Not sure if you can redo you medicals on your own without a valid HAP ID. I think it's the CO who will generate a new HAP ID that will enable you to do your medicals again.

hi, congrats on the visa grant. how long after your co contact (for meds to be done) did you receive your grant? was it shortly after?

    Hi Martyn.

We are in the same situation.
Nothing much to report. We have a little WhatsApp group going that really helps, a place to vent and read any info we manage to find that looks promising.
I will try and get the admin to drop you a message if you want to join?
    STAY POSITIVE!
    All the best.

Hi, YES that would be great!!! Would like to chat with people in the same boat! If you could get them to send me a message I think this would help! 👍🏼

  3. Hi all,

is there any hope for us at this moment in time. Feeling like life is on hold and starting to doubt the whole process!!!

after submitting 190 in feb 2020, still nothing at all. 😢 no updates off visa migration agent, sold one house 2020. Bought another 2021 and unsure where we stand? Trying to be think positive but I’m struggling with that 😕

what’s your stories? Any visa grants? Co contacts? Updates from agents? Or are we all just sat here knowing nothing?

Is her pediatrician an asthma specialist, because that doesn't sound right.

When I was her age - 60 years ago - doctors thought that asthmatics got wheezy mostly in summer, whereas if you got "chesty" in winter, you weren't asthmatic - you were susceptible to chest infections triggered by colds or flu.

For the last twenty years, we've known this is bunkum, but there are some doctors (especially in the UK, where asthma isn't as common) who haven't caught up.

They're all asthmatics, it's just that people who get wheezier in winter are more allergic to indoor things, like house dust, whereas asthmatics who wheeze in winter are more allergic to outdoor things like pollens.

There's a very good chance she will grow out of her asthma, but not until she's somewhere in her teens.

Yes, i believe so. She has been diagnosed with a "viral induced wheeze" she seems to be getting better with age. It all sounds worse than it is as she only has 1/2 episodes a year and even then we just use her blue pump and it clears. she is a normal healthy young girl. so frustrating that this could potential mess our visa and our chances of a life in OZ!

    Thanks for your response

The regulations about the PIC (Public Interest Criteria) medical in particular, are one of the more complex areas of migration law. If a significant medical condition was diagnosed it is sound practice to obtain a relevant specialists' report (or perhaps more than one) in a format that addresses the medical and legal criteria. The style of report that medicos write to each other is often far from optimal for immigration health assessment purposes.

Hi, thanks for the advice! what action do you suggest i take and how do i go about it?. I am using an agent and they haven't guided me down this route? Any feedback would be greatly appreciated

If you have not already taken professional advice about how to prepare a submission, may I suggest that you do so ?

Hi Wes, Our visa Application has already been submitted! I'm guessing that there is no more that i can do but wait for an outcome?

    Thanks

If she is on a preventative and a blue inhaler, then she has asthma.   A virus often triggers it off, but once the asthma starts, she will have it until she grows out of it.  If she's currently more than three years old, she's unlikely to grow out of it until she's in her teens.

The good news is that Australia is the world centre for asthma - she'll get better treatment here than anywhere else in the world.   Also, because she is likely to grow out of it, it seems unlikely that she'd be rejected on  medical grounds - it's a chronic condition but it's not as if she'll need expensive treatment for life, like some other conditions.

    Thank you Merisa,

Yes, her pediatrician has verbally told us that= she is likely to grow out of it as she usually gets "chesty" in the winter time. Thankfully she has not had an episode at all this winter! so fingers crossed this wont cause an issue! By the time we are aloud to travel to oz it will probably have gone given the travel restrictions at present times! Thanks for the advice and stay Safe!

Depends what visa it is ... if the visa type has the ability to waive the health requirement, then you can request a waiver, before the visa is decided, if you can demonstrate certain criteria. You can also dispute the cost findings of the Medical Officer, but these are all complex matters and need proper specialist help.

    Hi Paul,

we are going for the 190 visa to SA?

Is this the type of visa that you can appeal?

    thanks

It will all come down to how much they anticipate she might cost them in health care.

It doesn't matter that she will grow out of it, it's how much it will cost before she does. If it's over the threshold then it's over and that's how they measure it.

From what you describe we've certainly seen stories on here of people getting grants with more serious afflictions.

The truth though is you can do nothing about it so put it to the back of your mind and wait to here the outcome

    Good Luck

    Thanks for your reply!

I suppose all I can do is wait. Do you know if we can appeal a decision if they do refuse our visa?

Just try and stay positive...if the grading keeps going down alphabetically then fingers crossed b is nothing to worry about.

It’s either a or b! They have said that she will grow out of it anyway so hopefully anyone looking at it will have some Sense and pass it 🤦🏻‍♂️

  11. HI all,

Can anyone put my mind to rest! We have taken our medicals and my youngest daughter has a couple of issues. 1, She has a viral induced wheeze. 2, Has a slight lazy eye and requires patching.

she is on a brown inhaler (preventative) and blue as and when required. we take her for check ups 6-8 months for her chest and every 8 weeks to check her eyes.

These conditions and common childhood issues and both pediatrician and orthopedics have said that it is very likely she will grow out of these conditions.

we have submitted our reports from her orthopedic and pediatrics and our agent said that Bupa may asses it or it will go on until the visa is selected for processing.

Has anyone had similar situations?, as i feel that we have invested so much into this whole preccesss and it could be refused on these little issues.

Why are the medicals the last stage and why cant you undertake them before the costs start mounting!! so frustrating!!!!

    Thanks in advance.

    Hi Martyn,

Surely you can attach the points table and the basis for the points along with your application? Let me know how you get on!

Also out of interest, how may points did you have when you were invited and how long did you wait?

    Thanks, Charlotte

Hi charlotte, yes I presume that my agent would cover herself by attaching all evidence required to back up her issue. We had 70 points plus's the 5 for partner points. These where added when the changes came into force in November. I wish I had not updated the Eoi to award these points as it's been nothing but stress and worry! It took 7 weeks for my invite. Will keep you up to speed! What stage are you at?

I assume there should be somewhere to include the results of her English test (a UK passport is sufficient for Functional English, but an English test is required for Competent), but I've never used the Skillselect system.

EDIT: Sorry, I didn't read that you've received the invitation.  Then I assume uploading a copy of her English test is enough evidence of the 5 points.

Thanks for the reply, yes we have received and invitation to apply.

    What to provide

To prove you have competent English, provide evidence:

    • that you are a citizen of and hold a valid passport issued by the United Kingdom, the United States of America, Canada, New Zealand or the Republic of Ireland, with your application

This is what the DHA state for competent English so we are eligible to claim the 5 points. This issue is logging them onto the 190 application form. We can only assume that a passport would suffice for evidence. However, who then is responsible and where do I stand if the visa is refused on the issue I'm facing?. My agent won't lodge until this issue is resolved.

I don't know how you'd solve your issue, sorry!

I'd suspect that outside of the three or four agents who post on here no one is likely to have experienced it yet as it's such a new thing.

I do however think your agent is pulling a sloped shoulder move here and should be doing more to find a rectification for you.

I'm assuming your agent told you that you could claim the extra 5 points. I would suggest that if they cannot resolve the issue of how you actually obtain them then you have a good case for suing them to recover the monies you've spent so far. They gave you expert opinion that you have acted upon - but that in doing so you now have this issue.

Whilst immigration share some of the blame, your agent should either have told you not to claim the points or if they are convinced you can, they should be moving heaven an earth to get a resolution.

Remind them of their obligations to you that might be the rocket they need to do their job...

Thanks for the response, unfortunately it seems that nothing can be done. i will just wait and see what happens, my agent has said that we will submit application regardless, closer to the deadline. i can hypothesis with her but its extreamly frustrating for us. we are under the assumption that people are lodging the application with a statement attached explaining where the 5 extra points are from as there is no where on the form to address these points. my agent just wants to be certain. thanks again.

  15. Hi all, i am  giving this one last shot, as i am giving up hope in trying to find the answer.

Firstly, I am looking to find out if anyone is facing the same issue and what has been done to rectify it.

In a nutshell, i have received an invite to apply for the 190 as a plumber. My deadline to apply is 11th feb.

due to the changes on November 16th  i was able to claim 5 additional points on the eoi as my wife holds a UK passport. however, when filling out the 190 application form there is no where to log these points into the system other than attaching a copy of her passport. if you go onto the DHA website and look at the points table it states that these points are claimed under the PARTNER SKILLS section. on the application form is gives you the option to select (under partner skills) "yes" but then it doesn't give you  the option to claim the 5???

Your spouse or de facto partner must also be an applicant for this visa and has competent English

For you to be eligible for the award of these points your partner must be an applicant for the same visa subclass and must not be an Australian permanent resident or an Australian citizen.

All im looking for is some direction on where to go with this. i am already using an agent and they are also trying to get clarification on this matter but time is running out.

i have spoken to SA immigration - could not help as the DHA deal with the visas.

i have spoken to the DHA several times and they cannot help with filling out the visa. - they said to fill out an immi technical support form but this has been done weeks ago and no response.

its almost like they have applied the changes and have not updated the application form! im guessing that this could also be an issue for the other visas also?

    PLEASE SOMEONE HELP!!!!

    THANK YOU

  16. Hi all,
I got my pre-invite today from QLD (very excited). It states under the settlement funds:
    "Mandatory Cash Component - $5000"
    "Other Funds Component - $10,000"
    "Total Funds Required - $15,000"
My partner and I are onshore candidates - I already work in my occupation.
My Australian current account has $3000
    My partner's has $1000
We have a joined account overseas which has $15000 in there
    My questions are:
    1. Can we show all 3 or is it better to clump them all into one account?
    2. As our "other" components are cash is this ok? We own a house outright in Thailand but not selling it and therefore won't be money we will use in QLD.
    3. Does it matter all accounts are not purely in my name (partner is on the visa with me)
    Any advice is greatly appreciated

Congratulations, who did you speak to regarding spouse points? Phoned sa immigration and no luck? Thanks
  17. A previous post by Martynd says that the agent is dealing with it. I think he may just be wanting to find out if anyone else has had the same issue.

I would like to clarify that yes, my agent is dealing with it and has told me to wait before instructing her to lodge the application. The problem is, I’m sat here a month later with all sorts of thoughts running through my head and my EOI runs out in feb, I want to clarify the answer and provide her with it. She is probably doing all she can but I’m getting desperate.

Spoke to the dha last night and they didn’t know either. Phoned immigration SA and no luck. As previously stated it’s between 1-4pm aus time. Looks like I will be setting an alarm tonight.

    Thanks for the response everyone.

  18. What’s your situation?

Basically, I’ve received an invite to apply for SA 190 as a plumber and got until the 11th feb to lodge an application. I’m using an agent who is very thorough and has hit a brick wall lodging as when she is inputting the info regarding the spouse points for UK passport ( after November changes) it isn’t giving her an option under the skilled section (claiming points for spouse) I have very little time and just trying to find out if people are hitting the same issue and how they have got around it. No one seems to want to comment 🤦🏻‍♂️
