    I sometimes think they just do this because they already achieved their quota of approving visas and its just a way of them buying time if they know your visa should be approved. Its just a theory though!

  2. Processing times just reflect which files they have picked up the previous month. Unfortunately it is not a prediction, more like an average of what they have processed.

    of course if this timeline decreases it gives us the idea that they are getting on top of it, but I guess they still have a long way to go.

    I totally understand. 

    I was planning to go for a 2 month holiday this year but had to cancel as my migration agent adviced it might raise questions by the CO, if I would even get one to pick up my case. I chose to not risk it after all this hard work and go next year.

    at this point im losing hope that it actually will come anytime soon. I see grants here everyday from feb 18 and it makes me feel like im part of the lost pile at immigration.

    we can not put our lives on hold forever because it might affect our case. This waiting limits us in so many ways and its not healthy. They have to understand that when we get our PR we will also go on holidays!? Sometimes longer than others.

    anyway I would advice to take in consideration how badly you want or need this visa. I am not too desperate anymore and miss even the Netherlands a bit as well! Faith will decide

    If I go on unpaid leave and they open my visa will there be an issue?

    I am planning to do the exact same thing! It is possible on a 457 to go for unpaid leave overseas so do you still have a valid 457 at that time? Otherwise you need a bridging visa B and ask for approval first of immigration.

    only little risk is that they might question if you are really needed in your position if you can leave for 6 months

    Yes its been removed from the skilled list in March.Hairdressers too? I just see that all hairdressers wait very long in general here!

    I have not heard anything. I also did not contact them as I am officially still within their time frame, which changes every month 😵

    I believe that these occupations have the least priority and that is causing more delays than other occupations that they find more important.

    that doesnt mean that everyone will have such a delay, but I believe it definitely makes it more likely

    This is really a very very small number. Just wondering why department have to hold such a small list.
     

    And I believe that most of these people work in occupations that have been taken off the skill list in march.

    I have tried to stay positive for a very long time, at this point it just gets draining.

    as random as the process is, over the last 15 months I have seen a few clear trends. There are people from march 18 getting their PR today, but never from the hospitality industry. I think it is fair to say that some occupations are on the bottom of the pile and stay there for a very long time.

    also dont forget that these occupations have been taken of the list, so clearly we are not their priority.

    I know negativity doesnt help, but I want to be realistic too so I dont get dissapointed all the time. If they can just say, hey hospitality takes about 2 years at the beginning of the track (not 6-8 months as I was told) then you just put your mind to it and make the most of it.

Believe me, looking for competent staff is a lost cause, no Australians or permanent residents wants to take the job.     I guess they dont process our files because while we are waiting we are exactly where they want us to be. Once they grant our PR we are actually free to move from the industry or job so it is not certain for them anymore that we still take the lower wage jobs for hard work. In hospitality a lot of owners pay extremely low wages for sponsored people, just to hold over their head that they control if they can stay in Australia or not.

    I think exactly the same. It just the uncertainty that makes its such a painful process. I am fine either way, I could live back in the Netherlands as well and be happy there . It is just two very extremely different scenarios for the future and I just want to feel like I could settle down somewhere. Its been over 15 months for me and this has been my main issue, especially because the timelines keep increasing and there doesnt seem to be a deadline, you can not mentally prepare yourself to wait a certain time.

    Hello

    I was in a similar situation as you and my MA told be that I could only apply for the DE stream before March 2018, where the occupations were taken off the list.As it is a seperate visa stream that is not necessarily related to the 457, you cant use the old rules of the 457 in this case.

    at this point your only option would be to transfer your 457 and wait 2 years for PR through the TRT stream.

    Are you sure you can still transfer your 457 to a new company tho?

    have been reading this forum for months, but never post anything. Today is my 15 month anniversary, applied nom+visa 03/08/18 as a restaurant manager through DE...

    it doesnt look like they are very keen to take any restaurant managers in.... as I slowly see march approvals coming in I feel my file is just lost or something!

    My MA is  saying decision is ludicrous and reason are unjustified . She told me in her 21 years of being MA she never saw the way immigration dealing these days . Its ridiculous.

    What I dont get is how can they say that the role is not needed if your 457 has been granted 2 years ago? that obviously means that at that point they did think it was needed and you have been working in the role since.

    I know they are more strict now, but with this kind of reasons of refusal they basically are not in line with decisions they made in the past...

    Did you provide an organisational chart that shows you are the only one in charge and you make all decisions there? Or are there multiple supervisors / managers? 

    Also did you use a MA?

    Nowadays you can not be a stakeholder of the business you get sponsored at anymore. I had my own business before and sponsored myself but I had to sell it because they changed the rules. (Again)

    It really depends on your CO.. they all ask for different things. They might never ask for any extra info , they might not even check the ABN, but there is always a risk that they ask for updated information. 

     

    There is no chance that you boss can hold off the sale a bit longer ? Just in case ?

    The only risk is that they could ask for updated BAS statements later on, in that case you should check with your MA what to do. Even if the ABN is still in use,  if you are unlucky your CO could find out that the business is no longer operating.

    I almost ended up in a similar situation and that is what my MA told me. Do you use a MA?
