Hi Kitty, we are in the same position. Our 2nd VAC was requested yesterday for our 143. We are currently onshore( on a three year 870) and have requested our visa to be granted but expect to be told this can’t be done. Will pay up and wait and see when and where we can travel to validate the visa. Worrying times for everyone.

    Hi Big trev
You guys have been asked to pay the second VAC for 143? Really?
There are a a few people in this forum who have also paid the secind VAC but have been waiting for the GRANT.
I wonder what that entails as the borders are still closed, 4000 capping on people returning from overseas.
They shouldnt be askig for secind VAC unless they are ready to grant the visa soon enough.
Will be keen to know what happens .....

  2. Hi All & @Alan Collett

So I was a bit confused as to what to do with my Mom's 1 year arrival in Australia anniversary which was coming up end of August 2020.
She does not have the 8558 condition but has 12 months visit on each arrival.
Her current visa was not going to expire until June 2021.

I decided to apply for a new Visitor Visa (600). When I lodged the application online today and paid the fee. I got automatic application received notification as well as a notification for grant of a Bridging A Visa while they process my Mom’s visitor Visa (600). Also note that the Bridging Visa A letter says .... Visitor Visa: Active,  Bridging A Visa: Not Active.

I have a feeling we would have gotten away without doing anything until the department informed us that my mom has exceded her stay or has become a non-genuine resident; but we arent taking any chances!

Note: My Mom (in Aus at the moment), and my Dad (In NZ at the moment, he couldn’t get back before the border closure) are both at the point of “Second Vac” payment.

I hope this information is useful. Thank you all for your contribution to this page! All the best!

@Alan Collett This is what a mate of mine got when he sent in a request for the 8558 waiver.

If you hold a visa with condition 8558 you should depart Australia before the date on which you will have stayed in Australia for more than 12 months in any 18 month period.

If you are unable to depart Australia before this time for reasons beyond your control however, we do not expect you to apply for a further visa unless you are unable to depart before your visa expiry date.

Your ‘No Further Stay’ waiver request will therefore be prioritised according to the visa expiry date, and not the date on which you will have stayed in Australia for more than 12 months in any 18 month period.

Condition 8558 is not able to be waived, however a breach of this condition under these circumstances will not result in visa cancellation or have any negative consequences for a future visa application.

    @cfernandes This a great.
But it might be good if you have your own reply from the department so you can use it as an evidence later for your own circumstances.

If it is granted I'll be very surprised - so far as I'm aware there is no legal basis for a BVA being granted to your mother.

The BVA application form is attached.

    Best regards.

    Thanks Alan.
    Filled 1005, 956A
    Lets see what happens.

I have filled out the ONLINE 600 (as a backup) already but will send in this one as a paper application.

    Cheers!

I wasn't referring to you in the context of condition 8558.

As a rule a 143 visa can only be granted onshore to a 173 visa holder - unless your mother has what is called a substituted subclass 600 visa.

Unless I'm missing something in your mother's situation I'm not seeing a basis for a BVA to be granted to her.

    Best regards.

    Thanks @Alan Collett
Yes I am aware she needs to leave to get her 143.

I think I am going to take a punt and apply for a BVA, using it as a futher stay application.
Will update you on the results.

@Alan CollettWe do plan to apply to apply for a new visa closer to March 2021 if required. At the moment we are hoping that the borders will open until then and they don't have to do another round of temp visas. They can simply exit prior to March 2021 and return as Permanent Residents.

@cfernandes If one year expires they will have overstayed as per 8558 if they dont leave Australia or apply for another visa.
Again - this is my understanding and I am just reading inbetween the lines. No visa expert.

I would be planning on the basis your parents do not breach condition 8558.

I anticipate this may well necessitate lodging an application for another visitor visa.

    Best regards.

    Hi @Alan Collett
    Thanks for your response.

My Mom does not have visa condition 8558 on her Visa.
Length of stay as mention per the visa is: Length of stay 12 month(s) from the date of each arrival

BVA should be granted to my Mom because she is awaiting result of 143 Visa and also holds a valid 600.
First I thought to apply for another 600 Visa but then she is already on-shore and does not have 8558 or 8503.

@MELBNGSM My in-laws are here in AUS at the moment. However, we are still at the AOS & medicals stage. In their case the visa has an 8558 condition. They don't have an 8503 condition where a waiver needs to be requested. Although their one year expires in October, their visa as per VEVO is valid until March'2021. They will stay here until then. We don't need to do anything at this stage as no waiver is required for the 8558 condition.

Once the borders open up, they will perhaps start asking for the second VAC. Then they can perhaps leave AUS and come back. Hopefully it will be safer then.

    Thanks @cfernandes
I am no Visa expoert but from what I read from your comment. 8558 condition (12 months stay in 18 months). This is a condition in visa and the visa holder needs to comply unless they have applied for another visa which lets them stay longer otherwise the visa holder has overstayed.

Now since your in-laws dont have an 8503, it means they can apply for a new visa without waiver of the 8503.

I am going to apply for a BVA before my Mom's 12 month period is up, because she holds substantive visa 600 and has applied for a substantive visa 143
The only contitions my mom has on her visa are 8101 (no work), 8201 (max 3 months study)

    I hope this helps! Cheers.

Hopefully it’s not too far away. I’m on the same position for my mums visa!

    Good luck!

    Hi Nat & Others.
Has anyone here got parents on-shore in Australia and are waiting for the 143 approval final stage?
My Mom is here and we have also submitted all DOCs and have been waiting for CoVid situation to improve so they progress my parents application, but on 29 Aug 2020 she will complete 1year in Australia and needs to leave the country before that date/unless I apply another visa (not sure). Currently she has 600 Tourist Visa which allows her to stay in Australia 1 year on every visit which expires next year in June.
Does anyone have some idea how to go about getting her to stay here in Australia as it isnt safe to travel anywhere at the moment?
    Thanks!

@MELBNGSM This is excellent news. Some signs that there is some work going on at DIBP. Congratulations on being a step closer!

Hi - yes it is a great news but as you may know that things are on hold for people on final stages of visa until end of May and then reviewed.
AOS is purely a CENTRELINK process which is independent of DIBP. DIBP needs a positive outcome from CENTRELINK for AOS and that’s what we have.

@MELBNGSM even though you may get approval soon remember they are all on hold until at least the end of May. I guess when travel restrictions between Australia and say the UK for instance lift, they will then Re start to issue  🤞

Thanks! & Ofcourse - we just want to be decision ready. As we were discussing - I would like to pay the second VAC closer to when the Borders are open and commercial flight operators are again in business (maybe they wont even ask until that time comes). For now - Stay at home and stay safe!

I had to do the Bank Guarantee as the letter stated I had 14 days to get it done.

Scan bar code or manually enter (circled on top of letter as attached). It then came up with attached bank guarantee. My daughter can’t remember if Q769 came up but someone else has mentioned that code before so probably ok. 0FF3F9BD-251C-4A14-B359-664DE41A7F6B.thumb.jpeg.479d488c7ade92e39a9c751e3bada81d.jpeg

    That's it!

The letter needs careful reading. Take the letter to Commonwealth Bank. You will need ID plus $150. You need your tax number also, if you don’t have a Commonwealth bank account you will need a bank cheque from your own bank (it was made out to my daughters name) for the amount of bond requested.
when you get bond certificate done, you upload it to Centrelink, under “upload documents,” then select “Centrelink form”  scan or manually add the bar code on the top of Centrelink  letter,  it will then say upload bank certificate. Then await AoS approval.

Is this the option I am suppose to select?

FYI - and to help manage expectations of those who are in the closing stages of visa processing - it appears that offshore subclass 143 parent visa applications (along with other offshore visa applications generally) - are not being finalised at the moment due to the COVID-19 restrictions on incoming arrivals to Australia.

We have a case where the 2nd VAC has been paid but visas are apparently not going to be being granted until the PVC returns to its usual modus operandi - albeit that we are lobbying hard for the visas to be granted given the Department has the applicants money.

    Stay hopeful one and all!

Okay! So this means if I get asked to pay the second VAC fee I should try to get an extension or pay it close to when it is required.

If this goes on for 6months DIBP would have the 2nd VAC without giving the visa for a long time!

    Thanks Kath.

I have a CBA account and I will take my Drivers Licence.

This is why I like this forum. The information you provided isnt anywhere on the letter. Yes there is a bar code; so now I know what I need to do exactly.

    So many thanks to you!

In general, an assurer'll get a call from centrelink, then an email of invitation to deposit the bond.  In some cases, there will not be any interview from centrelink but you'll receive the email.

Just got the letter to provide AOS BOND.

It doesnt not say how to provide this bond to centrelink. CBA will know what to do?

    Thanks!

    Now it makes sense.

I got an CENTRELINK SMS Tuesday evening 6:51pm 24/03/2020 saying "A Services Australia Service Officer will call you today from a Private Number. Please answer this call"

I thought it was a bit late for a call but then I never got the call but had an updated status online AOS Application Completed. Waiting for the letter to be emailed sometime but dont know what is going to happen given how many people would want to use CENTRELINK at present.
