Spouse/partner visa Advice

Hi,

My husband is applying for a partner visa.

If we are not ready to make the move once granted. Do we need to go to australia (for holiday) to activate it?

And how long will the partner visa be valid for if you dont move for awhile?

 

 

Also what happens after the permanent visa is granted? will it run out after so many years?

 

And has anyone been granted a tempory and permant spouse visa together rather than waiting 2 years for permanent. We have been married for 7years and together for 10 years.

Hi Marie,

 

You don't need to make the move immediately after being granted the visa, but you will need to validate it. This is usually one year from the date that DIAC received the medicals or PCC, whichever was done first. Once validated, the visa is valid for five years for your husband to go and live in Australia. After the five years is up, he needs to either apply for citizenship (assuming he meets the eligibility criteria) or an RRV (Resident Return Visa) which again, is subject to eligibility. Hopefully, you are planning to make the move permanently at some point in the next five years?

 

Since you have been married for so long, I think it's fair to say that he will be granted the PR visa immediately as he certainly appears to meet the criteria.

If he is granted a Partner visa, he will need to enter Australia before the Last Entry date on his visa to activate it - the Last Entry date is usually 12 months from the date of the applicant's first medical or PCC.

 

Because you have been married for so long, he will almost certainly be granted a permanent Partner visa from the outset without first needing to spend a couple of years on a temporary/provisional visa. His permanent visa will be valid for entry to Australia for 5 years from the date of grant. After the 5 years, he can only enter Australia as a PR if he has a Resident Return visa. thanks so much for the responses.

So we would have 12months to activate the visa from the date we do the medicals. People seem to be saying they get there medicals done approx 3months after lodging the application..

So would that mean if the visa takes approx 9months to be granted, we would have roughly 6months to go to australia to activate it. ?

Just thinking in advance for saving for flights

This is correct, although my hubby lodged in September, did medicals at end of December, got grant in May and so now, has until the beginning of January 2015 to validate as that is when DIAC received the medicals, so just about 7 months to validate.
