    Maybe at IMMI, but def not at AAT... it's there most of us are stuck.

What i can see now that they ok with that because they are just requesting financial business docs at the moment. looks like that they just want to see if the company is ok to support me. we are ok with that. company with more than $5M turn over a year, but we never know....

    187 no longer exists either and businesses are still being approved to nominate through AAT so that’s not an issue.

    it is possible to win based on solely the documents, it’s really decided on a case-by-case basis and how good your paperwork is (and it if fully answers their concerns).

    How have you demonstrated that your role is not supervisory?

    I am pretty sure they used to have around 30 days to finalise your case after being remitted back to them.

    Our timeline is very similar. We also applied in Dec 2017 and the nomination got refused June 2019. We lodged the appeal in July 2019 and have been waiting since.
    The current processing time are sitting at 30 months for 187 DE, so if they are going to leave us waiting till the end we're looking at January 2022 (one more year) for the file to be just opened (and who knows how long for it to be finalised).

    You can't do much until they request medical tests again so perhaps spend that time working with your child. She hasn't been officially diagnosed so it might not be as bad as you think.

    Normally intervention by the Immigration Minister and/or the public (e.g. petitions) can be of huge help.

    It does vary but most 186/187 application are taking a bit over two years to get a hearing. My last one took 28 months.

    The active AAT case numbers do seem to be decreasing (maybe as a result of COVID) so hopefully we will see processing times improving this year.

    It also appears that the new regional visas the Government introduced are much easier to get, would you say that people who aren't lucky to win at the AAT should have a go at the Skilled Employer Sponsored Regional (Provisional) visa (subclass 494)? Especially for offshore applicants (we're currently here but will have to leave if we lose at AAT) and reapply from overseas (due to being on a visa C).

    I'm not sure if encouraging everyone to lodge a complaint will help and will probably make the situation worse. If the AAT is dealing with a huge volume of complaints, they will have less time to process applications.

    Raul, do you happen to know the current processing time at AAT? We appealed IMMI's decision in June 2019 and are wondering when we can expect for the file to open.

    How long do they normally allow for the requested documentation be provided? Without the extension period.

    You'd think financial documents are easily accessible and can quickly be collected.

    So you are saying you know people with non-genuine application who were refused by both DoHA and AAT? And have now gone to the Federal court?

    How do you know they are non-genuine? And how do DoHA and AAT know a case is non-genuine before they even open it?

    Very similar wait times to my case.
     

    Applied for nomination in Dec 2017 and was refused after 18 months.

    Applied at the AAT in July 2019 and haven’t heard back.

    Could you please clarify the below-

    1️⃣ What reason for refusal did IMMI give you?

    2️⃣ And what sort of documents did AAT request twice?
