Dennic
Hello everyone, I'm asking this on behalf of a friend, she is here on her husbands 457 they have 2 kids but have split up, she wants to know what will happen if she informs immi? Her kids are settled and she's not overly keen on the thought of going back. Will immi tell her she has to leave? If so does she get the 90 days? She's a stay at home mum so can't get a sponsor for herself Need as much help please Thank you
Rupert
The first thing you need to tell her is not to go anywhere near an immigration office until she has located a good registered migration agent and has had a consultation. She is in a very precarious situation as I am sure you both know. She cannot stay on his visa, but the children can, which is obviously not a good situation. How amicable is the split? What does husband think of the situation? Is he likely to a) let them leave or b) leave with them if they return. In terms of kids being settled well this is only a temporary visa anyway and even without the split they could have found themselves going back anyway,
