Hi everyone!
Submitted: 20th Feb 2019 (Through Agent)
Police checks & Medical: Not yet submitted (was told to wait until they were requested)
Aussie living in London with her English husband!
Together 4 years, Married for 1.5 years, 3 years defacto Sept 2019
Would LOVE to think that we’d be heading to Aus early 2020! Wait time was 12-18 months when we applied but has jumped 15-20 months but then dropped back to 12-18!
Used an agent because my husband has a 13 year old to a previous relationship, & contact is difficult, so far we have had unsuccessful contact with her to get confirmation about taking him for the medical or if she wants to deny it, on recommendation after 6 months unsuccessful contact attempts, we wrote a statement & submitted it in the hopes of waiving the need for a medical for him.
Have also been regularly updating my agent with poof of bills in joint names & joint account statements.
The waiting game is pure torture! So frustrating that you cant view anything! So spending my days down the rabbit hole on forums & researching job prospects!
Has anybody had experiences with the waivers or applied similar time to us and have any movement?
x
Our is taking a lot longer due to appeal process due to them not receiving any supporting evidence but should be done by January time.
With regards to you getting medical for your daughter. My daughter who is from a previous relationship is 12 and she will be staying with her mum here and our agent said she doesn’t need to have a medical as she won’t be moving with us. Hope this helps.

Hi All,
Just jumping on this tread.
I applied whilst in Oz on the 23 July 2019 along with police checks, medical done a few days later and on the system a week later.
Immigration are saying that it is going to take 22-28 months!! I have been with my husband for 14 years, married for 5 and have two sons together who have dual citizenship.
I've not heard anything and don't have a case officer yet.
Has anyone out there who applied at the same time as me heard anything yet?
Cheers
Have had a look on the actual immi account saying 15 to 20 months.

Hi all, happy to hear about recent grants! Hope you enjoy Perth and Geelong @Meath Lass and @Edinlass. We are intending to head to Sunny Coast to be near family there. Looking at ideas for back up plans as it looks like many people have been in for a long wait. I have heard alot about people going over on a visitor visa while waiting for the 309, then leaving oz to get their grant. Does anyone on here know if the working holiday visa could work in a similar way?
We are moving to the sunny coast also. Where about a are u guys moving to

Ah, that's rubbish Ben34uk!! So sorry to hear of the technical issues you have had. I have seen in this thread someone else who had documents disappear off their account. Is there a complaints department? Are you able to submit a formal complaint to get current status on your application/appeal and lodge a grievance? Have you tried contacting your partners local PM in Australia for some support? Just an idea
Unfortunately there is no complaints procedure we have tried every avenue to sort this out.
Even while we were on Sunshine Coast in March visiting family I contacted the local mp. Sent them all evidence etc. Unfortunately because it’s in the appeals process now they can’t stand in and neither can the minister of immigration. It’s a case of waiting and if it all falls through then the mp and minister will be happy to then step in. Fingers crossed by Xmas we should know what’s going on as that will be the 18 month time frame.
-
For some reason technical there end our documents didn’t attach to the application. So after 4 weeks they refused us.
Also referred to me as a her and she through the rejection letter.

Everyone on here needs to count there lucky stars that there visas are going through within 12 months. I’m still waiting after 16 months of an appeal so hopefully in next 6 months I should hear something positive and that they grant me straight away. Because if it has to go back to embassy after the appeal then god knows how long it will be before I get there

Don’t think people are stressed as much as me lol. 4weeks after applying refused and then 12 to 18months for appeal then re look at application hopefully lol
-
massive congrats.
Just a quick one to all who have been approved.
Did anyone have to prove savings or were they asked about any savings etc.
-
As people can see I’m blue on the chart awaiting an appeal but while I was in Australia 3 weeks ago I contacted the local mp regarding the big mistakes that have been made to my application regarding the embassy and now I have to appeal so awaiting to hear back from them as now it’s gone to the migration minister. So hopefully get some news soon

Hoping the appeals tribunal can pull there fingers out as will have been waiting a year in June for that. But can take up to 18 months so may not hear anything on that until December. Never been so stressed in my entire life

Not as bad. Mine more like 2-3years with all the appeal hassle etc. Roll on June to dec so I know more.
Then hopefully jump que and get visa if the appeal is all good
-
Want to add mine to that lol.
Applied 9/3/18
refused 9/4/18 due to the embassy buggering up and not receiving any of the 50 docs sent.
No notification to give us a chance to resend them
appealed decision 4/6/18
now the wait continues and could be dec this year before we get a court date

I’m hoping to hear something on my appeal soon as was sent off in June

Has anyone on here had a refusal on partner visa and appealed. Want to know after the appeal how long will the approval take do I have to go to the back of the que or is it done more promptly as I have had to wait for so long due to a mistake the embassy made and I was refused due to them.

Has anyone done a aat review on a visa or know anyone

At the time of my application we have a screen shot to show that some people were having problems uploading documents.
So clearly they have the problem there end. Which is what we will argue at the appeal
-
It’s an absolute joke. How are u even suppose to know that the embassy actually get the evidence there should be a response email saying documents have been received so u actually know they have received them. This is the problem we have had.
Even wehen we sent off for our appeal my agent sent 5 documents with the appeal application and we got an email back stating each item they have received

So have people had issues with documents not showing at the embassy end as this would be interesting to know as ours was refused as the embassy didn’t receive anything apart from our application. Subsequently it was refused due to them not receiving anything although 50 docs were sent.
Will be helpful to know as we can use this in our appeal.

Hi all. Can I claim citizenship by decent
my grandfather was a UK passport holder and moved to Australia and lived there and had a Australian passport and citizenship for 45 years. He passed away a few years ago. He was also a jp ( justice of the peace)
would I be entitled to apply for an Australian passport and citizenship by decent.
Please help.

That’s great Thankyou so much. Going to be a while for us yet as we currently waiting for date for the appeal so going to be a while

Has anyone had there saving etc checked for a partner visa and if I don’t have savings will this be an issue as we are moving in with the in-laws when we move and I will have a job already lined up for when we get approved.
-
When we applied we we’re told to hold off with our police and medical as they only valid for 12 months and if the visa takes longer than this they are invalid and have to be done again. Glad we did as mine was refused after 5 weeks. So now in process of appeal due to them not getting any supporting evidence and back to square one. Bad enough being £6.5k down currently. Would have been more if I had done my medical and police check.
-
Yea like mine because they didn’t recieve anything although over 50 docs were sent they just outright refused our visa. Why they can’t just send generic email saying documents outstanding you have 7 days to respond is beyond me. Especially as it did documents submitted. All you think is it’s all received then next thing you know is you get a refusal. Utterly disgusting from embassy end. We having a nightmare

Hi Ben
We are in exactly the same position as you, gave our docs to our agent who claims to have uploaded them in Dec 17 with our application and then in Feb it was refused. Agent didn't even realise it was refused until we prompted her to log in in April 18! We believe that she just didn't upload the documents and thought she would have more time or would get some kind of prompt from the Dept (perhaps about medicals etc) before she did so but they changed the way they were doing things and just started rejecting applications without supporting docs. Do you have any proof your agent did upload? Our agent has paid the fee to reapply and we did so in April 18. I plan to ask for a partial refund as well. Could you perhaps speak to another agent and ask how legitimate it is that there was just an IT error? Perhaps do a subject access request for info from the Dept of Immigration which may confirm no docs were uploaded. It is worth pursuing I think. Having outsourced the job of specifically uploading the documents, I would think an agent should keep screenshots or similar as proof that it has been done. You can look up the MARA agents code of conduct online too. It is hugely upsetting, we too feel as though we have been waiting forever but please don't be fobbed off by the agent, of course they will claim "IT issue. Also as with us now that you have had s visa refusal you will have to declare it if it is ever asked on future visa applications for other countries so it has serious implications aside from the money.
Best of luck x
Where was ur agent based in the UK and was she a Mara agent. What was your agents name.

With regards to you getting medical for your daughter. My daughter who is from a previous relationship is 12 and she will be staying with her mum here and our agent said she doesn’t need to have a medical as she won’t be moving with us. Hope this helps.
