Chid pom Posted December 23, 2016 Share Posted December 23, 2016 Hi, I was applying for a 457 visa so was granted a bridging class a, however my sponsor was regected from being a sponsoring business so I have received an email warning me that my visa will be refused (clearly!!) as well. I have been in a defacto relationship with an Australian man for 15 months so I understand we are eliagable for a partnership visa. However my question is can I apply for a partnership visa on a bridging visa? Can I apply onshore? Mark Northam Posted December 23, 2016 Share Posted December 23, 2016 Hi Chid Pom - You can lodge an onshore partner visa application, however as you are holding a bridging visa only you will be subject to the Schedule 3 criteria which requires "compelling reasons" to be shown why you cannot go offshore and lodge an offshore partner visa application. The bar for this is rather high, so you'll want to consider your circumstances carefully and perhaps get some professional assistance in determining whether whatever circumstances you plan to claim have a reasonable chance of being approved. The step-daughter relationship may have a chance, but may depend on proving the negative impact on her if you left and lodged an offshore partner visa and had to wait offshore 1-2 years for that to be approved. Chid pom Posted December 23, 2016 Author Share Posted December 23, 2016 Thank you Mark, another agent mentioned to me an option could be to go off shore and apply for a tourist visa then lodge on that, do you know how long I would have to be off shore for while a holiday visa is approved? Mark Northam Posted December 23, 2016 Share Posted December 23, 2016 I agree with George - coming back in on a visitor visa could be an option depending on whether you can get approved for a visitor visa and assuming that visitor visa does not have condition 8503 (no further stay).
