    One of my friends got the message below from the immigration department.

     

     

    Regional Sponsored visa applicants – please note:

     

    In the skilled stream, of which your visa application is a part, priority processing arrangements and Migration Program planning levels have been designed to ensure the Australian economy gets the skills it needs now. The Migration Program planning levels for the visa category, Regional Sponsored, has a limited number of places left for the 2013-14 program year.

     

    This will mean processing times may be longer and that once the remaining places are used, the department cannot grant any application until the following program year, unless more visa places become available. Until that time, I cannot guarantee that your application will be decided in the immediate term, nor can I give an indication as to the likely timeframe. You can be assured, however, that the department will contact you when we are ready to finalise your visa application.

    When contacting your allocated case officer, please ensure you put your case officer's name, the primary applicant's full name, date of birth and either the file reference number or Transaction Reference Number or Request ID in the subject line of the email.

     

    It seems that the quota for this year is almost full. I applied on 27th June. Don't know how long I will be waiting.

    Yes perhaps so! Well best of luck to you and good on you for finding another employer to sponsor you so quickly! And hey, Perth seems to be processing applications a little quicker now, and at least you've been through the whole process and know what to expect. Fingers crossed you don't have to wait so long this time around. I think DIAC has nearly cleared their backlog from June - or at least the Perth office, anyway. Keep us updated! On another note and out of curiosity, did you enquire about getting a refund from your first application? I doubt DIAC would refund it, but you never know? Or perhaps allow you to apply that paid visa application fee to your new application?

Totally agreed ..Sonic blue ...I shifted to WA and applied from a roadhouse again ...apparently here are 5 people already gone through 857 and 457 process and got their visa granted ..I dun understand if this roadhouse can sponsor people then Y couldn't the previous one ....I think its all about luck and fate ..:(.......

    I feel so bad for you, prayash! That is terrible for you to wait so many months only for DIAC to tell you to withdrawal your application because they weren't satisfied with the job requirement.

     

    In my opinion, that is was the first stage of the process - the RCB - should be assessing. Maybe this isn't necessarily the case for all states/territories, but in South Australia, the RCB is Immigration SA. So if the RCB assesses the nomination and they are satisfied, then that should be it. It is very unfair for an applicant to wait so long for DIAC to tell them that they "don't meet the requirements". I know I would much rather find out at the RCB stage than several months later when DIAC assesses the nomination. It's really silly that the RCB stage even exists due to the fact the DIAC still needs to assess the nomination. What is the point of the RCB stage then? I've been told that the RCB's advice "may influence" the decision of DIAC's assessment of the nomination, but to be honest, it almost seems like having the RCB assess the nomination and then DIAC assess the nomination is redundant... If the RCB stage is going to exist, then DIAC should trust that their assessment is good enough to proceed with the visa application.

  4. yea it was dec 2011 ....I applied for RCb which got approved after 4 months ..then nomination and visa on may 2012 . 857 visa application withdrawal on feb 2013 as the nomination of the business got rejected on the same month....

     

    Hi prayash that really sad bro...!! Hope u find other good way.... Could u please share your time line? Did you go through an agent?
  5. My case was same ...nomination got rejected after 9 months from SA.....it was a roadhouse and CO said its more like a fast food menu ..:( ...I wasted over a y

    ​Hi blossom n all, I have been following this forum from last 5 months.....

     

    My friend applied RSMS off shore(cook) on June 29th 2012 with approved RCB from SA...

    after all long wait they have been requested twice to DIAC about their application decision.....

    Last Monday(19/5/2013) straight away they had decision of refusal as co considered roadhouse restaurant is fast food according to menu even though they had main meals.....:(. Most of the road house restaurants have standard main meals with many fast food dishes.

    It was really surprised... they do not have a second chance to prove. Finally if they want to claim they have to go for MRT which is not worth waiting for one more year.

     

     

    Dear friends I feel contacting twice to Diac is not worth. It may be result with straight away decision either positive or negative. We should have chance for further investigation for refusal reason prior to decision made.

    Hope this information helps those who waiting....

  6. visa expiring on nov this year ...I didn't go for MRT but decided to apply from the place where I was working from last may...

    Can u tell me when is ur 485 expiring second Im pretty sure u can attain 6 each again in IELTS if needed so dont think about that,,,U have to make sure that u need to stay in the country to apply ur next visa,,,so when is ur 485 expiring and also have u applied MRT frm the last application...
  7. I am working with the employer from last june ( full time ). My trade certificate is from australia (TAFE). My ielts is running in 2.5 yrs ( 3 yrs valid for RSMS) and my visa status is tem. residency (485). so where do u think I stand ???

     

    "The Direct Entry stream is for applicants who are untested in the Australian labour market and have not held a subclass 457 visa for at least the last two years or are applying directly from outside Australia."

     

    My application is direct entry. I have not undergone any testing in the labour market not have I been on a 457 visa. I applied onshore from a working holiday visa, but this is how my MA sent in my application...

    20]Hey guys as every1 knows that There was a big rush of application pre july,,,but what do u reckon are the main changes that came after July... One for I no its Ielts and second Ive seen in south Aus its more harder to get RCB under new guidelines,,,,so guys frm other states ,,,what are ur suggestions(whats happening in ur state)???

  9. Hi Sonic Blue ...I am looking for a new MA to lodge my application . Apparently it seems your MA is quite experienced in this matter .Can you please give me his address so that I can consult with him as I am also in SA .

     

    Yes you can lodge your nomination prior to RCB approval. I'm also in Adelaide blossom79. My migration agent is in North Adelaide. We lodged my nomination and (187) visa together with DIAC on 11/9/12, but couldn't send in the nomination to the RCB at the time as we were waiting on a couple of updated financial reports from my employer. The nomination was sent in on 10/10/12 and granted on 13/11/12. My MA then uploaded the RCB advice (form 1404) to my nomination with DIAC. You can actually send in your nomination and visa without RCB advice altogether under the new reform, but it's obviously not recommended as the RCB advice supposedly influences the decision of the nomination with DIAC...

Yea I will tell both of them about it ..and my plan is not just RCB also the nomination ..it has been really unfair to me ....:(.......after 1 long year of hard work I get nothing but rejection...and when MA talk to CO about ,they dont even want to reconsider even though its their mistake..(

     

    Well done! I suppose you could always get both to apply to the rcb, but that seems a bit unfair unless they know you will possibly be taking a job somewhere else.
  11. when the nomination is rejected do we have to cancel the visa application or will it be cancelled automatically..

     

    I know a guy, he was rejected nomination last year,he changed ma and cancel the visa apply(step3),then he did apply again by same resaurant on Jun12, finally he has granted his visa Jan 13 straight away,the funny thing is it is same CO as last time.
