My questions are regarding bringing spouse on visit visa

 

:

 

  • How much time is required in visit visa processing ?
  • Can visiting spouse apply for spouse visa ? If yes, then will the spouse get bridging visa till the decision is made?
  • Can some one who is awaiting decision on spouse visa get a visit visa till the decision is made?

I'll assume you are talking about your Spouse applying for a Spouse Visa (SC309/100/820/800) and not as a secondary applicant on some sort of skilled visa.

 

The time depends where you apply. Offshore applications from UK Citizens are processed in London. Current processing time is approx 4-5 months I believe. Applications for other nationalities may be processed in different processing centres, so will have different lead times. The office which processes your application can tell you their current processing time. Onshore applicants are taking officially around 10-12 months (although there is the odd random report here of approvals in a couple of weeks - this is really not the norm)

 

Yes, a spouse on a visitor visa can apply onshore for a spouse visa (as long as their visitor visa does not have a No Further Stay Condition) They will then be granted a bridging visa with the same conditions as the visa they entered on...so in the case of a tourist/visitor visa, they will able to remain for teh 10-12 months of prcessing, but have no working rights.

 

Yes, someone awaiting a decision of an offshore application can get a visitor visa and enter Australia during processing. No, they can't remain in Oz until the decision is made on the spouse visa...they can remain for as long as their visitor visa allows them to remain. For example, if you apply in the UK with a 5 months lead time, you will need to come and go on the 3 month visitor visa (or apply for an e676 long term tourist visa) If you are from a HR country and the processing time is 12+ months, then you need to come and go several times. Irrespective of which visitor visa you apply for, remember that Offshore Partner Visas can only be granted while the Partner is out of Australia, so your Spouse will have to leave to allow the visa to be granted, and then they can return on their Spouse Visa. No bridging visas are granted to allow people to remain in Oz to await the decision of an Offshore visa, only Onshore.
