    If I was you I would ask my MA (assuming you have one) to contact the department. Seems ridiculous that it’s taking so long. Would think that your application got lost in the pile and wouldn’t hurt to get someone to dig it up for you, but they won’t do it themselves if not asked!!!

    My advice is to get in contact with Fairwork and if they don’t do anything you can always get an employment lawyer to help you out.

    I think the answer to both those questions is confidential. 

    They didn’t cancel his/her sponsorship because his visa application is still being processed but the business is no longer a sponsor due to whatever rules they broke.

    You’re personally not in trouble but the company sure is. It does have a negative effect on your visa application as you no longer have a sponsor. Hopefully you can find a job elsewhere soon with a company that is willing to sponsor you.

    Try to collect an much evidence of this bad treatment you can, such as video of you working as a kitchen hand, if you can audio or video of the verbal abuses, timesheet showing your extra hours, abusive text you received etc etc everything that come up your mind.

    Only problem is that he/she is currently on a bridging visa if I understand correctly. I don’t think the same rules apply re cancellation as when you’re on a 457 or 187/186. (I’m not an expert so could be wrong)

    It tells you where to find your hap ID when you’ve applied. If your MA says it’s ok then I suppose it’s fine but I would personally always try to use the correct visa number.

    I’m in the same boat. Could take anywhere between 1 day and the current 12-16 months processing time. Fingers crossed it’s sooner rather then later!

    @Roni S Yes you would need to lodge the nomination again with the new wage. Better to wait and maybe he can give you a bonus once the visa has been approved to make up for the time you haven’t been able to get the raise?

    But regardless of who spent what, the OP agreed to work for 2 years for the sponsoring employer. S/he posted on a public forum so I provided my 2 pence worth. If they want to risk leaving their employer it is absolutely to them, I don’t care! But like I said, I’m adding in my opinion and cautioning them seeing as they did ask.

    Unless you mean you paid the nomination fee as well (which is illegal).

    You applied for your visa on the agreement you would work for them for 2 years. The reasons you have in wanting to leave won’t cut it with immigration. You knew your remuneration when you applied. Your employer could report you for fraud and yes your visa could be cancelled. Whether this has been enforced I do not know, but I do know from a reputable migration agent that the guidelines do leave some loopholes open to cancel visas if need be, under certain circumstances.

    Hello @Wonderingaloud I don’t disagree with you and realise that this case is DE stream but in case of TRT there are no nomination costs for the employer. So in a situation where they don’t use an MA it is free for the employer to sponsor but the employee still has to pay their own visa and additional costs. Just FYI 😊 because I read something similar in another post from you but like in my situation my employer didn’t invest or spend any money on the visa and I did all the business paperwork myself. 

    As I said not disagreeing but thought you should know not all employers spend money on their employees and visas. 

     

    And if people want to risk leaving their employer then it’s up to them, don’t you think?

    That’s what we like to hear!!! My thoughts: because they didn’t approve as many applications in June the processing times on the website have gone up. It’s a representation of last month, not this month. 😄🙌🏻

    I want to get promoted but I don't want to risk, of course.

    Same occupation, job title or position but 1 level up from level 4 to 5 or 6 (max from this occupation), slightly doing more work according to paperwork, which is the jobs I already have been doing.

    I don't have Migration Agent so please help me guys.

    - Might be something worthwhile discussing with a MA and confirming your best options. Personally, I don't see how they would miss this (especially as the nomination is still in process). 

    To my understanding, using the wrong / different ABN makes the application invalid. 

    I’m no expert but if it’s an associated entity it might be fine. The MA should know about this.

    Your situation is different to mine so probably can’t be compared. We used an MA to become an official sponsor and for the 457 nomination but I’ve prepared the nomination for the 186 myself. After we supplied additional info it only took about 2 weeks to get approved.

    Hi @furbibi I’m paid by an associated entity - which is also the people I work for-  whilst the main business is my sponsor. My nomination for 186 visa has been approved. As long as it makes sense I’m sure you’ll be fine.
