Does anyone know the answer to this question prompted by a lunchroom conversation -
If you've applied for transition from a 457 to ENS 186 and it's refused is your 457 visa still valid until it was originally meant to expire or do you have to leave Australia within 28 days?

There's no point emailing them yet, they state that processing time is up to 6 months and that they don't respond to status requests until you've been waiting for longer than that.
Guys,Which email ID do you send an email to for contacting immi about your application status? Also, I applied on 1st Sept 2016, so is it appropriate to email immi and ask them about my application status?

RSMS
Section 137Q of the Australian Migration Act provides that a regional sponsored employment visa may be cancelled:
- If the Minister is satisfied that the visa holder did not commence work with their sponsoring employer within 6 months AND the visa holder did not make a genuine effort to commence that employment; or
- Where the visa holder commenced the employment but did not complete the two year employment period AND the Minister is not satisfied that the visa holder has made a ‘genuine effort’ to complete the required two years.
Under Australian Migration Policy, in assessing whether the visa holder has made a ‘genuine effort’, the delegate must consider:
- The visa holder's reasons and/or circumstances leading to the failure to commence work or to complete the two year employment period (family or personal considerations may be a factor under these circumstances);
- The possibility that the visa holder, in collusion with the employer, does not commence work within the six month period or resigns shortly after commencing work, as part of an arrangement to help the visa holder enter or remain in Australia;
- In the case of termination, the period of the visa holder's employment with the employer prior to termination of the employment (generally, periods of more than 12 months may be considered as a genuine effort); and
- Any other matter which is relevant to the commencement or termination of the employment
- If the Minister is satisfied that the visa holder did not commence work with their sponsoring employer within 6 months AND the visa holder did not make a genuine effort to commence that employment; or

RSMS (subclass 187) is a regional sponsored visa. They're pretty similar but for RSMS you obviously have to work in a regional area and there is a condition on your visa which states you must stay with your employer for 2 years. The ENS (subclass 186) does not have this, it's more of a moral obligation to stay with your employer.

... I don't envy the people presumably working in resource constrained teams who have to deal with all of the calls.
I wonder how much extra time there would be to process visas if immi didn't have to answer all these calls? :wacko:

both Nom and PR approved 17/06/16 ( I wonder if they work on saturday :smile:) it took us exactly 6 months
no further docs requested
submitted all docs including medicals, police checks and form 80 at the time of application

I lodged my visa in July. My agent has called immi a few times and told me it is too early to do health check now. Agent told me to wait.
How about you guys who has lodged in June/July? Have you all not done health check?
We lodged in July and did our health checks in October. They last a year so I'm hoping we'll have our visa long before next October!

isnt it shown on the acknowledgement you received as soon as app has been submitted?
The footer of the acknowledgement letter (PDF on email) has the following -

OFFICE: 9 Wentworth Street Parramatta NSW 2150
Is the footer specific to each application? I assumed it was a template and that was Head Office.

I know a nurse who got her 189 in 1 month and she was already in country!

If you're already in the country I can't see why your occupation would make any difference. You're already in the job you've been nominated for so processing your application faster isn't going to fill a skills shortage!

Jeez.... Can't believe the incompetence of some MA... Seriously, this is a basic one how can they possibly miss it????
I did the visa application myself and there was no mention of medicals in the document checklist. I've actually just logged into immi and clicked on 'View heath assessment'. In there it says -
Examinations required
This person is required to complete health examinations for this visa application. Click on the link below to organise these health examinations.
I went through and made a declaration about my previous health and have now printed off a referral letter with HAP ID. So it looks like I can go and get them done and they'll be there ready for the case officer that picks it up.

I haven't done my medicals and if I'm reading the information on the immi site correctly it would now delay my application to submit it prior to a case officer asking for it. Does anyone have any experience with this? I didn't realise it could be submitted prior to it being asked for. I'm in country if it makes a difference?
(I did already post this but it said it required moderator approval and has completely disappeared!)

I lodged my application without medicals and I've since been told by a couple of people that got PR recently that they did their medicals prior to lodging their application to save time. Is it too late for me to get the medicals done now? as we can see here it doesn't take 7-8 months for 186 it takes only 6 months..
Fingers crossed, PR would be a nice way to start 2017!

I've done some searching but haven't been able to find a definitive answer on this one. If you apply to transition from 457 to PR but are refused, is your 457 valid until its original expiry date?
