No , do not go for MRT because it is a lengthy process and god knows how long you have to wait for the outcome....And the CO has cancelled your nomination with a valid reason,So there is not point challenging it....other than that i dont think he can cancell your nomination without a valid reason....YOUR PAST IS NOT THEY ARE LOOKING FOR, IT IS YOUR DOCUMENTATION AND SKILLS THAT CAN GET YOU A VISA

Thank you. But the Co misunderstood my work duty then refused me base on that, I feel wronged. What can I do? apply for another nomination and explain my duty well?

Hi Guys, just got my nomination refusal letter, it states the Co doesn't think need me in his company (my occupation is network administrator). The Co think my occupation is just maintain hardwares, install computers and monitor network things. But my work there is far more beyond that. I am mainly develop IT strategies to expand my employers business. I think I should go tribunal but my MA told me if the Co wants to refuse me base on my student visa rejection history, he will come up another reason to refuse me again. What do you guys think? should I go MRT or apply another nomination?

Hi freddy , i knew its really painful when you got rejection .but dont loose hope.I was in the same situation when my nomination was declined because of the silly mistake of my MA but plz get advice from lawyer instead of MA.they are best.

Immigration can not rejected your visa on the basis of your history because they need a valid reason, Which can be buisnesa in loss, no need of an extra worker , company financial satuts and so on....And furthermore nomination has nothing to do with your past history!!!!so i think it is a complete lie believe me.....Ask your MA to forward the letter and you will see what the exact story is ....

i dont know what the hell had happened. because untill you get the letter of refusal we all cant get the exact reason..CO wants to give you another chance that sounds really fabricated because if u will apply again from another employer then again your history will come to your visa file.. we cant change our past then therir is no reqson to give another chance and why CO officer wants you to withdraw your file. mate honestly in my life i saw lot of people who got PR after after refusal of student visa/ RSMS visa. So i can totaly nderstand your. situation now. but talk to immi and ask the result of your nomination. if they will not provide you as per rule then get aletter from you MA that immi send to him and mate dont leave this forum until you dont get the exact answer

Thank you naviozz, I won't leave the forum and I will certainly get the refusal reason and post it here. If turns out the agent try to fool me and cover their mistake, I will certainly report them to the immigration department.

You are absolutely right because the immigration cannot reject your file (187) because of your previous history and they need a valid reason to cancel it ....as long as every document is placed in a proper manner there is no chance of a rejection (AS LONG AS AS YOU ARE NOT A FDEREAL CRIMAL)....I am writing all this from my personal experience because i dont have a good history either..

its really sad news mate.. but the reason you told its totaly undigestable.. because immi cant refuse you visa based on student visa refusal history.. but i dont know at tje movemwnt on which visa you was and what is your history..but if wer holding any substastive visa then they cant refuse your visa.. moreover you said your nomination refused .. nomination is related to your employer not relates to you.. in the nomination immi check the employers record not yours..thats why nomination approval is a different step andvisa approval is a different step.. i have doubt on your M check with immi on monday morning..if nomination is refused then the reaon would be your MA or your employer.. not you.. seniors please correct me if i am wrong somewere

Many thank you for your concern, I was thinking the same thing, they should only look at my employer at the stage of nomination. But my MA told me because I submitted Visa and nomination together, so the CO is looking at my nomination and visa at the same time. Co refuse my nomination not visa is just to give me a chance to withdraw my visa application. Dose it sounds right to you?

Really sorry to hear that, Freddy. The reason for the refusal given by your MA is especially confusing since the nomination is a consideration of the position and of the legitimacy of your prospective employer, rather than of your merits as an applicant.

Yes, that's really sucks. I have my everything there and get turned down only because of my student visa has been refused.

I don't think your student refusal history is affected your nomination. You need to ask your MA for the refusal letter. Check the reasons.

They haven't refuse my visa yet, my agent suggest me to withdraw my application before they refuse me and try again......

Sad to hear this tragic news but as per my opinion your student refusal history doesn't impact on your RSMS visa application. You need to review the statement again & retry with a migration advice. Good LUCK

Thanks, my agent didn't get their work done well from the beginning. I don't really trust their excuse as well. Sadly it's Friday now and I need to wait in the bad moon till Monday to ask them for refusal letter.

If the requested documents are definitely for the actual visa, chances are that your nomination has been approved. Check with your employer.

Yes, I have email notice alert as well. Just never rang. I think from case to case, their system have more details of status. Because she told me she saw processing in her system.

Just called Immigration Department, it is said we are looking at 8 month process time now for 187. I asked them to check my application, it shows processing in their system but mine immiaccount shows application received.

She told me they request documents about my visa but my bloody agent told me there's no update for my application....... I really need to speak with them today.

I sent an email 23/02/2016 to enquire the processing time(almost 7 months passed), and they replied me 24/02/2016, just said my application is currently under consideration. I called DIBP yesterday, got the same answer, and it is granted today! Amazing~

I guess your employer will get a reference number after apply. you better contact your employer's solicitor to check the process. I did it via my agent, so I just ask my agent.
