spouse visa 309/100 and duel citizenship of a step child

Hi guys, I'm currently gathering all information needed for my spouse visa and I was just wondering if anyone knew how long you have to leave the uk once the visa is granted (if granted).

I am British, my husband Australian and we have been married and living in the uk together for almost 6 years and we have been told by the department of immigration in london that once my visa has been lodged I will be upgraded (if thats the right word) to the subclass 100 due to how long we have been married. I mention that in case it makes any difference in the time in which we will be given to leave the uk.

 

My second question is, whats the chances of getting duel citizenship for a step child? Naturally I am mum and the Australian citizen (my husband) the step father.

We have 2 children together and their duel citizenship has been sent off and payment taken.

 

I am aware that my daughter can be attached to my spouse visa, we are just looking at all options.

Hi Sam and Steve

 

I can't answer the question about the citizenship by descent for the step-child but in terms of leaving the UK, you have until the medical or police checks run out, whichever is first.

 

There's a lot of info about citizenship by descent on the DIBP website that might be worth you looking at, but IIRC, I think it's harder even for an adopted child to get it. I do think it's worth you checking in to though on the website

You will get a validation date on the visa and you need to enter Australia by this date, after then you can come and go as you please.

 

I am almost certain the step child will not be able to get citizenship by descent, I think they will need to go on your visa application.

Thanks for that. This is going to sound pretty dumb or irrelevant but would you have any idea how long you have to stay in Australia before being allowed to come and go?

 

Initially, my daughter wont be coming to live with us and I dont think the subclass 101 is for if she ever was to come and join us, hence why I ask what seems to be a rediculous queation.

You have to visit to validate. Then you have 5 years to return and permanently settle.

You should go straight to PR based on how long you've been together and that you have children together. It won't affect your validation time or anything. Its the same for either the temp or PR partner visa.
