  1. HI Nemesis Thanks for sharing this. Can you please tell how long ago were you told of this wait time?
  2. Hi Andy English and Urdu are both written on the same Nikah Nama? If yours only had English and this nikah nama is officially approved by Pakistan Govt then you should be ok in advising you only did the English one. Worse case you can ask the person who did the Nikah to make the urdu one for you. Also just a curious question.....is Andy your real name? if yes have you married someone from Pak? you can choose not to answer these and it is ok.
  3. Is anyone of you in Australia? Anyways I like that you have challenged the case officer - get them on their toes
  4. Thanks for your wishes. Yes it sucks big time! but I am hopeful. what you are saying re application recognizing the sponsorship criteria.....this makes sense so therefore it will not be implemented - especially in immigration. Common sense is a sense which should be common but it is not common.
  5. It does not matter if you are sponsoring a second time. By Law you can only sponsor 2 partners in your lifetime. so this is your last and final call mate! Also what was your first sponsorship application date? please note this is not the grant date but the date you submitted your first sponsorship application?
  6. Yes I certainly can. There is a clause 1.20J which has limitations on sponsorship. Between 2 sponsorships there should be a gap of 5 years. Yes you read that right - 5 years from the time of the first sponsorship application date (not the grant date). So let us say that you sponsored your wife and lodged the application in Jan 2016. After 2 years you guys broke up and you withdrew the sponsorship. so until Feb 2021 you cannot bring your new wife/partner from overseas unless you have compelling circumstances. So unless I can climb on top of building and say I will jump if you do not agree to my circumstances being compelling, chances are your situation will not be compelling. Also if your ex departed Australia and never applied for a perm visa or any visa - that does not matter - still you have a 5 year limitation. How convenient really!. I was not aware of this until I had lodged my application. The application does not cost 2k but bloody 7k. So for me to lodge another application is very difficult. I have already spent 11k on this. Now the AAT will come in handy as they see the application at the time of the hearing so my 5 years finished in Feb 2018 this year so I am all good now. My application will progress but I have to wait until AAT looks at my appeal. so I have the option of a fresh application which costs dearly at this time. Hope this helps.
  7. Hi Everyone i just want to ask if anyone on this forum has partner 309 refused and has lodged an appeal with AAT? Reason I am asking is to ser the timeline for appeals to be heard. I lodged appeal in sept 2017 and still waiting 8 months now. I know about AAT website has processing times and currently sitting at 40% completed and average time from lodgement to hearing is 365 days which is 1 year. Has anyone been through this and how long it took?
  8. Hi can anyone please help in sharing some questions immigration is asking of sponsor and applicant
  9. Just asking a question.....has anyone been married over the phone and then lodged the application? if the husband or wife is in australia and the marriage nikah was done on skype or over the phone and then application submitted? Grateful if someone can reply so I know how such an application tracks
  10. Yes mate I have one advice for you next time you contact the department, please ask them to subscribe your email or even better your mobile phone number to an application event tracker. everytime anything happens to your application, you should be notified immediately without any delay. try it and let me know how you go. Food for thought - when you applied did you see the processing time for this application? likely yes you did, so just follow the process and enjoy the experience. Also do not forget that other people who applied before you, because of the way they applied and information they gave, we are now in this situation. so enjoy the ride mate
  11. mate what is the confusion here? 9-12 months is the SLA. So i will do the maths for you here. Feb + 9-12months = Nov-Feb 2017. Are you expecting them to grant you visa before time? At the time of applying you were told of the time frame. So wait patiently اِنْ شاَءَ الله
  12. This is indeed a sad news for both of you. What I suggest you do is address the reason they have given for refusal. usually from my experience, AHC is very fair and square. If something does not make sense, they will stop and investigate. They will hire local people to go and investigate in your mohalla, school, job, bank etc. and verify the information in doubt. What you need to do is NOT PANIC. Read very carefully the reason for denial and work your way through it. If you have any reason to hide certain information, re consider it. I can say one thing safely. AHC have found a misinformation in your application and that misinformation is very clear in the view with a proof. This is the only reason they will refuse a visa. They have substantial information. Having that said - this does not mean they will not issue you the visa. You just need to look into your application and apply again properly. Allah make it easy.
  13. اَلسَّلاَمُ عَلَيْكُمْ وَ رَحْمَتُ اللهِ وَ بَرَكَتُهُ Great! Let us wish each other happy new year. After all this is the beginning of a new year....ohh hang on. Sorry! Being a Muslim my new year started in muharram couple of months ago. There is absolutely no promise of Allah swt of solving problems with the christian new year. Not even muslim new year. Although prayinh salah and asking for help will solve the issue. Wanna try? His (saw) companions did it all their life. جَزَكَ الله خَيْر
  14. it is ok. See you do not have to prove your relationship with all the evidence. I recently had my wife's visa granted. She was asked the same questions as you have mentioned (additional evidence etc). I only had very few call records with skype viber etc. i said my wife does not use internet so no email records r there. I also showed financial assistance that i had given her (money transfers from melboure to her bamk account or to someone ellse who can hand her the money a relative rmetc) Also showed my itinerary that i visited pakistan to see her. I also showed bookings for a holiday we had in bhurbhan PC. I also mentioned that being a practicing muslim we do not take photos as it is not permissible in my religion ( affidavits u have given earlier are legal documents and is a sound proof). I hope his helps. Whatever evidence u have just give it. No need to create it. Allah has made u both husband and wife. Remember this is from Allah. He will inshallah help you both. Allah says to ask from me in times of difficultu with patience and salah. Bow is the time to do it. Inshallah next email will br ur visa news and a good one. جَزَكَ الله خَيْر
  15. Hi All My wife applied in march this year. Visa granted last week. Just for all the whingers out there: do the right thing (if u know what it is) and ask from Allah. Be patient as well. I have waited for 4 years now for my wife to join me. Guess what? The issue was not visa but something else. So u r all better off wIting just 12 months! Also do not abuse AHC. Just sit on the otherside of the table. Salaam
  16. yes people are free to comment on this forum. Yes it is indeed a long wait. we just need to get over it and see past it.
  17. Then stop judging me please. Whether to subscribe or unsubscribe from this thread - I am not taking advice from you so please keep such free advice within your circle of friends. I know you cannot understand what I am saying - so I am not going to repeat myself again (just deal with the fact that it is taking 6 to 9 months and tell your spouse about it all night if you like). You me and all are in this hole NOT because of aussies, but because of how we have acted in the past. We should learn from our past and put actions into place to avoid it happening. All of us are sharing our pain here....the benefit of this exercise is very limited to oneself only (i feel better after sharing and knowing others are also in the same boat). I have not heard anyone on this forum say that how can we avoid this happening in the future? everyone is thinking for themselves not realizing the problem? even if we do realize the problem, we want others to fix it. it is like I keep on coughing and so does my family. so I would not go to the doctor to find out why we keep on coughing but I will keep on taking the cough syrup off the shelf. for sometime the cough goes away but comes back again. so I will take the cough syrup again and so on. Any sane person would say - why do not you go to the doctor and get yourself properly checked? Why someone would go from 3 months maximum spouse visa processing time to 9 months? (if you do not understand what I am saying, please ignore this and do whatever you are doing)
  18. Partner Visa is not a challenge in itself? can you please explain what is the challenge with it? I am very keen to know what is the issue with this visa? Before you reply to this, I want to share some information with you? not long ago, spouses from pakistan were being given visas in less than 3 months. yes believe it or not some people even got it in a month and less than a month. But we as a nation do not thank and respect anyone whatsoever. Now the same Australian Consulate is taking 6 to 9 months time to process the application. Do you know why? have you ever thought why? wanna know why? we taught them how to cheat and lie and not trust on humanity grounds. Now Australian Consulate has eventually given up and employed local pakistanis to find the scammers and people who lie. This now takes much longer than usual. They no longer trust the documents. Can you believe it aussie girl bay that despite the marriage certificate, we are to provide 6 statements from 6 different individuals who verify the marriage to be genuine? to me this is ridiculous. but if you sit with immigration, you will understand why. Forged documents, fake documents, DOB being different on different documents etc....all are serious offences....but to us as a nation....this is normal...so all of us now suffer....so please welcome the 6 to 9 months waiting time. Just putting some context here.
  19. Clearly you are upset with my post. Very few people share their experiences here.....mostly it is not very beneficial to read the posts being made here. All I am saying is to limit the frustration here and post some meaningful and helpful information - simply asking how long will my visa take again and again is not going to help. I do not understand why people are worried before the 6-9 months time has not passed? what is the fuss about? if you are so needy, why do not you go and live where your spouse is until visa is granted? now this we cannot do but will ask all sorts of questions here for which there is no answer - complete waste of time. Yes we should show respect to people who share their experiences i.e if they do so. Have you thought about this - that some might read from this post and start to get worried about their situation? only to find out that the person read it somewhere from the internet? has no merit whatsoever....how much hurt and worry would come to this person? this world is full of intellectuals and non intellectuals as well. Not everyone is good at reading and putting things into perspective. So please save some trouble and only post what you have heard from your case officer and quote your circumstances so some context can be seen and understood. this is sharing experience....not asking again and again when will my visa be granted. I have stopped driving so many times just to read a post that has been made and only to find out that it is not really helpful.
  20. I just want to say to all you people out there who have applied for spouse visa. What is with you all? before you apply it is clearly mentioned how long it can take for the visa to be granted. If you have any issues/concerns with this, then link with the embassy before applying. Once you understand and apply, then I do not understand all of such posts (how long will it take? what happened to my medical? etc etc). You read from anywhere on the internet, start to believe in it and then confuse everyone.....you know what there is a life quota fixed by Allah as well - you never know you die before you get the visa.....wanna challenge this?
  21. Hi Punjabi Get your husband to attach a notice of assessment from the Australian Taxation Office (ATO). This proves that he lived in Australia, worked in Australia and files tax returns. Also attach the copy of passport and license with address on it. This would ensure your concerns are met.
