  1. Once you are married you need to apply for the partner visa pretty quick sharp in view of your timings. The bridging visa I snot something that you can apply for separately, it will be part and parcel of the partner visa application. Partner visas take a long time at the moment, about a year or so, so you will definitely be on a bridging visa for some while.

  2. 2 out of my 3 children suffer from chronic asthma? Has anyone from Melbourne or Sydney moved to Brisbane for asthma reasons and seen an improvement? My kids are 1 and 6. Any feedback would be appreciated. Thanks :wink:

     

    There are numerous asthma triggers, one is humidity, so asthma could get worse. I think there is really no way of knowing unless you have a very good understanding of your children's particular triggers.

  3. There is no requirement whatsoever to inform HMRC, UK is not a police state and you are free to come and go as you please.

     

    If however you believe you would be entitled to a tax refund, then you may wish to inform them via completing a P85 which is a tax refund form. And if you are required to complete tax returns, then you would of course need to highlight your non resident status at that point.

  4. I know this is an old thread now but I just wanted to thank everyone who had replied. I haven't been on here much...unfortunately my Dad passed away some weeks ago. So the countdown is on now to move back. I think unfortunately that I will have to go back to Australia. My husband and I will be having counselling but I can't see that will change his mind. Even if I am miserable, at least I can say I've done all I can to keep my family together and kept to my side of the "deal". My husband has made it clear that if we stay, he wants us to split up, so it's no real choice when put like that. No one said it was supposed to be easy, hey. Thanks again all x

     

    Well I just reread the thread. I stick to my earlier view, you willingly moved to Australia, had your children in Australia and promised to move back to Australia. I would also divorce you if you could not be true to your word. And whether I think Australia is better than UK or vice versa is irrelevant. You promised.

  5. They can't delta an AGM for heavens sake. I expect there is nothing that they would like to do more. But they can't delay an AGM and it is normal and proper for CEO remuneration to be voted upon at the AGM.

     

    It disgusts me that some people are using this tragedy to rail against others just because they earn more. Grow up and try to control your jealousy.

    I don't know what contet your snippet is from or what you have missed or inadvertently cut out. The baby can sponsor with an adults help, but a parent visa will never be free. It has to be the most expensive visa going.

  7. Some travellers might get a refund, others might owe, others might have paid the right amount of tax. It is quite a common belief that travellers always are due a refund though.

     

    Still if she only worked two months, then it is entirely possible that she did not get the full use of the personal allowance and is owed something back. With the back of a fag packet and a calculator you could probably work this out for yourselves by referencing the twx bands which you would find on the ATO website?

     

    If tax is owing to the Australian government, then yes it would normally prevent a visa being issued in the future, until such time as the debt is settled.

  8. This visa is intended for parents of settled adult Australian residents. The 'child' in question has to sponsor you. They have to go to Centrlink and be interviewed about their ability to provide for you if necessary for two years. This process includes providing pay slips to prove their income. I doubt very much whether the 143 is the way forward for someone in your position.

     

    The parent visa is for any parent. If the "sponsoring" child is underage then another adult, such as the other parent, can step in on behalf of the child. I agree it is not the way forward though, but mainly due to cost.

  9. Thanks for that :) what would be your reason not to base it as a holiday base for the month? It is about $400-500 cheaper than around bondi etc that's the Main reason we've been looking at it to be honest

    I would happily live in Neutral Bay. For a holiday my personal preference would be to stay in the CBD, no reason why you should, it would just be my personal choice to be able to walk to all the city centre sights. I would not even consider staying near Bondi, I would stay in Neutral Bay rather than Bondi if that was the choice.

  10. Yes it is handy for the CBD. Although it does get heavy traffic in rush hour, but like most places really. Not particularly handy for Bondi, that would be into the city and out again. It would be handier for Manly. I am not sure where to start in describing it visually, but it is somewhere I would be perfectly happy living in if I found the right property.

     

    ETA: I just realised you only mean holiday accommodation, in that case nah it is not where I would base myself for a holiday.

  11. if iam not wrong, one of my friend's initial 5yrs of PR was finished and he went to immigration to get a new STAMP which showed for the next 5years.

     

    No they would have gone to get a resident return visa.

     

    PR does not "finish". It is permanent.

  12. Before the epiry date of your PR just come to Australia, and your PR will be automatically extends to next 5 years.

    To become Citizen you need to be in Aus for 4 years including 1 yr with PR.

    You dont need to stay continously until next 4 years to become Citizen, ones your PR extends for next 5 years you can travel as you wish, But what ever the time you will be out of Auatralia you have to wait those many days more to apply for Citizenship.

    Just to clarify. PR is not extended, it doesn't need to be because it is already permanent and something permanent cannot be extended by definition.

     

    The right to travel to Australia is not permanent but it certainly isn't automatically extended. Permission to continue to travel to Australia needs to be applied for in the form of a residents return visa.

  13. Hi, I am literally a newbie to this.

    Im 27 from Uk and have been a registered nurse for 18 months.

    I wish to come over and work as nurse (for an undertmined amount of time).

    I also want to bring my partner over, he is 32, Britsh and a HGV driver.

    We don't live together at present but have been together for 6 years.

    What visa can I get so that both of us can come over together, and he can work too? How do I prove we've been together this long?

    Is there a particular reason you do not live together? If there isn't, well then it doesn't matter how long you have been dating, it is of no relevance, you are not defacto and will not be able to lodge a joint visa aapplication. I would suggest putting it on hold, living together and accumulating proof of such. Oh or you could get married.

  14. Employer has 2 shop in different areas and I guess someone in other shop made anonymous report to Fairwork. I think he or she left a job for long time and doesn't need to get back money, maybe just do for destroy business. Actually, employer usually hiring ovearsea people that work overtime and under paid for long time.

     

    In this situation, I got employer 's warning that If FairWork can find out my overtime working hours, my Pr can be bad effect. So I worry about this warning, I should keep sercet story or FairWork find out this story and they will say I am lier. Any suggestion to slove this problem ???

    I am utterly baffled as to what you think this has to do with your visa.

     

    You have a PR visa, you need to stay working for that employer for two years post visa grant. So long as you do, your overtime arrangements are irrelevant.

  15. The future is not uncertain because of Brexit. The future is ALWAYS uncertain, because it is the future and nobody can see into the future. Make your decision based upon real factors, not some fallacy that you can see into the future or once could. Indeed many people would say it is a gamble to leave secure well paid jobs, no matter what direction of travel.

     

    We took our decision to move back about this time two years ago. Just have to weigh up the pros and cons for you. I would not be making the decision near Christmas or after a holiday though, it is better to make this decision in the cold light of day not post holiday and certainly not post Christmas holiday.

    Yes they will. Even more reason to put her on the application as migrating as she is going through all the same motions anyway and then won't get a visa at the end of it.

    Yes I know you did. But I thought you still might not have fully understood the consequences and indeed did not seem to realise that it is by no means too late to rectify it. In fact you still do not appear to realise that. It would be very easy to add her on to the application now, there is no question about "whether it is possible", it is totally possible but you must do it without delay because once your visa is granted then it is too late.

    know that our bank rate in the UK is very low

    our Australia bank is sort of ok, seen better days

    question is should we put the money in the UK account to transfer when maybe interest rate improves in Australia

    or have my solicitor transfer it directly to our bank account in Australia on completion

    I would be basing this decision on exchange rates not interes rates!

     

    If you don't immediately need the money for something, I would leave it in UK for the medium term and wait for an exchange rate improvement.

  19. I have a baby with an Australian man. My visa has expired and I've had to return home. Our baby is currently in oz. My question to you is...where would I stand if the father refuses to bring the baby back to me in the uk?

     

    Oh blimey. I would have stayed put and become illegal if need be!

     

    If the father will not bring the baby to you, you would have to lodge a custody battle but you should not expect to get the advantage of being the mother in this case, it will be heavily weighted to his favour.

     

    Hopefully you can find an amicable solution, are you still a couple? If so, partner visa. If not, would he be willing to sponsor you on behalf of the child for a parent visa?

Hi SOMV, Thank you for your response. in line with your advice i have phoned and ask why they are requesting it as my partner is not included in the migration and the response was that the case office has the right to request the details if they want and that non migrating person must meet the requirements. Like you suggested i am going to supply the information as requested as i cannot see any other option As she is on a 422 which allows her to stay and work here we prioritized getting my visa, in retrospect it would of been better for us to have a joint application. It appears exactly as you said that it looks like it is a lot of new workers and maybe experience is playing a part. I dont mind providing the information, i just wish there was a definitively list of their requirements on everything that is required. Each separate request is not related to the previous submission, it is very piecemeal and frustrating. Hopefully i will get there. Thanks again for your advice.

     

     

    You are doing your partner a HUGE disservice by not including her on the application. It is not too late to add her on, I would implore you to do so without delay.

     

     

     

    The 422 visa is a temporary visa and it always will be, she will never obtain the rights of a permanent resident or citizen on this visa, including social benefits if she falls ill and cannot work. A few years ago there were terrible floods in Australia and even the help provided to those who lost their homes was not extended to NZ living in Australia temporary visas.

     

     

    You say that the priority was getting your visa. This makes no sense as you could get the pair of you a visa at the same time, priority doesn't come into it. Please please update your application.

  21. Wooba, Yes, things are starting to look pretty positive now, although I have spent most of my nightshift finally getting to the bottom of it. Apparently I will need a variation of conditions to my visa which isn't that cheap AND I'm not sure why I need this just yet, but the main thing is that it can be done :)

     

     

    Well I would make sure you get a cast iron guarantee on that. I personally think you are wrong. I have been on migration forums for a long time and this has come up loads of times. The consensus has always been that once your Australian travel rights expire the NZ ones will too and you would have to go through the NZ visa process or stay put until citizenship. If you find out otherwise, in that you manage to re-enter NZ after the Australian visa has expired then would love to hear about it as it would be useful to know.
