801 visa and employment question

I was granted my 820 sept 2013 and was eligible and submitted required documents sept 2015 for my 801 in which my son is included on it with me. We are still waiting for an answer from immi if we are approved. My son is a full time uni student. He has an on the books job working one day a week just so he has some spending money. I work at a job which is on the books during the week but off the books on the weekends. My husband (sponsor) works a full time on the books job making good money. I/we pay for my sons school, basic living expenses and he lives with us. I have been offered another job (in which jobs where I am at are very hard to come by- been trying for new job for a year) however the new job is strictly off the books. Work conditions at my current job that I have been at are not good and I really just want to get out of there. Someone (i think on a forum) mentioned though that it might not be good to take off books job as I would have no proof of working and then my son might not be considered dependent anymore and we might get denied pr because of it? So I am torn on what to do if I should take new job or would that jeapordise anything in regards to getting our pr? Does it matter if I have off books or on books job? Any answers would be greatly appreciated. Thanks.

I presume by 'off the books' you are meaning 'cash in hand' type employment. Such arrangements may be considered to be illegal because of taxation, insurance and safety and health issues to name a few. As a visa applicant you need to ensure that all information you submit for visa purposes is genuine, and also need to consider the character provisions in migration legislation. If you either intentionally, or inadvertently get involved in illegal activity it can have serious consequences for both your current visa application, and possible future applications.

 

Your doubts about this are possibly well founded. It is in your interest, your family's interest, and the interest of any employer to provide employment through the correct processes.

I am sorry would it be possible to ask just one ore question. My son has just come to me and says he would like to take a semester off from uni and do some courses at a place that offers accredited courses (its a community owned not for profit Adult & Community Education learning centre) is that acceptable to still be considered doing schooling to be a dependent? Or does he need to stay in uni? I am dumbfounded as he has just hit me with this.

Your son's grant of the permanent visa (801) depends on the successful grant of your 801 visa. His status as either dependent or independent does not effect his 801 grant. What is important is that he was a dependent (and a member of your family) when you lodged the 801 application, and that depending on his age he continues to satisfy health and character requirements.
