    Hi all,

    I have just received a call from my lawyer saying that the tribunal has requested a hearing with my employer in a few weeks (a week before my due date!).

    Exciting and stressful at the same time. The member wrote that they couldn't make a favorable decisions based only on the documents received and that they want the employer to be at the hearing to "give evidence and present arguments relating to the issues arising in the case".

    Anyone had a similar experience? I think my lawyer was really hoping to have them making a decision on the paper....

    CASE UPDATE

     

    The tribunal contact my migration lawyer on Friday, asking for 2 more documents (updated BAS and update business organisation chart), and everything has been lodged to the Tribunal today.

    From your experience, what will happen next? So exciting that things are finally moving!!!!

    so so so true! I am about to have a baby, I will definitely enjoy my last days of employment and my baby, and be greatful for the life I have and for the beautiful support I have from my employer !

    I am newbies on this site but have silently followed for few months. Below is my case and it would be so much appreciated if anyone could assist or give me any idea.

    187DE lodged on 14/06/17 as per Cafe Manager in WA. Nomination and visa application were lodged as same date.

    21/01/19: CO sent Nomination refusal letter without asking anything with the ground that the manager position wasn’t necessary as owned by 2 owners. Ofcourse it is kinda ridiculous reason for what i have done and still doing this. We do have all the records from business, the owners’ personal circumstances and local community evidence to prove the position is genuine and essential.

    Anyway, AAT review was submitted on 21/02/19. Since then, we havent heard anything from them. However, 08/20, we uploaded further evidence including updated business financial statements, payroll system, reference letters and medical records of one of the owners.

    In short, it has been more than 27 months after the AAT review being submitted, we havent heard anything.

    So here i am...i do wish to hear any comments from you guys. Any suggestions are more than welcome as i have been desperately waiting for this case.

    I have noticed that alot of people in here have got hearings or finalised case after such a lengthy waiting period. I believe the date of AAT review and AAT contacts aligning with nominated occupation and state are something helpful to track down where we are. Does anyone have this?

    Nice to read your story and see that the times between AAT hearing and Immigration Dpt are going abck to normal.

    HEre my timeline:

    nomination refused in August 2018 - for a 186 DE visa

    AAT- nomination lodged in Sep 2018

    AAT - visa lodged in Oct 2018

    Nothing heard back from AAT yet

    Migration lawyer sent all the document to AAT in January, hoping that it could speed up the process as the application is "decision ready", but as I said nothing happened yet.

    Anyone in the same situation?

    Position is Event Manager and I am in WA

    Hi, my refusal reason was that the applicant has not demonstrated the need for my position (considering that I was on a 457 -same business / same positions - granted by the same department!

    I have lodged an appeal for both my 186 nomination and visa refusal in September 2018, and still waiting to hear from the AAT.(I am in Perth).

    Anybody in the same situation? We have been waiting for 17 months so far, we have a 3 yo daughter and as you know, it's so hard to live like this, without being able to plan anything.

    I have heard so many stories, and it seems that the majority of these appeals are successful, which is a good news (if you don't focus on the epic waiting times....).

    I have been seen a lawyer, who suggest to submit all the documents to the AAT before they will get in contact, to see if they can make a decision faster and on paper (no hearing). Anybody has any experience like that?

    Any suggestion or comment would be appreciated and good luck to all of you!
