  1. Ok thank you and fair enough, but this doesn't mean that the majority of employers and 457 visa holders should be penalised! Being against 457 holders, as some people on here seem to be is unfair, and if they realised the individual circumstances, they may have a different view.

  3. Hi, Thanks for the message. I know... it is just awful. Certain people on here keep preaching it's a temporary visa and disregarding the fact it had a route attached to it!! It makes me so angry that these people continue to comment (not helpful), when it is obvious we had a genuine pathway that has been changed mid way through. If the job came off the list then maybe I would accept and understand, but changing the age limit is something different. We were, and still are, sure this will resolve itself, so stay positive and think of this as a glitch that will come to light and be honoured before it passes through parliament!!! Keep in touch.

  5. Sorry for the delay, I haven't been on here for a while. It has to be in before his 45th birthday as the age limit has been changed from 50 to 45.
  6. Thanks but it would have to be in before September which is just over 4 weeks away. We haven't even done a skills assessment yet, so I think we have no choice but to leave it and wait
  7. With reference to the first of these 2 big questions, could I add 'irrespective of their occupation or age'. This is the question we have as my husband is 45 in September! Do you think it would be possible for us to get a skills assessment done and a ENS186 direct entry visa application lodged before beginning of September?
  8. Oops just checked the TRA website and it is the Australian Construction Training Services that we would probably go to. Vetassess require 5 years evidence. ACTS require 4 not 3 years as I previously thought. We would have to write a statutory declaration for at least 18 months. Does this sound feasible or are we wasting our time Raul?
  9. Even though he has worked over 15 years in this occupation, he only has 21/2 years of physical evidence and we need 3 years for TRA don't we? He has payslips, job offers, reference etc for his last 2 jobs but not the one before. He didn't keep anything. We don't see the point in trying if the TRA rules are strictly 3 years of enough evidence. Could he do a stat dec for the other 6 months?
  10. Yes they should. I still wonder if these are proposals and if the government will explain closer to the time that my husband will not be affected?
  11. It's not just the people who have the visa, it is the whole family who are affected and they are Australian citizens, some born and bred! My family started emigrating as far back as my grandparents. Some have adult children with children now and we will all be upset by this separationl. I really think they need to think about the serious effects this is having

  14. Is anyone in the same dilemma as us? We are on a 457 and would have applied for PR through 186 transition stream in 2 years. The age limit is proposed to be changed from March 2018 from 50 to 45. We came on the understanding that my husband, then 43 would have plenty of time to get PR through this, the only route we could be successful with. Does anyone know if grandfathering arrangements will apply to us? If not, we have uprooted our lives for no reason and my whole family are Australian residents. I would like to speak to people in similar positions. I don't want to hear that the 457 is a temporary visa, as it comes with the understanding that you can, after 2 years, get PR through the temporary residence transition scheme. It therefore should be grandfathered for the few people like us who are in this position.
  15. Hi. Has anyone heard anything regarding the govt stance on the issue of 457 grandfathering arrangements? Nothing has been said since the changes were made.
  16. Obviously if companies go into administration that is a different matter and it would be upto the individual to then find alternative work or, as was accepted in the rules, return home. I totally agree with that. We will have to disagree on the other issue, as it 'has' affected 457 visa holders. The change has been made and I am waiting for the govt to realise that the changes shouldn't apply to us. I'm sure this must have been overlooked. They say there is a grandfathering arrangement and this should apply to this part too.
  17. I used the term 'possibility' as I knew the replies would refer to this if I didn't. However, this is a pathway that was open to be pursued and I can't see how, if the govt are saying 'current 457 visa holders will not be affected', that this can happen. I am also not saying that this should be an 'automatic' permanent way in as it is a temporary working visa. What I am saying is that if there was a route to apply available when we got the visa, then this route should still be made available to those people who were told this. If this route to apply has been taken away, then this has, in fact, affected current 457 visa holders and is contrary to what was announced by Malcolm Turnbull isn't it?
  18. Yes it is a temp visa with the TRT scheme route to permanency as a possibility. This should not be changed for current 457 holders should it?
  19. Hi Tom, We are in almost exactly the same situation as you. We came in July 16 and would be ready for transition next July. Shouldn't the grandfathering arrangement apply to us on this issue too? Especially as they have also changed the age limit on the 186 to 45 from 50 and my husband will be 45 in a few months!!! Really worried and very stressed as my whole family are here and some are Australian citizens. Plus we gave up our home, jobs and life to come here to be with my family. Good luck with your skills assessment, although I still hope they see that this is unfair and affecting people currently on 457s.
  20. Although I agree with you that people from UK shouldn't now come on a 457, I wouldn't have agreed a few weeks ago before the goalposts were changed. We came on that basis, that it would become permanent, as it was an expectation through the TRT scheme. The ability to apply for PR through the 186 visa TRT route applies to the current 457 visa doesn't it? I hope there is a grandfathering term attached to this. Does anyone know if this has been discussed, as it seems there has been no consideration about the impact of changes to the 186 visa on current 457 visa holders?
