  1. How Can the DIBP know?

In most cases, your employer serves as the trusted source of the immigration people in finding out that you have been remiss in observing the stipulations on your visa.  They will be the one to inform the proper authorities that you either fail to commence employment or you end your employment before you have completed the prescribed two-year length of service.
Apart from your employer, the other sources of information of the DIBP may include other government departments and line agencies such as the Australian Securities and Investments Commission, Centrelink, Australian Taxation Office and others.
As a visa holder, you are not obliged to inform the Department about the termination of your employment.  Hence, it’s the government agency tasked to oversee the status of non-citizens living in the country that would determine your case.

  2. Cancellation of Regional Sponsored Visas

The reasons why RSMS visas are canceled.
First off, section 137Q of the Migration Act 1958 empowers the DIBP to cancel RSMS visas (subclass 187) under certain circumstances.  But two reasons stand out among the many as to why such visas are canceled.  These are:

you do not start working in your nominated position within six months from the date of the granting of the visa, or you fail to convince the DIBP that you have made a genuine effort to start working in the position you are supposed to undertake within six months after entering the country.

you start employment but you terminate it within the first two years and you fail to satisfy the DIBP as to your effort to remain in your sponsored job for the prescribed two years.

  7. My status is initial assessment too. Does this mean my nomination got approved?
Did they asked for extra documents.
Initial assessment basically means that your file is opened.
Also from initial assessment it will move to further assessment and then the final outcome.

But honestly no one knows what criteria is followed and how things work ?
some people just go through straight away

I wish you all the best

  9. After Nomination approval, there is 99% chance of Visa grant. The few reasons for visa refusal are:
    1. Serious criminal history (that went to court)
    2. Serious Medical condition (that is likely to be burden to australia health system eg HIV/ AIDs, Kidney failure requiring regular dialysis.
    3. Character isssue including bogus/fake  documents and fake Certificates in your present or past applications.
    4. Qualification not matching position.
If you dont have any issue with those, you will sure get you Visa. I only know of one person that got refusal after successful nominatuon because he had Cert IV. But he won the case at the AAT.
    All the best guys!
I know 1 case where visa was rejected after nominations. That family was from UK.
Actual reason is not told. But nominations were approved successfully.

  11. Hi, They had requested for updated reference letters in June 2017 which I provided within a week. The status of my application has been "further assessment" ever since, over 1.5 years now. My nomination was approved Aug 2017. It has been that long, I don't even know what to make of this lengthy wait. Have called the department multiple times and they refuse to entertain because I am still within the 22 months processing time frame.  I am so disheartened. [emoji20]

OMG .. THIS IS THE MOST SHOCKING AND STRANGE THING I HAVE HEARD SO FAR.DOES "FURTHER ASSESSMENT" MEANS THAT NOMINATION IS CLEARED OR NOT ?

I believe in your case there is some kind of miss.. otherwise its not possible.

Also I am assuming it is Aug 2017 not 2018 as you have written correctly.

Btw they count 22 months from nomination filing date or visa filing date..
