  3. Hi Veenameena I asked my CO what would happen, as main applicant, I kicked the bucket (accident etc) would my family be posted back? Her reply: Please find the section who investigate such cancellations would consider the circumstances around the visa holders circumstances leading to the failure complete the two year employment period. Family or personal considerations may be a factor under these circumstances. I am unable to give specific information on the departments cancellation process, however a visa holder which includes dependants are unlikely to be assessed as failing to have made a genuine effort where the failure to commence or complete the two year employment period was because of a situation beyond the visa holder’s control. Looking at past from replies on this foreum it seems the DIAC would be considerate if you remained in the same occupation and same regional area should the business sell. This is beyound your control, so maybe look around get something (apply but don't start yet) and I suggest approach DIAC (get letter/proof business is selling). You have a problem and a solution. Some members suggest keep quiet and carry one, but I would not be able to live with that worry of maybe one day...Won't the new owners keep you? With sponsorship must the old owners not consider this in their negotiations? They do have an abligation towards government.
  4. Dunken! Our odds were unsurmountable. Lower middle class - not favourable finances, nearly at cut off age - 45, step-son nearly independant - 21, applied to 67 jobs - 3 interviews & 1 interest, had to get a sponsorship first. There were many times we thought it was never going to happen. The paperwork was hell! We made it by the skin of our teeth - both now 45 and our occupation was removed off the QLD short skills list just after we got our CO. But once it is done, one would appreciate it so much more. I thank God for a miracle and it was! Let me know for any advice. Best wishes
  5. Hi Dunken I reckon a few weeks. An application once a CO is assigned can take 4 weeks. But try and phone and get a contact person and direct number. If you have not yet been assigned a CO I think it would be more difficult having to get hold of our file. Why, if I may ask, did you withdraw?
  6. Hi Sambo85 Once the DIAC confirmed that my application was considered a non DRC (did not use a RMA) I requested via email if they would consider it as a DRC and gave my reasons. The DIAC replied that they did not consider my reasons serious enough. After a second concerted attempt and more effort on my side with 6 supporting documents and a lenghty letter it was expedited. It was free of any opinion and emotions - kept it factual. Remember if my memory serves me correct about 350 PR are approved a day and I am sure many try their luck.
  7. Hi Mamma The email we used: nsw.pse@immi.gov.au Be sure to include your: Client Name: Date of Birth: Client ID: Application ID: File Number: in all your correspondence. Non DRC applications take usually 6 months at the last look I did. It varies. Send an email to the mentioned email and an automated reply is received regarding processing times. There they will indicate how far they are - the applications they are processing on which date they were receiced. Work it back from today to their date of application and that would indicate how far they are.
  8. Hi rrrrwfn Wait 4-6 weeks after DIAC acknowledge your application. Then email them asking if yours is a DRC or not and when you can expect a CO. I even phoned them and got told whats up.
  9. Hi Veenameena Usually 4 weeks. But as Sam2012 mentions you references might be checked and depends how they do it phone, email or letter. Our delay was our CO was on leave!
  10. Hi Mamma I waited for 6 weeks after the DIAC acknowledged receipt of my application. When I received no responce I emailed the DIAC and asked. An immediate automated responce is received about where they are etc. About 5 days later a DIAC communications consultant, confirmed it was not DRC. If this is the case the wait when I checked last was 6 months (Parramatta) depends which centre is handling yours. (Perth seems to be the most up to date)
  11. Yesterday afternoon we received notice from our CO that our RSMS application has been approved! What a relief! We did a 457 and 857 back to back. The amount of paperwork and cost has been daunting. The CO was strict but fair and always replied to our emails. This was a non-DRC application submitted with the nomination 20 Oct. Made a request to have application expediated due to hardship. Finally granted after second request. Very unfortunate with last outstanding document, a police clearance certificate. First the South African police clearance was not applicable, then the Queensland police clearance not admissable, then the Australian Federal Police police clearance certificate got "lost" in the post, it was posted again and it turned out it was the wrong code 30 instead of code 33 (AFP admitted it was their mistake) and finally the CO got it yesterday! Hang in - be patient and persevere. Opinions and emotions aside, strictly facts and proof thereof!
  12. It is taking my LAST oustanding document longer, already delivered to DIAC to reach my CO, than it did with normal mail from Canberra to Sydney.

Hi Undertaker Looking at pg 76 of this thread Katerina posted on 23 Jan that Parramatta with RSMS applications have started working on applicants received on 23 August (Different centres different times). This means that your application is a non DRC and generally the waiting time is about 6 months. I reckon next month sometime you would receive a CO. If you want to find out about progress send an email to DIAC and you will receive an automated reply on processing times.
  15. RMA (registered migration agents) submit DRC. However a collegaue and some posts on this thread submitted applications that were accepted as DRC. Once you receive acknowlegdement of receipt from DIAC as a private non-RMA applicant and you get a reply within 4-6 weeks you were fortunate to land in the DRC pile. If after 6 weeks you hear nothing, you can expect to be on the 6 month non-DRC pile! Your agent should have your application as a DRC if all required documentation was submitted!
  16. Welcome! Reading past posts in this thread is a mine of information. Your agent is correct within 4-6 weeks of acknowledging receipt of your application as a DRC you should have a CO. The standstill is usually only non-DRC. Best wishes!
  17. "Hope to be an Aussie" I would try and get your CO's contact details and find out what's on. This is pretty serious and I do believe they would understand. By the sounds of it the business screwed DIAC around and this is above your head. Your options are as mentioned wait it out or get another nominee. But this you can decide once you know what is going on at DIAC. You are on a 457 visa which should give you another 4 years if DIAC don't cancell it, but I do believe they would do it in a considerate way with enough advance notice and possibly give you options. Personally, if your work has been negligent, I would look for alternative work for sponsorship (nomination) for a RSMS and get the process started so long. But I am not sure how DIAC handle a 457 with one nominee and another RSMS application is received for another nominee. Keep us posted!
  18. APC1 any change in the 5 days since your post? Is your occupation on the short skills list? Are you below the age where nomination is mandatory (think 40?). I started with 457 when I realised my time was running out and had to start work. Once in Australia after 10 months I started with the RSMS application. With a 457, I had 4 years on a working visa. The 457 application was all done electronically and approved within 2 weeks. This also does require nomination from the business. Best wishes man!
  19. Hi Undertaker! I was informed by a RMA, just before we went solo that one has to start the application from fresh. Your 3 phased application involved business nomination accreditation by DIAC and nomination for you as employer. This would not be the case if you resign. Reading previous posts on this thread some people were thinking about it. Mention was made that leave the job and the probability of DIAC hunting you down is pretty slim as the DIAC have a "humanitarian" approach. Especially with a RSMS application if you remain within the same region doing the same job. Personally I would refrain - too mush at risk with a family. Usually you have 2 years to work with your intial nominee before you can leave!
  20. Hi Alfredv. Can understand your frustration! I sent an email to the DIAC requesting the status of our application. Ou first reply (immediate) was an automated reply stating the usual - how far they are etc (examples of such similar email on previous posts in this thread). However after four days I did receive a personalized reply from a communications guy, stating our application was a non-DRC application. I was able to communicate with him on several occasions. (I think the system refers you back to the same guy who replied originally). I don't think your folder would end up on the bottem as this guy would check a computerised entry. Try and get your application ID and state some personal details as a security check for the DIAC. As you have gathered alot of "I think's" were present in my reply. For some obscure reason I have to submit more documents than a colleague from the same country, same profession, same job,same employer. It depends in my opinion from CO to CO. Best wishes!
  21. Both assessing and case officer are the same. Form 80, I was under the impression was only required for off shore applications. However it seems if the CO feels one is required for a applicant already in Australia, the request could be make.
  22. Just received a list of additional documents required. Medical of one member of family just turned 15 (appointment tomorrow), Form 80 for my wife (completed), Australian police clearance certificate - SA one not sufficient, not sure why (applied this afternoon) and then the biggest challenge getting a South African police clearance certificate! (Just made contact with service provider in Pretoria). The amount of money already spent on documentation is staggering! But we are making process clawing our way forward!

  24. Hi Katerina.There were other aspects other than son's uni. Most of our assets i.e. property we were unable to sell in time. Our job apppointment & 457 went much quicker than anticipated and we had to move, with little liquidity in hand. After a second and better prepared request to have our application expidited it was granted.
  25. Received a phone call from a supervisor on 4 Jan that our application RSMS has been escalated and that a CO would be appointed the following day. No news from a CO yet, but today I will be phoning to hear who our CO is, as the supervisor did offer I could phone her to find out. God willing this week we hope to have ours approved.
