It always amazes me how naive some people are on how the world actually works when it comes to finance and credit.

 

This is probably what happened

 

Originally Credit Card debt sold to UK Debt Collection Agency for probably less than a third of the total amount. Original creditor will write off the debt and claim back the loss via insurance or write it off against tax. OP then agrees payment plan and has been paying this for years (this may have been arranged before OP emigrated). So the UK DCA has probably made a tidy profit on this debt

 

UK DCA knowing full well that the OP is a non UK resident and if the OP stops paying they have legally NO recourse of getting any more money back, sell the debt on for a tiny fraction of what they originally paid for it to another International DCA.

 

International DCA knowing full well they cannot take any enforcement action regarding this debt. Chance their luck that the OP may be ignorant of their rights by threatening the OP regarding payment (immediate or increased monthly payments). This is purely a calculated numbers game as some people will pay up, and it only takes one or two people to pay up for them to make a large profit from the thousands and thousands of accounts they have paid pennies (or cent's) for

 

IN SUMMARY

 

UK DCA sells worthless debt to an International DCA who then tries to screw and bully the OP

 

Yet some people on here are bringing morals into this story if the OP decides enough is enough and does not pay a single cent more?

 

 

They cannot touch you for this debt in Australia, they can send as many letters to you as they want asking for money but legally and in reality that is all the can do nothing more.

 

Tell them to jog on, in fact ignore the letters they will soon give up the ghost.

 

If the DCA is an Aussie company report them to ASIC. It is an offence to make false statements regarding a debt and what will happen if you do not pay the debt.

From what I can see the OP has been happily paying her debt each month as per an agreed payment.

OP is doing the right thing, and has not said that he/she can't continue with the regular payments.

 

I do question the morals of others who advise for no good reason that the OP stop making these payments, just because it will be hard to get caught if you are now in Australia.

 

Who knows what the future holds...the OP has been paying the debt as agreed. If they return to the UK in the next few years it will make life a bit easier if the debt is paid and there are no surprises waiting for them when they return. It might not be in the plan at the moment, but who knows? Why does migration mean people should be absolved of any financial obligations they took on (and can meet!)

 

Having said that, I wouldn't entertain any of the strong arm tactics of a debt collection company...if you have an agreement and are keeping to it, then if they want to break it you should tell them you are prepared to break it as well and know they can't enforce any debt...you are paying it back out of choice even though legally they can't enforce it.

 

Your nationality has no bearing on any of this...just where you live.
