Hi guys, silent reader,
my nomination has been refused as cook, applied 30 june 2017 without asking any document and immi invited to comment on refusal, i still don’t know what is reason as tomorrow will speak to MA. Does anyone know if i submit required document within 28 they will reconsider or i have to apply AAt?
Regards
Unfortunately, like @Parkesy already said, it's too late!!
Our MA, should update all the documents when she submitted the application and while we where waiting, just to make sure that it will be approved.
My one didn't care at all, even if I called her everytime...
I asked more opinion and everyone is saying that our nomination as been refused because our MA didn't provide enough documentation about the business and we'll be able to sue her!!

Did you appeal with the same MA?
Can I ask you how much did you paid in total??
I'm in a similar situation, but I don't even now if right now will be worted Do it, because the owner after our refusal is thinking to put the Restaurant on the Market...
Unfortunately In one day, after that our nomination has been refused, He lost the Chance to keep with him the Head Chef and the Second Chef (my fiancé and I)...
We are so stressed right now

Hi Guys,
I'm back just to say that yesterday our nomination has been refused.
The same f...... reasons that they are giving to most of people, the restaurant will be no able to pay my fiancé salary for the next 2 years!!
We Are shocked but there is nothing that we can do, we just need to change our plans and go back to Europe.
I'll appeal just because we want to have more time to organise all our stuff that we bought after living more than 5 years continuously in Australia.
Good luck to everyone...

Hi,
I applied for 187 visa last March for a full time cook position.
The business is slowing down and I'm not getting the required 38 hours per week. Sometimes I only get to work for 15hrs/week.
I messaged my MA regarding this matter and she said, under the current law, my employer is required to provide full-time employment in the nominated position for the next two years UPON VISA GRANT.
Will this affect my nomination?
Unfortunately, if you cannot prove that you are working full-time for your employer, this can effect your Visa.
Your employer sponsored you and signed a lot paperworks saying that he/she needs full-time cook, paying you At least a minimum wage...
Like your MA said your employer should keep your position for the next two years, after your Visa will be approve!
Just talk with him/her and explain the situation, hopefully will understand and will give to you the correct amount of hours, even if now we are going through the quietest time of the year!!
Good luck and let us know...

It's not our fault where we born.
You might know that, if you apply from European countries for any visa it take less time than the as compare with Asian countries.
This is not even true, I'm applying from A low risk Country and one of my best friend applied from Vietnam on the same day and same occupation of mine..
She got her Visa before me.
Maybe can be true that European will have their Visa first but This wasn't my case and Of course I'll not complain but I'm happy for all of those people that are waiting for their PR.. doesn't matter it they are from Itlay, UK, Cina etc...

Bro your country is really low risk country.
The applications belong to Pakistan, India, Nepal and Bangladesh etc are taking more time.
I'm sorry but is not our fault if we were born in a place that is considered from the Australian Immigration a low Risk Country..
I'm sorry for you if you didn't get this chance!!

Hi Everyone!
I've received the Golden Email this afternoon! it has been a long journey for me.
While I was on my 457 my company has been sold and the ABN has changed. In March 2017, my occupation (Exporter) has been removed from the list of eligible occupations.
Despite these hurdles, my visa has been granted today (on a saturday?!)
Both nomination & visa application lodged in June 2017.
No Documents requested. I did however upload new police checks as mine had expired.
Good luck to everyone and thank you all for your amazing support and sense of humour!
Congratulations ??

Through MA... Benchmark 2014,15,16. Payroll 2015, balance sheet 2014 to 2015.... Thats way they refused ?
If you applied on June 2017 your MA should have updated all the documents till now...why she didn't ask you the latest BAS, bank statements etc?
My friend had the same issue, she send the latest documents to her MA, but the Agent forgot to update all of them...
She has all the e-mail where she can prove that she sent all the latest documents to her MA. So she appeal and Now she'll need to wait for the decision.
The biggest problem is that we are paying our MA because we don't have their knowledge but at the end, in my experience, I need to contact and push her to update all the latest paperworks...
But Thanks to this forum And all people experiences I understand what the Immigration is looking for and which document we need to keep updated till we'll not receive our PR...
Good Luck ????

Hey everybody,
Some days ago I finally received the good news, when I could finally breathe freely again, when my shoulders would not be so heavy anymore and my body and soul would become lighter.
I went through three different migration agents, so many up and down moments, hope and despair, balancing from keeping it on and giving it up, trying to look happy when I was feeling so miserable, and trying to make these 21 months of doubt more bearable and less dramatic, by convincing myself that in any case, it would be fine.
I have spent some long hours reading this thread, hoping, fearing, dreaming with all of you guys. But each situation is different, each work and life experience has its own specificities, and all we can do is hope for the best and keep trying until the answer comes through.
I applied for a 187 as a restaurant manager in Perth the 5th of August 2016, I got my RCB approved a week later, I updated the financial infos of the place 12 months later, my nomination got approved on the 28th of March 2018, but I also got asked for a new medical assessment and a new police clearance (the ones I sent had expired), I sent the documents on the 9th of April, and finally on the 4th of May 2018 I got my visa approved !
Good luck to everyone!
Congratulations... it was a long journey for you, but finally now you got it!!
BTW a lot Restaurant Manager here got their Visa approved in this month...
Hopefully soon we'll have some good news for Chefs/Cooks, Marketing Specialists @Parkesy and Hairdressers...
Fingher crossed for all of us ?
