Aussie wife's UK ILE expired after 2 years and 6 momths in Aus

I'm UK Citizen and our 2 children have UK citizen passports, Aus wife got Indefinite Leave to Enter UK while we were in Aus in 2011, we went to UK in Mar 2012 and stayed till Jan 2013. Now returning to UK at end of July therefore wife has been out of UK for 2 years and 6 months and ILE has technically expired. My wife has no exit stamp from UK in her UK passport, nor an entry stamp back to Australia in her Aussie passport, therefore my question is will UK know that she has been out of the country for more than 2 years? I know that they were getting some embarkation info from airlines about people leaving UK but apparently not from all airlines. Would UK Immigration just ask us when she left or, seeing no exit stamps, not even bother to ask? Or, if they did ask and we said we left under 2 years ago would they accept this? Just Asking like!!

Hi,

I believe UK immigration will know your wife has been out of the UK for more than 2 years, as records are kept electronically through the chip passports..exit stamps are getting rarer from what I hear, as they're less necessary due to electronic records.

Hello,

I've read that chip passports only verify holder's passport details and contain no records of entry or exit. In fact exit stamps have only just been re-introduced in UK precisely because there were no records.!!??

You'll have to send her to Calais to sneak back in to the UK!

 

I was telling my chiropractor about the spouse visa a few weeks ago. Disbelief is what most Brits think of the system.

Last time he tells me that his British friend living in USA had come to the UK with his American wife and baby. Thinking they'd sort the visa out in the UK.

His wife and baby got deported back to America.

UK Spouse Visa system is a joke. Having to re-apply after 2.5 years, and then again after 5 years is even worse than the initial application. As for the NHS fee.. that just makes it even more of a farce. Its all about the revenues they get from it and nothing about the rights of the UK citizen sponsor...
