AAT member does accept documents even on hearing date so don't worry.

thank you aat website says the same , before during and   soon after hearing they  accept supporting documents, I read  many cases in AustLII, AAT is flexible

As per my understanding, tribunal requested documents deadline was 13 feb and your agent got confused with dates, aat will not consider the documents after the due date even if u submit strong documents, Thats why he know the result and blaming aat member for his mistake, i would say go for plan b, and dont loose and give shot for hearing as well,

please note its not professional advice

    thank you ,

aat opened my case on feb 2nd and scheduled hearing on 20th February  and request documents by 13th February (my agent got only7 working days gap to prepare and submit everything) normally aat gives atleast 2 weeks  to provide documents  right ? then only they decide whether they need to conduct hearing or not,  (my agent submitted on 11 th day )

aat member told my employer she couldnot give a fair decision without checking and considering the documents  submitted by my agent so she will go through everything and later inform how she is going to proceed.

lets see how it goes, I  waited 3 years and 7 months already

your agent supposed to sent you a draft submission but never lose hope as first palace i got an invitation for attend an hearing but after that got cancelled and they approved without hearing so i think you should keep yourself positive and ask your employer  to do same. Also you can have a newly sign contract between you and your employer and it will be a good impact on your case.

I can see you will get through this. god bless you

    thank you

yes new contract signed and submitted

Hi guys, AAT finally open my file on 14th Feb after nearly 5 months. I got call from AAT this morning but agent didn't tell me anything before and hearing schedule on 27th March for both visa and Nomination.  Also, AAt requested 2 more business financial documents. Agent saying we might not need to attend it if they satisfy. All documents submitted today Any suggestions how long they will take to review them .Thanks

hi just my opinion, attend the hearing if they scheduled hearing for you and your employer , they normally schedule hearing when there are not enough evidences / missing details /need more clarification  on duties, company financials  etc

Looks like you have a very good chance to get decision based on your paper submission.

    good luck🙏🏻

but what if my agent didn't do a proper submission? I lost trust in them , the very next day after agent got invitation they sent me $3643 quote for skill assessment and advised me to go for it asap as a plan B.

I guess my agent already decided my outcome after seeing my  aat member's name, I do not want to mention her name  here, everyone says its not easy with her , even if we have tons of evidences and supporting documents , she will come up with something new  and refuse

    Hi Madhuri

have you got your hearing done ?

    whats the update

    thanks

    sadly hearing cancelled

my employer hearing was scheduled on 20th February but my agent messed up , they submitted all evidences and documents by 5pm on 17th February only (in invitation they requested to submitbeverything   at least on or before  13 feb, which agent told me they submitted)

aat member informed  my employer  on Monday that she didn't get a chance to check all   new evidences and documents  submitted by my agent  , its not fair to proceed with hearing and take decision with out checking everything. so she cancelled hearing and told she will inform how she is going to proceed, may be take decision based on the documents submission or may schedule hearing ..

It’s depend upon case officer. He may not take your hearing.but you will be fine, don’t worry.

just want to confirm did u email on their email address to open your file? Or u simply went to their website and select general enquiry or complaint?

i sent an email to AAt in October and they reply to my agent.my agent said don’t email them just wait.yesterday i called them.and he said you will hear back from us soon.

    hi

email sent to this id mrdivision@aat.gov.au on January 2nd 2023

got reply from aat from different  id (National Registry Mailbox<MRDivision.Mailbox@aat.gov.au>) on 13 january 2023

aat contacted agent 02 february 2023 and invited employer for hearing  for nomination refusal on 20th February  ( video)

aat given 2 weeks time to submit all documents

i read some where current processing time for AAT for 187 is  3years 8 months ( for finalising)

i applied on 2nd july 2019 , today 3 years 7 months  , so they acted quickly, now hearing scheduled straightaway .

my email was just a reminder  for them (in email i explained my struggles and my need to travel overseas to meet my sick dad)

hope others with similar  timeline will hear from AAT soon, i suggest try to sent an email, it wont do any harm.. just request update

my agent always asked me to wait , and got surprised when i got reply from AAT that my case is allotted to the tribunal member..

  8. Hi everyone

    Can anyone reply me asap

After long wait ( applied July 2019, Qld ) aat opened my appeal today, asked to submit documents in 2 weeks and hearing is scheduled on February 20.

This invitation for hearing  for Nomination only and employer has to attend,  there is no mention about the visa . Is it normal ?

Are they going to invite for hearing for  visa separately?

    Anyone had similar experience?

    Hi guys

I have a quick question I applied for the 187 visa as a cook in 2017 and got refused and still waiting on aat . But when I applied I had my rcb approved and nomination applied but I was a month late to apply for my visa and they had a new rule to have 3 years full time experience back then which I wrote in my application that this rule was not in when I appied first . Just want to know if anyone knows if this will affect my aat appeal as I have worked full time as a chef in the same place for over 4 years now since I applied

    thanks in advance 🙏

Please mention What date  did you lodged visa in 2017?

What was your refusal reason ?

So we can get try to help you

I was wondering if anyone else had a similar timeline and had there appeal looked at yet?
    Thanks

    Hi guys.

My case officer just assigned and my hearing is expected soon.

Just in case if my case will refuse, can I apply 494 visa after hearing?

    applied AAT July 2019

    retail manager

    QLD

Yes you can if you have 3 years experience , if your employer is supportive its easy .

my agent also advised the same back up plan , I need skill assessment and appear again  for ielts for 494 as old ielts is expired

Iam also waiting 187 aat review applied july 2nd 2019 , Queensland position contract administrator .

Weird. I checked, there’s no regulation request skill assessment for 187. We don’t need it, and my friends- 3 of them got sponsored for chef, none needs skill assessment.

Check with my agent - he said no. If any agents ask for it, ask them a copy of legislation

Me too asked my agent and he said no need of skill assessment , if case officer asks they will give  appropriate reply .

I think my agent did send an written file to ask about that matter and I don't have a skill assessment, so it's been pretty stressful

Hi just one more question ,

are you 187 temporary resident transition stream ( means 457 subclass to 187  subclass)

    or 187 direct entry stream

  18. 2 minutes ago, JezzNg said:

It is my case, I have just got that request from the case officer that is taking my case in March and they asked for it.

I attached a bit of letter for you to see

    IMG_1954.HEIC

Thank you , i will check again with my agent , i never heard 187 direct entry need any skill assessment or experience other than related qualification.
Did your agent ask for further clarification/explained this matter to case officer ?

    - did you have your skill assessment ?

  19. 1 minute ago, MilaMocha said:

Sure you need a skill assessment however there’s been cases refused with skill assessment and cases won without.

    Consult with your agent.

    Hi ,

Could you please tell me where did you get information that 187 visa needed skill assessment , my agent said we dont need it , iam waiting for aat to open my case , any information will be helpful for me.
