  1. It is not clear on the immigration website about successive Visitor visas. History: An application for 12-month visitor visa (subclass 600, tourist stream) was successful and this expires in a few months. Can they apply for successive Visitor visas (subclass 600, tourist stream) for another 12 months? She is the mother of my partner who is having a baby later this year - could be considered compassionate / exceptional circumstances? Thank you in advance

  6. Thank you all for your helpful responses, I am very relieved to hear this although subclass 820 is a partner visa which is temporary. You then wait 2 years to apply for the permanent visa, if this is the case, the line on the Medicare site would mean she is only eligible once she waits 2 years and applies for the permanent one. Is this true? She has about 1.5 years left on her student visa
  7. Hello, I had a question related to hospital expenses for the situation I am in. My partner, who is now about 1 month pregnant is on a student subclass 573 visa. I am on a permanent residency visa. Over the last few months we have been preparing for both the visa and baby, and everything is prepared to be submitted within a few days. If all goes well and she gets a bridging visa, it is possible that she does not get the 820 visa before the baby is born. Questions: 1 - if she is on a bridging visa, will she be able to apply for medicare and get public hospitalisation costs covered? 2 - if the 820 visa gets granted before the birth, , will she be able to apply for medicare and get public hospitalisation costs covered?   8. Thanks blossom79. How does it work, I apply for the visa. If she gets approved, she goes onto a bridging visa (this is when her student visa conditions no longer stay in effect?), then after 2 years she becomes a permanent resident if she maintains living her for that period and any other conditions. Am I correct?
  9. Sorry for not being clear, I myself am a permanent resident and have been here 2 years as a usual resident. I would be sponsoring her while she is on her student visa and by the sounds of it (as CollegeGirl says), her student visa restrictions/conditions would remain until it expired.

GeorgeD: You couldn't have put it any better, thank you so much for the clear guidance. I may speak to a migration agent once I have decided the best option to take.
  13. It's hard to consider visa requirements when dealing with breakups and new requirements, especially with dates that start and stop. She did contact DIAC and they advised only the primary applicant can make the notification that it has broken down. Was this information give incorrect? She did bring in form 1022 which was filld out but didnt have options for noting a breakdown in a de facto relationship (should she have put divorced?)
  14. When contacting DIAC about the relationship breakdown and cancelling the visa, they said this is not necessary since she was the secondary applicant. The correct process was to apply for a new visa (in her case student visa) as if she cancelled she would have no visa and have to leave immediately - they do not do this. She took a little time to get the student visa as she was deciding which courses to take, a lot has been changing in a short time but it is genuine. Saying it in the right way is tough, although I do not intend to apply for another few months at minimum.
  15. I guess I'm unclear on how the relationship breakdown really works, as relationships dont fall apart on a single day it's very much a grey area. And what about cases when they resolve issues and get back together, surely DIAC doesnt want to know all the fine details. A relationship should be able to develop if another is breaking down, even if it is not serious. Maybe I am not clear on how they actually assess these types of situations? She had been granted a graduate visa and it was not stated on the grant notice to contact about any breakdowns. Does the graduate sublcass 485 have the same requirements as a typical partner visa?   16. Hi, thanks for the response. I do see where you're coming from but do want to assure that this is a genuine relationship. The student visa was meant as a temporary means to allow her to stay here while we arranged future plans. I was looking for some help on how best to approach this and present it so that it holds up as a valid application. If all the criteria is met, even though circumstances may not be perfectly sequenced, does that still have an effect on the outcome?

Hello, I am preparing to apply for a partner visa - subclass 820 and wanted some recommendations from all you knowledgeable people Here's an overview of the circumstances She was granted another partner visa in May this year - by a relationship that ended in June (she changed to a student visa in Sept this year) She started her relationship with me in July this year We registered our relationship in Sept this year (state registration - QLD) When would be the most suitable time to apply? My plan is between November 2013 and January 2014. Does anyone have any input into this or advice? Kindest regards
  19. Hello, I am sponsoring my girlfriend on a 820 partner visa later this year and also want to allow her mom to stay here. Her mom is single, 63 and currently on a tourist visa. What options do I have to keep her mom in Australia? Are these my only options? 1) When her tourist visa expires, apply for a student visa? 2) Apply for a parent visa (when she turns 65) - subclass 804? 3) Continually apply for tourist visas - if even possible? 4) Can her mom be included on the 820 partner visa? Using form 47a as a dependent family member? Any help would be greatly appreciated!

  22. Blossom, you couldn't have said it better I am going to follow this advice. It is true, there is no rush and it's better to take things at a gradual pace especially with how strict and closely immigration can look at the details.
  23. Isn't it a problem if our relationship started while she was in one with someone else and on his visa? Let's say in 2 weeks she notifies DIAC the relationship is over. If me and her then file to register our relationship, the 12 months are waived? This would be a huge step as we have known each other for over 5 months, have a genuine relationship and many friends can vouch and provide references for us.
