  1. Hi guys.

     

    My my current employer wants to keep me on. My second year working holiday visa expires in November.

     

    Neither of us jave any real solid knowledge on sponsorship.

    From what I can see a 457 is the route I'd possibly want. But when it comes down to "skilled" visa I'm not really sure what it comes down to.

     

     

    Are any of the agents based in Melbourne or could recommend one to me?

     

    The Internet has so much general information it's a little hard trying to see if it applies to my situation.

    Hi Rob

     

    There are various options here at hand. You might be qualified to apply in your own right for a skilled visa. Also your employer could apply to become a sponsor and sponsor you for a 457 visa, or they can nominate you for a 186 for instance.

    Well the delay in 187 does not necessarily mean a refusal .....

     

    You need to weigh your options

     

    1- If you don't apply for a student visa

    2- If you apply for a student visa

     

    #1 pros

    Full time work rights

     

    #1 cons

    if 187 is refused, you can only go through the 187 review process OR leave Australia, can't apply for further visas aside from a limited set of visa subclasses

  3. Sir do I have now 28 days for student visa extension?? My visa is expiring tomorrow. I mean can I still apply for student visa extension within these 28 days if I get 187 refused in these 28 days??

    You can apply for a new student visa any time between now and 28 days from the day your current one ceases (if this is the first time you apply for a student visa onshore while on a bridging visa or without a visa at all)

    My student visa is going to expire tomorrow and I know my bridging visa will come in effect. But my question is by chance if I don't get any positive response from immi regarding 187 visa then do I have option to apply student visa extension within 28 days??? I would appreciate if u reply.

    If 187 is refused you can't apply for a further student visa onshore

  5. You are still supposed to keep them updated with your actual address- its a condition of the visa.

     

    That is not true. 820 comes with NIL conditions. 309 SOMETIMES comes with Condition 8502 (The holder of the visa must not enter Australia before the entry to Australia of a person specified in the visa.), besides the usual "must make first entry before" condition, but partner visas never come with a condition to keep immigration updated with your address.

    Second Stage is what happens once I've been in Aus for 2 years correct? However they are asking me for an address - I have no idea what this will be in two years.

    Should I put down a UK family member address?

    You can always update your address via form 929 or online. No worries they do not expect you not to move around

  7. My DH is a British trained anaesthetist looking at registering with FANZA. We are a little confused about some of the info that we have been given regarding restrictions on practice following registration.

     

    We we are waiting for the Royal College to confirm a few issues but they are currently not responding and we wonder if anyone else may be able to help.

     

    When we were looking for work previously, he would have been eligible to work pretty much anywhere so long as he had the appropriate visa and registration. Now we think he can only work in a DWS? Is any one able to confirm if this is the case please? Also, if this is the case, how are DWS areas defined?

     

    Some of the info we have found also states that he must work in a DWS for a decade before being eligible to practice with his own practice Medicare number. Is this a number he needs if he is wanting to undertake only private work? Or can he work in an area other than a DWS if he is happy to only work for public hospitals?

     

    any other advise around his registration would be great if someone has experience with FANZA. Thank you.

    I believe you mean registering with the ANZCA or becoming a FANZCA, and by the DWS restrictions you are referring to s19AA and s19AB restrictions

     

    If he becomes a FANZCA there are some ways to obtain exemptions from such restrictions.

     

    Also, in all cases, please note that DWS map for specialists is different from the DWS map for GPs.

     

    e.g. in Sydney, Menai is DWS for specialists, but not for GPs.

     

    i.e. Specialists like your husband would have access to less remote and more urban areas to work in.

  8. Well it depends. What did the sponsor tell immigration to cancel the nomination?

     

    If they plain and simple said the job offer is no longer on the table, that should not be an issue in a subsequent nomination, given that employers and employees can have their differences, and can work them out later.

     

    If they said something else, I wouldn't know to be honest. Depends on what they have said.

  9. I believe the requirement for a certificate of citizenship is a new requirement recently introduced.

     

     

    The Australian Passport Office requires it for children who are Australian By Birth, if neither parent was a citizen and had an Australian passport issued before the child's date of birth. Previously the proof that one parent was a PR by way of visa label was sufficient, now it's no longer sufficient and applying for citizenship evidencing (which is NOT an application for citizenship as the child is already a citizen by operation of law in that case, but only an evidence thereof) is required now prior to applying for the passport for the Australian Citizen child

    Skilled migration won't be possible unfortunately due to age, however, moving on a work visa is still viable if you can find a job offer in Australia.

     

    You'd need to work at least 4 years for the same employer at the high-earning tax bracket income in each of the 4 years to qualify for age exempton to PR afterwards, but I highly doubt this would be possible as the pay for nurses is rarely within that bracket

  11. OK thanks, makes sense. If I did do it in advance is worst case scenario that I'd have to pay to redo it later on? I was hoping as I'm a really straightforward case the process might be quite quick but I guess I'm probably being unrealistically optimistic ;-)

     

    Yes worst case is it will expire and you will have to redo it (if the officer doesn't give you a 6-months extension which COULD be granted on an officer's discretion)

  12. Dear sir thanks for your advise. Yes I have my bridging visa grant letter. Now I don't need to worry about visa extension otherwise I was planning to lodge one more file. But I am wondering and worried why my MA is saying I should lodge student extension file????? Dear Ahmad do u have any idea???

    I do not see a good reason to extend the student visa since a BVA (especially one leading to a 187) is more preferential and beneficial than a student visa, unless your MA has some concern about your 187 and fears a 187 refusal.

  13. Hello guys, i have applied my 187nomination and visa on 15/12/15 and my current visa(student) is going to expire on 28/7/16. My question is should I lodge file for student visa extension or bridging visa will be alright?? My occupation- Restaurent manager. Any suggestions from agents will be appreciated.

    Your bridging visa will kick in the day your student visa expires. Actually you're better off on a BV leading up to a 187 than on a student visa.

     

    Just make sure you have your BV Grant Letter.
