visa application form, as the applicant, you are required to declare that you:

    1. Agree to work in the nominated position for at least two years
    2. Understand that if you as the applicant, or any family members included in the application or third parties acting your behalf, provide (or have provided in a previous application) false or misleading information, or bogus documents either knowingly or otherwise, the visa application will be refused and you may be subject to three year bar in relation to visas to which the fraud criterion applies. Any visa granted may be cancelled.

Effectively, this means that when your visa application is lodged, you must have the intention to work for your sponsoring employer in your nominated role for at least 2 years from the date that the visa is approved.

You need to continue to have this intention until a decision is made on your application. If your intention changes before lodgement, or during processing, and you no longer intend to work for your sponsoring employer for at least 2 years from when the visa is approved, then you should either not lodge the application or inform the Department and withdraw your application (which ever is applicable to your situation).

We are almost on the exact same timeline, and your story sounds similar to mine although I'm not pregnant...... yet! Here's hoping for good news. Where abouts in Oz are you?

I'm 32 and also want to start a family, and my job is the biggest challenge I've had in my life.

My advise is: don't wait. In a bridging visa you have Medicare and even if your visa is denied (hopefully not!), but you would still being able to apply for review and it would take another year or two, so plenty of time to have a baby while on Medicare. ?

If you approval comes soon, great. If not, at least you are investing in another dream.

I know it sounds bul.. but keep it positive and get busy with things you enjoy. It will be worth it.

Medicare doesn't cover baby costs. Requirement of my visa is private health care?

Do you work on weekends as well?

What about going to the beach, finding a hobby, some activity that will help you get through the process?

My husband got really depressed and I don't wish it to anyone... he just got better after engaging in some sports.

    No, I'm still waiting... 23 months. ?

I work at home at the weekends, live on a farm so plenty to do. I love my life here but I just want to be able to plan for the future.

    Thanks for your suggestion though

  13.

Agreed! Its pretty stressful being in limbo for so long. I applied when the processing time was 5-8months (oct 16) with the expectation of spending around 2 and half three years max in the outback. Now looking at 4 years minimum and unsure if thats really what i want.

I figure ive been waiting nearly 20 months now so im just going to try and wait the decision out and hope spirits are lifted, weight of my shoulders etc or if its refused then thats the decision made for me and i wont have the' what if id of stuck at it' thoughts.

I know it dosent feel like it but everyday that passes is one step nearer to a decision, everything crossed for everyone ☺☺

I want to start a family, I'm 30 and concerned I will never be able too ? Plus I'm not overly happy at sponsored job!

    Fingers crossed x

Its hard but try to make the most of your waiting time... get busy, travel, do things you enjoy.

When I applied, the deadline was max 6 months, then 10 months..then 12 months, then 16 months...etc etc. It's been 23 months and only on the last 5 months I started to enjoy life. Don't make the same mistake. ?

I work 6am - 5pm most days at my sponsored job and travel 40 mins each way every day so I don't have time to travel no more ?

    Has yours been approved?

You are lucky, i have being in the regional SA for almost 3 years. Just submitted my application September 2017 with no news yet. My problem is not the waiting time but my family is in shambles as a result of that.

Yeah me too - regional for almost 3 years... submitted in August 2017, still nothing!

I applied nomination & visa on 30 & 31 October 2017. At that time, the processing time was 15 - 17 months. This time is changing every month. Lastly, it was change on 15 May 2018 for the applications moved in April 2018 as 21-23 months. In this situation, the Department of Home Affairs will consider time as 15 - 17 months of 21 - 23 months?

It's so hard to remain positive!
