" userid="276742"] My nomination is refused for RSMS 187 after 19 months and immigration not given any reason and does not asked for any further documents. I submitted all documents on time. Position retail Manager in QLd in regional area. 

Hi everyone.
i need a help pls.
my nomination got refused yesterday. It says my position is genuine but the company has no capacity to pay me a salary. They temporarily closed down the business last year and didn’t even inform me. They were asked to send the financial documents but they haven’t.
could Someone please tell me what should I do. I applied offshore and waited 21 months. These people are heartless. They knew the outcome but they didn’t care.
please give me an option. I feel so depressed. I spent a lot of money. 
Nomination got refused so Should I withdraw the case ? Should I apply for a AAT? (Tell me the success rate pls) ? Can I find a new employer and add to the existing file? Please tell me the best possible option 
some one said go for a new nomination. What is that. Pls explain. Is that finding a new sponsor and adding that to the existing file.

documents request 10 dec 2018 (last year financial and asic report 
again documents request 15 dec 2018 for medical and police clearance.
anyone has idea or even same situation? Please respond me .

Just got a call from department of home affairs regarding the position. She was asking about the my position and all the duties involved, working hours about superannuation and opening hours of the business. She told me at end need some more paperwork.

Rcb applied jan approved in march 2017
Nomination applied march 2017
Visa applied june 2017.
 

any retail manager approvals? Have seen other occupations but no retail manager approval timeline. Anyone?

Hi guys I applied 186 direct entery , occupation is cook in April 2017 . I have on bridging visa in this situation can go India or not ,if I go it effects on my file . Plz reply my question .

If you are bridging visa A then you have to apply for bridging visa B to travel India. But If you are on bridging visa C then you won’t be able to travel. It won’t have any effect on your file.

Thanks for your reply. I applied for direct entry 187 visa. I know my nomination is withdrawn but in the Basis of PR application can I apply for appeal?

For more information, I have not withdrawn my file yet after my employer withdrawn my nomination. Immigration give 28 days to withdrawn. After that my file will refuse and then can I apply for appeal in AAT?

I would like to stay in Australia as much as I can.

Unfortunately you won’t be able to appeal. There is only one way to extend your visa that needs to be done by applying another valid application.

Bro r you working at that time when you lodged your file ? And which state ? Mine also retail manager with 4 people working. So what you will think to do ?

A. if you have been sponsored from "xyz" and  working in "ABC" under the same employeer, Than no problem at all regardless ABC can go to hell. 
B. Your ABN shouldn't be changed, even your employeer sell the "XYZ" as well, and new employeer come. But new employer have to use the existing ABN. ABN will only be changed if new employer change and name of the company. 
C. in your situation you was working in abc and been sponsored by xyz and xyz under the previous employer then you have no problem at all. 
D. i had the same issue and my agent said to me even my employer sold the 100% share and new employer keep the existing ABN. then there is no problem at all.

sorry to hear that mate! I assume you don't have a MA to check with. IMMI website is not that clear to me about it. I guess you can get back in AU within these 28 days..

Could you please tell me which state did you apply from?
 

Mine got refused as well. Retail Manager, NT, LR Country, everything lodged Jan 2017
Reasons given are word for word the same Cippalippa
The big boss wants to appeal it as there are genuine mitigating circumstances which weren't considered and i few that we didn't supply evidence on to be fair, BUT i don't know if i can be arsed waiting another year for a yes or no only to have to stick it out another year or 2 to fulfill the visa obligations IF it is approved.
The new hot thread here will be AAT timeline for 187 visa refusal from the looks of it.
Its particularly unfortunate getting this notice just after Christmas as i have lots of stuff to sell and not long to do it. Might appeal, settle my affairs and then withdraw and go back to Cambodia where its much easier.
