    Hi Rama, hope you are well? I’m in similar situations like your, working for 7 years for the same employee (3yr student visa +4 year 457) and 186 refuse because of financial on May 2018 then apply for aat.

    june 2019 I quit from my job and get a new job in different company as I was on BR.

    I wondering how is your hearing goes? Did you advice aat when you change your job?

    did you get the approval?

Hi everyone, i wonder if anyone on the similar situation as mine and if can give me a piece of advice or knowledge. i know there's a lot of mistake that has happen during my application but im looking for a solution or advice if you could share your info. I've believe most people in this forum have been through the stress and pressure with this australia immigration thingy 😞 Thank you

    Background :

    I had been worked for the same company over 7 year in total ,(3 year using student visa + 4 year under 457 visa )

    on 2017 -  my lawyer apply for my 186 visa with an explanation my company (*ABC) is changing to another business model (*XYZ), but my immigration lawyer didnt apply a 457 transfer from ABC to XYZ for me, which result into  186 refusal on May 2018 because my company change their business model and using different name and ABN. So immigration cant find any connection between those 2 company and the new company is not making profit.

    I apply for AAT on June 2018 , with a letter from my manager explaining both company is connected and the reason why the new company is not yet making profit and providing the projection the profit the company will be making in the future.

    Now, my 457 has been expired (June 2019) and im holding bridging visa A. 

    August 2019, i start a new job in new company with my bridging visa A.

    I still havent hear anything from my ATT application which i have apply on June 2018.

    im not using any migration agent anynore for my AAT Case.

    did anyone got their AAT approve after their change to another company?

    as I'm not working on the company i apply for the appeal meaning i dont have any hope any more for my appeal case?

    Do i need to notify AAT or immigration that i change to new company?

  3. Hi Yuyu... be prepare for the worst... case with aat we never know... i cant imagine myself in your position in next year... but Please stay strong.. if you already done everything you could have done, just pray for the best....

    Lets hope this new financial year will bring a new luck for us ?

Hi i just applied my aat for visa refusal yesterday, i had applied for my nomination refusal earlier.. but i wonder if anyone knows what documents i needed to put on my visa document for the AAT? since im apply AAT without immigration agent / immigration lawyer. any advise will be very much appreciated. Thank you

     

  5. Hi @declanchou can I ask when u decide to appeal do u need to prepare all the document form the beginning when u apply for the 186? Or just prepare the document regarding the excuse of the refusal to aat?

    also, did u prepare the document before submitting your aat, or after aat open the case and request the document then you submitt it? 

    Me and my employer thinking to do the aat without using the migration agent.

  6. I apply on june 2017, so we only submit for the 2016 only, so 1 months ago my MA ask my employer to submit the financial statement ended June 2017. Since the company is expanding the company is making loss because they are spending lots of money to grow the business. 

    the financial statement was sent directly from my employer to MA, I wasn't informed it's state making loss..not that I need to know how much it's losing etc.,, but at least I could ask them to write an explanation or at least I be aware it might be refuse ect And be prepare.,,

    My MA should have ask my employer to write the financial viability statement when submitting the financial statement but he didn't....

    I did use MA but I'm really not confident  to use Ma service anymore If im going for aat, I'm thinking to do it by myself with the help of my employer.

    because using MA Didn't guarantee I'm getting the approval as well and it will cost so much.. 

    it's just so much pressure since they are giving the 21 day limit decision making after waiting for 11 months...

    Hi.. my company is showing loss for 2 years as well but explainable and we showed 2-3 years forecast demonstrating recovery and revenue increase + tax accountant letter supporting the growth. I have not received any answer yet from them but I am hopeful. You could reapply for the nomination and add additional documents showing that despite the loss the company is operative and solvent. Many companies ( especially the ones part of groups under same shareholder) operate at a loss for tax reasons.

    I did apply in the past to ATT because my 457 nomination was refused, but then I withdrew the application as I have resubmitted the nomination with further documents.

     

  8. @KKD& @sbrowne9 I got nomination refuse on Saturday. Because my company is making a loss now... I'm thinking for Applying AAT. But honestly I'm really don't know what to do... 

    anyone apply aat after 186 refusal?

My only bit of advise would be step 1. take some time to leave it settle and think about things. Emotions are running high, and any decision may have a little spite/frustration in it. Get all your options, not just employer sponsored. 

    I won't lie, the second application is harder...you know the possibility of a refusal, and it just adds to the anxiety of the wait. Feels like I've been waiting since last April!

    Either way, if I or anyone else here can help, just let us know; also keep us informed, as your misfortune might be able to aid someone else in their application. Thats why the forum is here in my opinion; support and advice
