Thanks Raul but CO asked for my wife’s functional English evidence but she doesn’t have any of those so we are happy to pay second instalment.
I don’t know how I have to say that.
-
Anyone knows what type of document you have to upload if you’re will to pay the second instalment?
is there a form or just a normal statement?
I’ve googled but I can’t find any source.
Thank you

It’s TRT, reason is benchmark training back dated 2012-2015, which is already in system. Refusal is totally unreasonable, going to see lawyer tomorrow will see what he suggests.
Hey Manpreet so sorry to hear that. AAT is the way to go especially if refusal sounds unreasonable for your ma.
What was wrong with those training benchmarks anyway?

3 years. If lets say your IELTS or any other english language certificate expiring today, it is still valid for immigration purpose till next year. For immi its valid upto 3 years
So does it means that can approve an application even if ielts is expired (considering it was still valid when we applied)??

Your employer has no obligations to change your contract

Hey Guys, there’s a Schwarz in timeline, who applied on January 2017. He’s been asked to provide more recent English test.
If you’re reading can you please give us more details about it?
Was it for the main applicant or the dependents?
thank you

Thanks for your response.
I have checked with a friend she is immigrant agent, she told me that is for the main applicant, but for the secondary the IELTS must be valid when the CA will look at the application .... it's very strange ... but it's the rule.
My partner took lot of medicine and she has been to the test last Saturday, so it should be ok.
We need to do also the Health Check because we have done it too early (Aug 2016) .. it's bad because in immigration portal they request all documents asap.
I have requested an extension but they answer was : Your previous health examinations have expired and you are required to undergo new health examinations. Extensions on health are assessed on a case by case basis and are only applicable in limited circumstances.
no more details .... but they spend 16 months to look at our application so they are late and when we applied the expecting date was between 5 to 7 months ...
Should I send an other email ? or just give up and go (btw BUPA increase by $50 the health check ...) I feel like I'm a wallet ...
Thanks for your help !
You’re so close, I wouldn’t spend time arguing with them and suffering a further delay... I would do medicals straight away.

Mate, as per below she does not need to sit IELTS again at all. Follow up with your MA or immigration and argue on it. It is not fair.
Eligibility- All streams
Who could get this visa
- You might be able to get this visa if you:
- have been nominated by an approved Australian employer within the six months before you apply
- are under the age of 50 at the time of application, if you are applying under the Temporary Residence stream, or are under the age of 45 if you are applying under the Direct Entry stream
- have the required skills and qualifications for the position (at time of application lodgement you must have the required skills and qualifications for the position you have been nominated for – you must hold any mandatory registration, license or professional membership, or you must already be fully assessed as suitable by the relevant body)
- have appropriate English language skills (at the time of application lodgement)
- meet health and character requirements
- meet the requirements of the stream in which you apply.
Hope she get better soon.
Please let us know what you’re going to do.
A MA friend of mine also advised me to take English test again. Mine is expired as well.

Medical examination is valid for 6 months or 1 year ?
1 year

Satisfying the English language requirement is a ‘time of application’requirement.
That’s what I thought

In my case we provided the salary of the apprentices and total payroll in order to provide training benchmarks. Way over the 2%.
Would it be enough?

Just 2 weeks left when he applied.MA said "will be alright till before 2 weeks"
so i might think you will be fine.Check this link:

For the competent language evidence, how come the test should be conducted no more than 12 months prior to the visa lodgement?Supposed to be 3 years before the application as per check on the definition of competent language capability. Can Anyone advise?
Sent using Poms in Oz mobile appYeah I’ve just posted a similar post about my situation in 186 timeline thread.
Immi website still says three years before.

Evidence of competent English
Agents are reminded that if an applicant provides evidence of English to meet the requirements for ENS or RSMS, the test must have been conducted no more than 12 months before lodging.
I was reading the update on Immi Website and this caught me by surprise...
I have applied for Trt 186 ( both nomination and visa application) on June 2017, my IELTS is dated October 2014 and I thought I could use it because of the three years validity.
What now??? They won’t even consider if I take one now as it would be uploaded after the lodgement....
I’m devastated
-
A MA friend of mine reckons that they open first applications with high IELTS marks...
-
Thank you Raul.
after few researches I found out that to be safe it's better to show training evidences since 2013.
Then this can be helpful for others: training benchmarks are calculated in 12 months period (not financial year) so for instance if sponsorship started 1 January 2017 employer has to meet the requirements from that day till 1 January 2018.
-
My 457 expires on June 2019.
-
Standard Business Sponsorship
-
I'm on 457 (granted on 5/6/15) but sponsorship was granted on 6 June 2013 (expired June 2016).
-
Hey guys,
Could anyone help with this?
My employer sponsorship expired in June 2016. Now I would like to apply for a 186 visa TRT.
Can I still apply for it despite sponsorship expiration?
Secondly about training benchmarks do I have to provide evidences since June 2013 (sponsorship started back then) or only for the years I have been on 457 (from June 2015 till now)??
Thank you so much
