hi guys,
I got a bad news from my agent this morning.
The nomination refused yesterday and I have two options.
1. withdrawal
2. appeal after 28 days
I waited 19 months and I really expected my visa going to be approve this month.
However, I shocked with this result.
My agent recommend me that I choose option 2 because it will be success that if company appeals after 28 days.
But he doesn't say how long does it take.
Is there anyone had this experience?

Who knows how to get a new HAP ID?
If u applied new application then on the basis of new appl.u will get new HAP ID. Everything new like TRN no.

U can see other agents opinion. What they said. In my case I reapplied, I got refusal ENS 186 TRT reason genuine position and didnt provide organization chart. My MA told to reapply again.

I have no idea about aat . AAT take more than 2 year. U still dont know about reason why they refuse. Try to find reason from ur MA.

I pretty sure ur MA send refusal letter to employer. Immi. After refuse nomination they send 2 letter to MA.
1. Invitation to commont on information for ENS visa nominations refuse. ( u got this one)
2. Notification of refusal of a application. ( this one get only employer and MA.
SECOND letter most of the agent not provide to client because this belong to employer under confidentiality information.
U have to request to ur MA To provide one.

We dont know until see ur letter. Post ur letter to us which u got from immi. We will see and tell you if u coudnt find reason in the letter.

My case is exactly the same as you. I got my nomination refused in June2018(Ens186 Pastrycook transits from 457). The reasons of refusal was that there was insufficient evidence (receipts, a written report of the training outcome) to show that PR or Citizen were giving training. After having consultations from 2 migration agents and 2 migration lawyers,then I decided to reapply as those migration specialists said there is the best option for me so far. The positive point for reapply option is that the laws have chance. So.if you lodge a nomination application after 12 August 2018 the case officer are now not required to assess the training benchmark requirements as all businesses that nominate permanent or temporary staff must simply pay the training contribution charge( $3,000 for business with a turnover less than 10 million.
Anyway my case still has risks as the refusal decision of the previous nomination is on record and it could be adverse information and this can affect to the new nomination so the best way to do is providing a strong submission about the previous training issue. Or if I'm lucky , the case officer might not give weight to the training benchmark issue on the record as it has been discarded by the new laws. Finger cross and always have a good hope!
What I want to tell you is that don't just stick on one migration agent but seek a lot of second opinions from several agents or even lawyers to ensure you get the best solution. Good luck!
I reapply my new application because old nomination refuse june 2018 reason genuine position. New application lodge Aug. Reapply is better option rather than go to appeal.

Just like you, my first nomination got refused in Feb 2018 which applied in Nov 2017.
It`s amazing that only take 3 months to get a CO even my occupation has removed from the list since 457 reform in Apr 2017.
They just rejected me on genuine need and org chart.
So it`s really hard to admit they have a pattern.
Same here June 2017 got nomination refusal stright way reason genuine need and org. Chart. Reapply again aus.2018. Hopefully I will get this time

I reply from immigration related to ministerial intervention review. They refused my visa old ens 186 visa because I applied new application. In August. I applied for ministerial intervention review in June 2018 and got result in Nov. They not going to review old decision like refusal nomination.

I think for ministerial intervention you only have to wait about six months.
You can try your luck with ministerial intervention but you should have other plans too in case decision does not come in your favour. Best of luck.
