Hi, I applied AAT last year in Sep and still waiting.
I know most of people are waiting for 20-24 Months. I believe yours is coming soon.

RSMS applied: May 2016 (Nomination & visa)
Retail Manager - Victoria region
Refused: 28th December 2017.
Reason for refusal: My employer have more than one store and case officer thought my owner is running businesses without any sponsored employee before and he can continue doing that & doesn't need any sponsored manager. (Which is of course a weird reason to refuse and they just did it as they did it to many other RSMS applicants in that period)
AAT lodged: February 2018.
AAT hearing: Nomination & Visa on 9th October 2019. Nomination hearing took around 40 minutes, followed by Visa hearing less than 10 minutes.
Member asked my employer number of questions about business, employer profile, applicant details and other employees. At the end of hearing member asked my employer to submit latest financials, training and Salaries related documents.
Documents submitted on 22nd of October 2019.
Decision: Set aside on 6th December 2019 both Nomination & Visa.

If your employer withdraw the nomination appeal, there is really nothing you can do except talking with your employer. Otherwise, you might need to find another sponsor. That’s what I think.

I am sorry to hear that. But why your employer withdraw the application which you already waited for almost 2 years????? And without inform you ??? That soundS really bad to me.

Hi, may I ask did they actually just used “ Super calculation problems “ to reject you? ? I was thinking about your case the whole day I just couldn’t understand.
what is exactly wrong with the financial report? Why they got confused with super part?

After we submitted docs for the first request, nearly 1 month later they sent an invite for the hearing(15/11) , then few days ago they requested more docs again. We going to submit tomorrow and see what will happen next.
Please keep us updated. Everyone in this group we are not the lucky ones. I’ve seen some people got their PR in 1 month or 4 months. Even my friend who submitted at the same time with me and he got approved, I just got rejected. So we have to be strong and stay together and fight for this.

The higher court costs more money. But in your case , it might worths to t try it. Because it sounds like the member was not professional and rude to you.
so basically, they just use “ The company cannot afford you” as new reason to reject your nomination?
I understand that they will got confused about like “ Company are running in loss or Other financial problems” but why they confused with super ???? It is in your contact and your payslip. Why they got confused about super calculation.

I am so sorry to hear that, heartbroken. Yes, my MA also said , the Member is very important. It will influence the results directly. I feel sorry for you.

I think they want to see you if your employer Pays you as manager pay ( correct payment). If he has been paid you for last 2 or 3 years , then you should fine.

reason: supervisor not a manager ( we are franchise, CO thinks we just follow the franchise agreement so I am not actually doing manager job)
location: Far North Queensland
AAT nomination lodged: 23 Sep, 2019
still waiting for visa refuse and going to lodge visa appeal as well.
Changed a different MA

Ques 4: Do we get 21 days or 28 days to apply for AAT .. ita little confusing..
My status is still showing Further assessment.

Hey, the Current AAT waiting is 12-18 months. But in reality, I think it is 2 years.
I looked into the percentages of AAT wining , it is 26% winning about 186 , 187 appeal. ( the highest percentage is partner visa appeal which is 50%). But you still need to know the reason.
You have to lodge the AAT in 21 days.
I think they cannot reject a nomination without a reason. ( but if Your nomination got refused, then your visa will be rejected automatically without any specific reason ).
So I am not sure if they reject your nomination without any reason or just reject your visa?
