Kellex Posted February 26, 2013 Share Posted February 26, 2013 Hi We have a 176 SS visa granted on the 29th November 2012, we have to validate the visa before the 17th August 2103 so have our validation trip booked for May this year. At the moment we are not sure when we will make the final move but will hopefully have a better idea after our trip in May. Our visa expiry date is the 29th November 2017, so if we were to move sometime in 2017 what happens when the visa expires? lebourvellec Posted February 26, 2013 Share Posted February 26, 2013 You will have not issues staying in Australia once your visa has expired, the only issues you will have if you leave Australia after it expires you will require a resident return visa to re-enter Australia. Once you have lived in Australia for 2 years you will be eligible to get a 5 year RRV, but if less than 2 years you will liekly only be able to get a 1 year one and will have to prove that you have tie to Australia, i.e job, house, kids in school etc. http://www.immi.gov.au/migrants/residents/155/eligibility.htm It is easier to get a RRV while living in Australia. Also by validating and moving later you will be eligible for citizenship after 3 years living in Australia, but you need to meet the other requirements. You are allowed 12 months out of Australia in the 4 years before you apply, and 90 days in the 12 months immediately before. The citizenship works as you can use the 12 months that you are not in Australia at the start of the 4 year Residency Requirement, as you last left Australia as a PR and you held a PR when you were not in Australia, you are eligible to use this towards the residency time. But if you did leave within the 3 year time for a few weeks you would just be eligible a few weeks later, as long as its not more then 90 days in your final year. https://www.ecom.immi.gov.au/citz/startIntervalCalc.do You can put dates in the future.
