    186 TRT

Nomination & Visa lodged early December 2018

Nomination approved today 28 March 2019

    2 applicants

    NSW

How long does it take for visa to get approved after nomination?

    This is very varied.

It could be tomorrow, it could be next week.

Factors like your current role / your birth country come into play.

Hello guys I m so upset why they guys not open the restaurant manager files

There have been a number of Restaurant Managers as of recent achieve their VISA.

You applied in July, so with current waiting times you shouldn't be expecting anything until at least July 2019 keeping in line with current waiting times unfortunately, you may be lucky.

  3. Hey All!

    Just got the Golden Email.

9 Months on the dot exactly! And an exact week since the Nomination.

    Very pleased!

    Timeline in the signature.

Thanks all for the support and kind words within the forum, very supportive, but I did find myself becoming salty with the 2-3 month approvals post SAF! 😞

I'll hang around and answer questions when I can!!!!

p.s. remember to notify your bank and update your Medicare card when you get the approval!

@kstttt Nope, Grandfathering should make no difference to the time the application takes.

I would argue that the majority of Grandfathering roles now exist on the STSOL list, and not the MLTSSL - and we have reports that occupations on this list will be processed faster, as well as seeing people on this forum having their VISA's processed faster, not in all cases albeit.

    Hi guys, a quick question.....

    what does mean “grandfathered”?

Many people are talking about having applied under “grandfathered”.

can someone explain to me please?

    thanks

The ‘Grandfathering’ permits certain 457 visa holders who were granted their 457 visa on or before 18 April 2017 to apply under the current requirements for a ENS 186 TRT.

If you held, or had applied for, a Subclass 457 visa on 18 April 2017, you will be able to take advantage of existing TRT stream provisions:

    • Occupation requirements will remain the same (ie there are no restrictions as long as you continue to work in the same position for the same employer as approved for your visa);
    • The age requirement will remain at less than 50 years of age; and
    • The work experience requirement (ie. the requirement to have worked in your occupation at least two out of the three years prior to nomination on a Subclass 457) will remain at two years.

    Source: http://www.abacusvisa.com.au/news-flash/grandfathering-provisions-announced-for-certain-457-visa-holders

So basically, if you were granted a 457 VISA after 18th April 2017, you would not be eligible to apply for the 186 TRT under the new conditions, however if you held before, the Grandfathering provisions allow for this.

Gives me some hope as I am also on grandfathered option and applied June 2018.

Any requested information on the nomination?  What did your company do for training benchmarks?

    Thanks in advance.

Hey - no information requested fortunately from what I can see.

I' m really not sure about the training benchmarks, this was all done by our Managing Director and my Line Manager.

My VISA application is still 'Received' according to my MA.

An announcement made today confirming the new cap changes, from 190 000 to 160 000.

    https://www.theguardian.com/australia-news/2019/mar/20/coalitions-permanent-migration-cap-revealed-as-morrison-launches-population-policy

Again, I wouldn't worry to much about this, as it's on par with what last years intake was anyway (162 000).

Interesting about the new visa with 3 year residency before PR though, sounds like they'll try anything to reduce congestion in major cities.

Further to this, I just seen a news flash, that they are increasing the  limit on  Employee Sponsored VISA cap, up 3500 - I think this will more hit Independent Skill Based VISA's.

An annual cap of 160,000 is to be placed on the permanent migration intake in a move that will cut the targets set under the former Labor government by up to 30,000 people a year and impose for the first time an official ceiling on numbers.

The Australian has confirmed that the government’s razor gang, the Expenditure Review Committee of cabinet, has signed off on the key elements of the Coalition’s broader population policy "

what you guys think? Is this going to be pass? if so, the impact on us?

I am really worry about this guys 😥 Should We?

Was just wondering this - is it likely to affect the Skilled Points In dependant based VISA's more than ENS?

I wish everyone here gets their much awaited visa soon. Good luck

    Congrats on the good news.

    Can you please let us know the following information;

    Hi guys, just a question.

boss is considering to promote me to General manager in my company, but I m stucked at the nominated role.

Should I reapply a new 457? And wait another two years for 186 ?

    any advise would be appreciated.

If you move from one role to another, and they are not closely aligned, you have to inform the IMMI.

If you change roles, you'll likely drop off your 457, and move onto a TSS VISA.

If your new role is not on the Medium-term stream, you will not qualify for the 186 TRT, and if it is, you now must wait 3 years instead of 2 before you can apply.

If you have been in your current role, on or before April 2017 on a 457 VISA, you should qualify for 186 TRT via the Grandfathering Arrangement.

I'd think carefully and consult an MA on your situation.

Hi everyone! My file opened and my spouse received Character daclaration details request. Around 18 years ago he got the minor offence. We already submitted character recommendation by his boss and statutory declaration about the details of offence to our MA.

Is there anyone receive this request before? Thank u!

Please provide time line, date of application, occupation etc.

Hi guys. I got a question. I have submitted my nomination and visa application September last year. When shall I arrange medical check? Thank you very much for help.

Best practice is to have an application 'Decision Ready' when submitted.

Due to the cost of medicals and their 1 year expiry date, some MA's recommend doing it a little later down the line.

As you applied in September, I'd look to arrange one soon.

    Hello Everyone,

My colleague just got a request for further information from the CO.

He lodged his nomination and application in June 2018, we are from the same company but under different occupations. Mine was lodged in May 2018.

Feeling a bit anxious now. 😩😩

Well, for a start, your friend who has an occupation on the Medium and Long-term Strategic Skills List (MLTSSL) - and your occupation doesn't appear there.

Occupations on this list are sometimes processed quicker.

Why Hairdressers are scrutinised more than others?

Do you know? I’m new in this forum!

    Many thanks

This isn't the case for all Hairdresser applicants, I've got a friend who worked for Tony & Guy a big firm who had their 186 come through at a decent time.

But I've also seen a few cases on here, where people were waiting nearly 2 years.

    I believe there is a few factors;

    • Size of the business, have they sponsored someone before. Small businesses with low revenue / staff generally get looked at in greater detail. A lot of Hairdressers I assume work for smaller salons.
    • Hair Dresser is a ANZCO Level 3 Skill Job, and so the qualifications required to meet the Skill level e.g. a AQF Certificate / equivalent, which is available at college level may come from a bogus institute (more common than you think). Not to mention there is many variations of AQF Certificates, depending on which country you obtained the certification in.  In comparison to a ANZCO Level 1 - where you need a Bachelor Degree, and so the Institute is generally more well known / more clear cut. Thus, further investigation into the college / qualifications might be necessary, especially if from a HR country.

Many other factors come into play also, but these are two that stand out for me.

As you are TRT, and so have already had your 457 approved, this should help, as they've already approved you for that role, rather than a DE applicant.

    Hi guys,

I applied in April 2018 as Hairdresser and still nothing from Immigration 😔😔😔😔.

    Its so frustrating to wait.

Many people that applied after me already received their PR or anyway “news” from Immi...... why not me? 😭

The Department is still getting through the bulk of March applicants.

Haven't seen too many April applications be processed as of yet. But in your case, as a Hair Dresser, you might have to wait a little longer, as this occupation is often scrutinized more than others.

Hi guys I am new member here

i want to know what is MA, LR, HR

    MA = Migration Agent

    LR = Low Risk

    HR = High Risk

These are used when defining the country of an applicant, and is set by the Immigration Department. Applicants from High Risk countries generally face a little more scrutiny on their applications, generally because more fraudulent applications from people within HR countries.

Guys any way advice here or feedback please...

It's very hard for any of us to say.

Likely, as your TRT criteria is largely based off your 457 work experience, there may have been a discrepancy between your 457 file and your TRT, you're MA may have adjusted this, or the CO might have updated it to reflect something.

Maybe ask your MA if they had updated your 457 file? If not, a CO may have updated something, could have been something as small as an address.

Just my 2 cents worth - please take with a pinch of salt.

Sad news this morning - my nomination was refused 😟

I'm awaiting a meeting with my MA to find out the reason why - once I know I will share it on here.

My application was more complicated than most and I sort of had this in the back of my mind this could happen but hey life goes on. I wasn't actually as upset as I thought I would have been.

Still currently on my 457 so no need to make any urgent decisions at the moment however at first thought - I don't think I will appeal. I see it can take another 12-18 months for your appeal to be heard and to be honest I don't think I can put our life on hold for that amount of time again. My wife wants to start a family and I don't feel comfortable doing that whilst sitting on a bridging visa awaiting the possible outcome - no matter how strong my case may be.

So it looks like my journey in Australia has come to an end - I have so many great memories here and I wouldn't change them for the world. I believe in life, things that are meant to be are meant to be and I guess its just our destiny to be back home. Although they wont say it, both my Wife and my parents will be over the moon I bet - they really struggled with the thought of us having a family out here alone.

Good luck to everyone on here - the forum has helped me through the process and its an awesome community that you all should be proud of.

I probably will take a step back from the forum now and I doubt I will post much more - just need to start planning the move back to the UK. My company has offices back home so I'm currently looking into an internal transfer.

    Farewell and God Bless🍀

@boo-yaa so sad to read this news.

You've been an absolute essential asset to this community, and you're wise words have helped many.

Please consider how fast we're seeing nominations being processed now with the SAF (as bitter as I have been feeling towards to the newer applicants) - I too wouldn't consider an appeal, but with a re-nomination you could see a 4-5 months wait.

Wishing you all the best, please keep us updated on your refusal reasons.

Over and out, all the best in the future.

    Hi All,

    I have a similar question.

My nomination and visa application were lodged in June 2018 and the status is still "Received" and last update says "1st of February 2019". Can someone please tell me what it means ?

I believe that's the last time an amendment was made to your Application.

Did you recently send your MA a document to update? e.g. a Police Certificate?

    Hi all,

Nomination and visa applied yesterday! Very excited.

My MA says that they do not want me to view the application in my account - however I thought that we could import the application just to view? I am just so crazy reading these posts about MA's forgetting important docs. I also just want to be able to check in whenever I want to soothe my own anxiety.

I think I read somewhere that I could import an application and it won't notify the main person? Any ideas? How do I import the app into my immi account so I can view?

No one can say for certainty, from previous comments - but I think the common opinion amongst this thread is that they can't.

I know there's a few MA floating around on the the sub-board (https://www.pomsinoz.com/forum/48-business-sponsored/), you could start a post there and ask, one of them should be able to give you a concrete answer.

I'm also wanting to do it, with my MA asking I don't, so if you find out, please let me know!! 🕵️‍♂️
