Last week I sought advice from a solicitor about something similar.Go and get yourself an appointment,around £80 for a set half an hour appointment.If he is on the birth certificate and you were married he has parental responsibility.If you wasn't married and he is on the birth certificate and your daughter is born after 01/12/2003 then he has parental responsibility.If she was born before 01/12/2003 and you wasn't married but he is on the birth certificate then he automatically doesn't have parental responsibility,he would only have it if he applied to the courts to get it. You are required when you apply for your visa for the childs biological father if he isn't going with you to either have a statutory declaration signed by him at a solicitors giving his permission for you to take her.(the cheapest option).Or if he refuses to do this the only other thing is applying to the court for a "leave to remove" order.This will be several hundred pounds,unless you defend yourself,but still a few hundred.Sounds like he will defend himself and reject the order in court.This then leaves the judge to decide if your allowed to take her abroad to live or not.The judge decides for the childs best interest,not what the mother or father are wanting.You will need to gather a lot of evidence stating why this is the best option for her.Things like,research on the areas,houses,schools,finance,jobs etc etc,just to say its a better lifestyle for her or a better way of live will not cut it. They will take his opinion into count if he does have some contact with her.The impact it may have on your daughter and the father etc.This is not to say you won't get the order granted.The judge may impose conditions on the order like,regular phone calls,Skype calls,school progress reports when you get them,emails,photographs,and may even say about regular visits. I would say get a good solicitor and he/she will run you through the costs and procedures.And what the possible outcomes could be,but unfortunately you can't just leave as your visa won't allow it.The Oz Gov want either a statutory declaration or "leave to remove"court order.These are the only options. hope this gives some info for you x

  3. Can I ask if ok memmymooch,was you married to the biological father,is he named on birth certificate,did he ever have PR,is there any previous court orders or agreements in place for him to see your child?

Em that worries me what your going through. my solicitor just called be back and said to apply for the leave to remove order and the residencey order with PR for my partner.He said looking at my case and the biological father has no PR,no contact,no court orders or agreements and has never seen her he will not be classed as an automatic formal respondent so in theory no one needs to inform him.This is good news for us.However the case above makes me nervous

Hi the solicitor said he wouldn't recommend adoption because of the same things you just wrote.A social worker would be appointed and prob will need to tell my daughter who is only 10.Also they would try and contact him for permission. He said what ever happens we should apply for a residencey order for myself and husband because this will come with automatic PR for my partner.Biological dad doesn't get informed of this at all. As far as the leave to remove order my solicitor is finding out some more things next week before we make a decision but to be honest it doesn't look too good for us,unless we want her biological father involved in her life.After leaving her at 7 weeks,10 years on no contact has ever been made so really we don't want him involved.
  6. Don't you still need to ask the biological parent on the birth certificate for permission regarding the adoption? I was once told they had to be asked.Thats why we never applied for adoption.
  7. Also you can apply to your bank for the last 10 years bank statements,it costs around £10 with most banks.You can go through the statements and high light your wages from that company.This is at least some proof you worked for them.Together with a stat dec from the solicitors this may help.

  10. Hi mum2four. Its a while now since your post and was wondering what happened? I'm in a very similar position and don't know what to do? My ex is on the birth certificate to my daughter who is now 10.she was born before 01/12/03 so he doesn't have PR.He left when she was 7 weeks old and saw her 5 times in 2003.Nothing since.He has no contact,no payments to CSA,no PR no court orders or rights.And has shown no sign of trying. when my daughter was 1 I met my husband who has brought her up as his own,she doesn't know any different and thinks he is dad.I know one day she will need to be told the truth but not until she is older and can understand. im worried if a solicitor contacts him to sign a Stat dec he may want future contact with her,even though she doesn't know him.He wouldn't want to pay court costs because he hasn't worked for many years but if the solicitor grants me a court order do they contact the biological father first? Not sure wether to peruse this and try,but run the risk of him creating a whole whirlwind for my daughter.

  12. Are they checking for correct spelling correct punctuation etc? I write in capital letters! I left school at 14! And became a plumber and later in life a heating engineer.i do exams regularly for my Gas Safe etc but it doesn't require writing 150/250 words etc? May need to find a tutor I think! (My wife writes all the things on this site for me!! lol)
  13. Hi everyone, We have been advised to sit the Ilets test to gain extra points that are needed.Do we both need to sit the test? Or just me as I'm the main visa applicant,my wife has UK passport so has competent English. The question I'd really like to ask is,how hard is the test? And how hard is it to gain full marks of 8+ (which would give me 20 points)? I am dyslexic and I rang the local test centre who said if I provide a full report from a registered agency I would be given extra time to sit the exam.But is 25% extra time worth the several hundred pounds needed to get my dyslexic report? if I passed with 7+ I'd get 10 points,I'd still be 5 points short of what I need.i don't think we would get the 5 points from my partner,even though she is under 50,has competent English,the thing is she has been a housewife for the last 10 years raising the kids so she doesn't have a skill on the sol.

So at the moment we are soon applying for TRA assessments,I will need a practical test in the UK as I'm a gas safe heating engineer/plumber and will be applying under the occupation "plumber".From the website site I'm looking at over £1000 to be assessed altogether because of the practical tests.As long as I pass this I can then apply for state sponsorship in South Australia as they state on their government website plumbers are in higher demand and should get an invitation to apply for a visa a little quicker.Then pally for the visa for myself and family under state sponsorship. im also thinking to cover my odds applying for state sponsorship with Victoria as well,as my occupation is also on their state demand list.But once I have the TRA I have to summit my E.O.I first I think for Victoria.Unlike SA it's straight in with applying for state sponsorship.
  15. Thank you for your reply,very encouraging.im ok with form filling,I recently did all the paperwork for my partners divorce so we saved a fortune on solicitor fees.whats a not straightforward type of case?
