    I was on 187 as well. You can take further action if they are not treating you well, at the end of the day regardless of your visa category the employee should be treated accordance with FAIR WORK COMMISSION. So if you have any issues with your employer take it to fairwork commission in your state. But its not good idea to do your Citizenship test and resign, yet you have one more option (depends on your state). If you are done with your exam and its approved instantly, you can request for a Virtual Ceremony. If you are lucky and granted with a VC, the next moment you can say BYE BYE to your nasty employer.

    Advice is:- Do not resign without a Citizenship Certificate in your hand or without informing FairWork Commission.

    UPDATE:- Both our applications got approved in 2hrs time.

    9.25am appointment, verified my details with the counter officer (Passport, Driving Licence, Birth Certificate). Spent around 10mins at the counter.
     

    Then proceeded to the computer where the test is held. 

    Allocated PC for me n started the exam at 9.38am and finished at 9.41am....

    You can download Australian citizenship test on app store easily. There is heaps of app available that covers all the questions. And real citizenship test question is pretty standard and easy. I got 💯 % correct after practicing those quiz and questions in app.

    yeah I am doing those quiz as well, but was wondering if there are anything else to look at.... thats why thought of asking the Newly Oz Citizens who has done the test recently.

    I will not do anything with it. Coz for me it looks like a scam, but I did receive it via email too. Also the letter came in a standard Government Envelop... So i was not sure.

     

    Hence I posted here to see if anyone has received such letter and make them aware of it.

    Hi Mohammed,

    as for my Knowledge, 

    if CO ask for more information, that CO will push your file to a Further Assessment team. That’s is another pipe line. So you just submit the document within the time period and you will be fine. 

    After few weeks another set of CO’s will look into those files and see if you have submitted, if everything is fine, then they will process your file. So hold on tight, from my understanding that process takes around 30-60days frm the time you submit all your documents.

    received my GOLDEN MAIL an hour ago... I’ll attach my entire case below...

    RETAIL MANAGER - South Australia 

    RCB - 07/2016

    RCB Approved - 08/2016

    Nom & Visa Applied - 09/2016

    Nom Refused - 12/2017 (as usual u all know the fake reason they gave)

    Visa Refused - 01/2018 (due to Nomination Refusal)

    Appealed at AAT Nomination 01/2018 and AAT Visa 02/2018

     

    Received an email in 03/2019 from AAT to submit for information regarding the business (my agent only know what documents, since it’s My Company Business privacy). 

    We submitted them via email to AAT on the 15/04/2019 same day NOMINATION got approved without any hearing.

    My Visa file sent back to IMMI on the 26/04/2019. 

    CASE OFFICER allocated on 26/04/2019 and requested for S56, Medicals, AFP and PCC from Overseas for my wife.

    submitted them on the 9/05/2019

    and finally today I am here In front of you all as an Australian Permanent Resident.

    Hi Arm,

    when AAT open your Nomination File, they will request for documents what’s required for them to assess your case. So don’t need to hurry up.

    But from your side, keep your PaySlips and all the work related documents ready.. anyways the Business is up and running, so you can submit whatever the documents they request...

    hope they will open your file soon.

    If u have applied for AAT for both Nomination and Visa.. and if you win your NOMINATION, AAT will send your file back to IMMI. 

     

    So if you win and AAT send your file back to IMMI, then you will receive two separate refunds of $865.50 (1 for Nomination and 1 for Visa). Because when you appealed you have already paid AAT $3462 in total (Nomination $1731 and Visa $1731).

     

    the rule - if AAT Revise the decision and it’s positive, then 50% of Appeal fee will be refunded back to the applicant

    Owner has 8 plus business in NSW Still refused on the basis 'GENUINE NEED' F..K man and turnover I don't know about it.

    Offshore Applicants can not apply for AAT APPEAL for their visa, but your employer can apply for AAT for the NOMINATION..

    Immigration contacted me and asked for more information. I have provided them too. All the details are above.

     

    NO I didn’t provide any Skill Assessment for this application, because you cannot do since Retail Manager is not on the list anymore. But I recently got a Cafe n Restaurant Manager Skill Assessment Positive. But I am thinking heather to submit that to Immigration or just keep it for now n use it for a different application...

    Hi Kuljit,

    so sorry to hear your Nomination has been refused. It’s so frustrates people, but it’s normal for Immigration Department. Hope you win your case.

    AAT processing time varies from State to State. So if you post which state you have applied, the other members can help you out. I am from SA and the current processing time over here is around 12-14months

    1) Has anyone been able to have success in AAT? Retails Managers have won the AAT Appeal in most cases, but those applicants are all onshore and they were working for the employer. Therefore they had the chances to prove THERE US A GENUINE NEED FOR THAT POSTION. (I am a recent AAT Nomination Winner)

    2) What to prove to immigration to show this is a genuine position? As I said above, you will have to consult a good Migration agent, because you are offshore and your employer has managed without you for last 1 or 2 yrs. so better consult an agent and they will be able to give you some sort of idea.

    3) As i cant submit AAT for visa. Does this mean the visa fees i paid is gone? or will i be able to re-open the visa file after nomination decision? You will not get a refund for your Visa application. It’s gone. So if your NOMINATION is approved by AAT. Then you will have to pay the Full Visa fee again and apply..

    applied in South Australia as a Retail Manager and Nomination got refused.

    RCB Applied 07/2016

    RCB Approved 09/2016

    NOMINATION and VISA Applied 09/2016

    NOMINATION got Refused 12/2017

    Applied for AAT (Nomination and Visa) 01/2018

    AAT Requested more information for Nomination 03/2019

     

    NOMINATION Approved by AAT Officer without hearing 03/2018 (same day as we submitted the documents)

    DOHA requests S56 More Information 26/04/2019

    Submitted the Documents on the 09/05/2019

     

    STILL NOTHING 🤞🤞🤞🤞

    AAT processing time differs by state to state. So 575 days could be normal. Which are you from? I mean State?

    i am from SA and it took 14months to open my file. That’s roughly around 420days

     

    also please note, as everyone has mentioned above, just the PaySlip is not enough. You need to provide a complete set of financial documents to win this case, because your Refusal is about FINANCIAL LOSS OF THE COMPANY. If you provide the payslip, that will cover saying you have been working, but it will not show your company’s financial status. 

    Whatever the documents you have submitted during the Application Process is now way too old. So AAT will need Current situation of the company financial, to see if they can run the business and still provide a genuine position to you. AAT will not care about the past of this company, they want to see the present and future of the company.

     

    act fast and get them right, you got 15days. Because AAT won’t give you a second hearing.

     

    This is my opinion to fight this case and win.

    Btw according to ur agent, Immi has done nothing on my file yet... I also thought they will process the AAT files soon. But I submitted my documents on the 9th of May and still haven’t heard anything from them 🙂

     

    I though as soon as we submit it, they will look at them and approve, but as usual they are taking ages to move on.

     

    btw regarding ur Immi account finalised... it should have been like that since ur Visa was refused.... because ur file was forwarded to AAT. But when Immi receives it back again frm AAT, it will remain the same as FINALISED. So don’t worry about it. Now it’s all Manual system for us..

    i have not received my Visa yet. But immigration opened my Visa file after 2 weeks from the Nomination Approval. They requested for more information

    such as

    AFP, 

    Overseas Police Report

    Did the Medicals again, because the previous Medical was expired.
