    I need some info with regards to Engineers Australia assessment for migration. If someone has a bachelors and Masters in Environmental science and a PhD in Chemical engineering, will he be able to get a positive skills assessment as a chemical engineer??

    i am a newbie in this forum and i have lots of questions regarding spousal visa to australia. just in case, this is not a scam but a true love story of a foreigner and an aussie PR. i feel that there is a need to check on the procedure. my girl and i are getting engaged and she wants me to stay put in australia.

    1. after our legal engagement in australia, how long will it take for me to be granted a spousal visa to live and work here?

    Hello,

     

    You need to be outside Australia to lodge a prospective marriage visa.

     

    You may also be eligible for an offshore spouse visa. You are able to lodge this visa BEFORE you get married, provided you get married DURING the processing time, which is currently 12 - 15 months. You do not need to be living together but need to show that you are a genuine couple and ongoing couple. You must show that you intend to marry and you must marry outside Australia.

    My concern is what Qualification is required for this Occupation in order to receive the positive outcome?

     

    The occupation is very similar to Training and Development Professional. Only little difference can be observed.

     

    I am Bachelor of Business Administration with 7 subjects of IT studied during my 4 years of degree. What is the possibility of getting positive outcome from ACS?

    Hi,

     

    The ACS will look at the overall percentage of relevant subjects in your degree and from here, determine if the occupation is a match. They will then determine how many years you are deemed skilled.

    We started thinking about Australia long time ago. Now it is the time to make proper steps.

     

    I have some doubts about few things connected with visa 189/190.

     

    1. Skill Assesment by ACS - if they tell me that they recognise my work experience for 8yrs - could I use it for my Visa points calculation ? Would it be checked again after visa lodgement? I read a lot about it and I'm confused.

     

    2. Attachment to visa should I put here all of my work experience evidence again? If yes could I use one pdf file for all? I was partly self employed so you can imagine that i could have more that 100 evidences (like contracts, invoices, bank statements).

    Yes, you can claim maximum overseas work experience points if the eight years were in the last ten years, at the time of invitation to apply.

     

    You need to be able to verify all claimed employment at the visa stage, not just at the skill assessment stage.

  6. Hi I am still new here and planning to do the assessment for my qualifications and experience through Vetassess.

    I have several questions here and I need help from those who has the experience in assessing their Qu. & Exp. through Vetasses.

     

    1. what is the the criteria for assessing experience (is it base on job title, is it based on duties, is it based on the kind of projects???)

    2. can you give examples of employments closely relevant to CPM and the ones that are not relevant.

    3. what about a one year master degree in Construction Management, is it considered in the qualifications?

    This is a Vetassess Group A occupation and you must meet the following

     

    "Qualification/s assessed at Australian Bachelor degree or higher degree with a highly relevant field of study and at least one year of post-qualification highly relevant employment at an appropriate skill level completed in the last five years."

  7. A partner visa is very simple and not normally difficult at all, unless of course you have different/difficult circumstances. If you do, then employ an agent, if you don't, well then there is no need at all.

    I am applying onshore for my partner sponsored visa. I understand it's a lengthy, difficult and EXPENSIVE process so I am considering using an agent. Has anyone used them or know anyone who has or can give me advice? I have met with Australian Skilled Migration ASM, but I can't find any reviews so I'm nervous about parting with the fee of $3000 (plus gst) on top of the visa cost. Any help or pointers would be greatly appreciated! Thanks :)

    It is important to find out as much as you can about the agency you intend to engage. The partner visas fee is so costly that you do not want to go through the heartache of lodging, waiting the average 12 - 15 months processing time, and then have it refused.

  9. A skilled visa would be a far better option.

     

    A 457 is a temporary visa. If you were to lose your job while on it, you only have 90 days to find another company willing and able to sponsor, or leave the country. Note, not every company can sponsor.

    If you are looking at a skilled visa, you might want to think about moving to the Northern Territory to live and work on your current visa. Hairdressers are listed as in shortage on this area.

     

    You do need to reach the point score and meet NT's requirements, but this is an option for you.

  10. The Australian Bureau of Statistics website, which has the ANZSCO on it, says that you can substitute at least 5 years of relevant work experience for the formal qualification (the bachelor degree)

    I agree with other posters. This applies to eligibility for a 457 visa.

     

    You must meet the Vetassess skill assessment requirements as a first step in a skilled visa.

    I appreciate there will probably be information on this already here, but with the ever changing immigration situation, just thought i'd try and get some upto date info.

     

    I am an Aus PR, living in the UK. In May 2015, we applied for a Partner Visa for my wife and six year old daughter.

    Chances are, the Partner Visa will only be granted between March- July 2016 due to UK processing times.

    Our case is very straightforward, with no complications and we should be eligible for the permanent visa.

     

     

    We are considering applying for a 12 month visitor visa for my wife to allow us to travel out to Oz sooner, so that I can commence work etc.

    I'm aware that we should notify our case officer of this.

     

    My question is..........

     

    Can my daughter go on the same visitor visa as my wife?

     

    Is it still the case that my wife/ daughter would need to be outside Australia when the visa is granted?

     

     

    Has anyone else done this recently? Any thoughts/ views would be great!

    If you have lodged a Subclass 100 visa, your partner CAN be inside Australia when the visa is granted.

     

    100.4 Circumstances applicable to grant

    100.411

    The applicant must be:

    (a) in Australia, but not in immigration clearance; or

    (b) outside Australia;

    when the visa is granted.

     

    It is recommended that you seek professional migration advice if you unsure of visa conditions.

    Long time browser, first time poster.

     

    I'm currently in the process of applying for a 457 visa (my company applied for the nomination a week ago), and have some questions regarding my final stage of the application once the nomination has been granted.

     

    1) I have my Resume, birth certificate, qualifications (degree) certificate, letters from previous employers and jp signed passport copy. Do I need a proof of medical insurance (even though I am a British citizen), police clearance, medical certificate or any other documents? If so, how would I get them?

     

    2) I hear it's better to submit your application from outside of Oz, is this true? I'm currently working for the company, and would prefer not to take an uncessary trip abroad if it in no way effects the application.

     

    3) Anyone currently in the process or have recently completed their 457 application that can say the current processing time?

     

    I'm really nervous as its nearly a month until my WHV runs out and I want everything to go smoothly as I'm running short of time.

     

    Anyone that can give any general advice it would also be super helpful and appreciated as I'm doing this all by myself.

    Hi Dan,

     

    If the nomination is not approved prior to the end of your current visa, you will either need to leave Australia, or lodge your 457 visa and link it to the pending nomination. You will then hold a Bridging Visa A.

  13. Hey, I've been in Australia for 11 months. I've already got a second year visa meaning I am eligible to stay in Australia for another 13 months, but I'm curious on becoming a resident. My friends have done the process and advised I look into it sooner rather than later; which obviously, makes perfect sense.

     

    Back in England I completed a 'BSc Business Information & Systems' degree, the same year I came to Australia. Because I was at university right up until traveling to Australia I haven't been employed with that skill ever. In Australia I've done plenty of construction laboring also.

     

    Wondering if there are any possibilities in me being able to stay? Would a sponsorship be the only realistic way? I'm 24 years old, if that is of importance.

    Hi Laurence,

     

    As you hold an IT degree, you are eligible for both a 457 visa, and a 187 (Direct Entry) PR visa - if you are living in a regional area of Australia. You do not need post-degree work experience to qualify for either of these visas.

  14. Hi i have just moved over to the North side of Brisbane to be with my Family (Currently Living on Bribie).

     

    I am a fully qualified senior hairdresser and currently working locally whilst on my working holiday visa.

     

    The issue i have is I would like to get sponsorship - does anyone know if this is possible for my trade?

     

    If not i will need to do my 3 months regional to get my second year - I have heard so many horror stories - any positive advice would be appreciated on how best to find something.

    Hi,

     

    Yes, you are eligible to be sponsored on a 457 visa (showing three years of paid work experience). You may also be eligible for a 186 PR employer nominated visa (through Direct Entry), if you are able to pass a skill assessment and you have three years of post-qualification work experience.

    Most employers can obtain approval to sponsor, even sole traders or businesses trading less than 12 months.

     

    Labour market testing is not required for all occupations.

  16. My daughter and her husband have today lodged their onshore 820 partner visa but they both need to travel outside of Australia in December. Does anyone have any idea how long it takes to get the bridging b type visa granted, apparently it cannot be done online. My daughter is Oz citizen, husband is Colombian.

    We would need to know what visa your son in law holds, and when it expires, as he remains on this visa until either it expires (at which time he goes onto a Bridging Visa A, associated with the lodged 820) OR a decision is made on the 820 application.

     

    If he is on a Bridging Visa A and wants to travel, he does need to apply for a Bridging Visa B.

With some visas, if the issues that caused the nomination refusal can be quickly addressed and a new nomination lodged, you can then have your existing application linked up so that your application isn't refused as well. I know this can be done with 457 visas, but not sure about the 187. If your employer isn't already working with a registered migration agent, they should engage one immediately to see if your existing application can be salvaged before it's refused or you need to withdraw it.

     

    The nomination stage usually isn't expensive so depending on the reason for refusal, it may be cheaper to simply lodge a new nomination vs. appealing the decision.

    If the refusal is not appealed, a new nomination will need to be lodged, and new visa application.

  18. Thanks Joy, I just can't seem to see a reason in the letter.

     

    The letter states that, 'The nomination submitted to the department by xx company listing you as there nominee has been refused. Meaning visa cannot be approved.'

    Then it goes on to list our options.

     

    OK. It is the nomination that has been refused. Your nominating employer would have the Immigration letter outlining the reasons for the refusal. The date on that letter is very important.

  19. Sorry, I worded my original post incorrectly - our letter actually says nomination refused, meaning our Visa cannot be approved.

     

    Am I right to assume this is to do with the job role?

    We found out today that our 187 application has been refused. We are completely devastated.

     

    We plan on appealing with the help of my so's company lawyers - does anyone have any experience with appealing? I've read that it can be a long process and quite costly.

    I am sorry to hear of your 187 refusal.

     

    When did you hear of the refusal? There are strict time frames on lodging an appeal.

    Was the nomination refused? And therefore the visas? Or were the visas refused after a successful nomination?

    Are you in Australia or offshore?

    What was the reason for the refusal?

     

    These questions would need to be answered and understood by anyone you're working with on an appeal.

  21. Thanks Joy - I'll take a look into the ins and outs of that visa. We didn't want to pin ourselves down to a state when we started this process, but the goalposts have been moved so many times on us that we may have no other choice.

    Bear in mind that it is as moral obligation (not a legal obligation) to live in the sponsoring state for the first two years of your 190 visa.

     

    You will find that some states claim on their website that you MUST live there, but it is not a condition of a granted 190 visa. They are issued with nil conditions.

  22. I'm currently claiming 10 points (Australian Diploma or Trade qualifications) for my diploma in Computing and it has been recognised by ACS at that level. But I don't think that my 60 points will be enough in the EOI to get a 189 invite. So - I also have a diploma in Creative Writing and English literature and could do a couple of courses to top-up the two diplomas to a degree. In a nutshell - I need to know if a BA/BSc degree will get me the 15 points or if I will need to do an extra course and get the BA/BSc degree with honours. I anticipate that the final grading for the degree will be on the lower side.... Thanks

    Have you looked into the 190 visa? You will get 5 points from the state and you and your family will get PR.

    I am new to this forum and would like some information on the correct procedure for applying for a 489 Visa.

     

    I have got all my documents for The VEATASSESS assessment and I am going to send off these documents this week once I have had thm authenticated by a solicitor.

     

    If I am assessed as qualified I must then submit an Expression of Interest. How do I do this? is there a specific site. I have done some searches but cannot seem to find a link or I am possibly looking in the wrong place,

    You need to make sure that you meet the point score for the 489 prior to lodging your Expression of Interest. Are you looking at family sponsored or state nominated 489?

    I've completed my EOI but now I'm worried. As I aren't claiming points for experience I have marked all employment as not relevant. Should I change the relevant employment to reflect its relevancy even though I don't have enough for the additional points?
