    the reason does not make sense at all and its totally unexpected. They refused because the previous sponsored restaurant manager left quickly after getting his PR and after that I was not sponsored until about 8 months later. Because of this gap they say there is no need for a restaurant manager. This is a big mistake because in those 8 months someone internally took over the role, however, unsuccessfuly and so they advertised later on the role and took me in. Unfortunately they did not ask to explain this situation and refused straight away (well after 22 months ). And we never expected that this was a problem anyway? Isnt it the point to actually first try to give the role to residents/australians?

    I am a genuine applicant and this is such a stupid reason. When i saw refusals on here I always thought there must be something dodgy about their application and it would never happen to me. 

    Advice: How genuine your application is, dont take for granted that you get your PR. Especially in DE. I believe if they want to refuse it, they will find a way. Even tho this reason is stupid, the current system doesnt allow you to comment until 2/3 years later. Its unfair, but within the law so nothing I can do about it.

    I am really sorry to read your lines. It is a clear evidence that genuine applications get refusals too. I also agree that there is a growing number of cases where refusal is decided beforehand no matter how strong the case is.

    We all have to live with this potential outcome. I think if you have evidence that there was somebody in charge of managerial role during the 8 months in question, you have a good chance to win AAT.

    Good luck and never give up unless God tells you otherwise.

    I also thought this was the case, however, it seems more that the CO will not approve your visa application, until the nomination is approved.
    There has been a case (here, not too long ago), whereby a CO had requested information on the visa application, even before the nomination was approved. 

    This was also new to me and in a way, I was glad to see it happen.
    It means that both cases could possibly be worked on at the same time, however, there is an approval process / flow whereby the visa would only be approved once the nomination has been. 

    Just my 2 cents worth and something you might find interesting. 

    As per I have been reading on this thread, I believe you are right. I had even heard of a case where the visa was approved first and the nomination got refused. Anything and everything can happen once you decide to embark on the journey of Australian immigration.. I can't be surprised anymore.

    I believe that immigration wants to approve applications for which the emails were sent this financial year. The rest has to wait for the new quotas from July.

    This is just speculation, but very probable scenario. If this is true, it is bad new for me who has not received the email.

    Is there different weight placed on the perceived "importance" of skills? Or is it just that you they seem to do different professions in blocks e.g all Chefs together?

    I am applying as advertising specialist. Which i guess is similar to marketing specialist? I am on the old grandfathering scheme... I don't believe that you can apply as an advertising specialist anymore so im worried I could get forgotten! Any other Advertising Specialists out there? 

    If you are sponsored by a small company you have to buckle up for a long ride. I am just being left behind at this stage as a March applicant. I believe that all "forgotten" marketing specialist have been nominated by small firms. I would wonder if there are any still waiting who are sponsored by big company.

    My company wrote the names of participants on the invoice.

    Letter from training provider is a good idea. I suggest that it includes also the confirmation that the training cost has been paid in total. You should also upload the training material (including training content for each training day) and attendance sheet.

    And first of all, pray for positive outcome!

    As far as I know, the training benchmark has to be paid for each year in case of nominations before August. For peace of mind, it is better to pay (2% instead of 1%).  I suggest to contact another MA for consultation too.

    @madhu nom & visa lodged 12 February, visa granted 21 November (didn’t hear anything about nomination, just visa directly approved)

    Your story confirms that nominations of big firms are absolutely prioritized, whereas small businesses are neglected by immi. This tells me that processing time mostly depend  on two main criteria : occupations and nominator. Low or high risk country or number of applicants should play a minor role.

    Congrats, I am also marketing specialist waiting since March. Would you share the character of business (industry, size, turnover, number of employees). Have the financial documents been up to date?

    Same here. Usually , uni contract is for one year unless you have your own grants. I guess the 2 year contract rule are mostly to small business. 

     

    Employers have to express intention to sponsor for 2 years, but dont have to obligation to do that. What is CO expectation to see this intention? Does the employment contract have to be signed for a  definite period of 2 years?
