Hi guys..I have just joined this forum because I'm in a bit of dilemma..
So due to my personal situation i have to receive PR by END of 2017.
so I grew up in australia by myself (Came when I was grade 8) and did all the education here and have now become a pharmacist.
So I have applied for 187 direct entry on Early June (cant remember exact date but it was around 5th) and so it has been 4 months past since I have lodged everything through a migration agent; now the pharmacy I have been sponsored by has been sold on 1st of Oct 2016.. It's just very annoying because they say it takes about 6 months for the PR to come out and I only have about 2 months left. The new employer is quite happy to take over the sponsorship, however, they are looking for a partner pharmacist who will buy the share of the pharmacy to look after it..and I don't want to do that..and I know for sure that he will dismiss me once he finds a partner and I don't want to risk it.
So my migration agent said either you can look for another sponsor in another regional area, or u can lay low and hopefully receive the PR with the 'old' boss. The pharmacy that has sponsored me is leaving their ABN open until PR is out. Does anyone know if that would help?
Because if i go out and apply again it takes another 6-8 months easy...and it's a bit of pain
Anyone's ideas please...anything would help ease my mind thanks guys
Hi adios, if it is easy for you to find another sponsor then pleAse dont delay. If it is hard then wait for result. They can refuse nomination but they wont cancel your visa. But, now a days getting PR in cases like yours is only 10%. So please try to find another sponsor. It will cost you more but definately saves your time.

Ho everypne i have a question i have applied 187 direct entry visa as cook, rcb approved already, my qualifications are cert 3 commercial cookery and advance dip and diplome of hospitality management it was 2 years course all together, i have provided 2 years experience as cook on training not paid though, do i still need cert 4 ? Is a cert 4 is valid if i get from some institution with my experience as cook ?
I dont know about unpaid experience but it says cert3 plus 2 years experience. Or cert 4 (no experience).and yes RPL (the cert4 you are wondering) cert 4 is 100% valid certificate to apply 187

Hi praneesh , congrats mate, nice to know you didnt have to submit more document just wondering which documents did you attach when you applied the visa?
BAS, tax thing etc indont know actually coz my ma did that. And being in this forum more than a year My insight tells that you will get doc request
if your application is incomplete,
if your employers turn over is not so good,
if immi found something fishy (lots of sponsorship from same company)
and finally if CO is fussy or even drunk?

Good news guys. I got my nomination and visa this morning. Nom was approved at 7:55 and visa at 8:55. Am. No documents requested. Thankyou so much for your support. You guys will get your soon. My timeline is at my signature

just a question
what happens if someone is on RSMS 187 VISA and the business gets sold with in a week after his visa approval.
1. what obligations does employer and employee has to follow?
2. will that affect on 187 visa holder?
3. the next employer is ready to keep him in same contract,same location,same salary and same position.

Then it means your luck favor you by one week. In your case you do not have to worry as seling business is not your mistake.

for 187 you need market rate salary package. It depends on your area as well. As a cook 40-45 is normal annual salary for 187.
Can you explain, what did you mean by excluding tax? Tax should be from your salary as I know.

What is the standard market rate for cook to sponsor in 187? My MA told me somewhere between $35000 to $55000 PA. My employer is offering $40000 PA excluding tax N super. Will that be fine?

There is no point wasting money on the MRT if their reason was correct for refusing. She's better off getting them to correct the issue and applying again.
So she will be able to apply for new student visa? There wont be bad history of visa refusal?

Got to know that her visa is refused straight away. She is wondering if she can be able to extend her student visa or not? As her visa is expiring soon (within 3-4 months). What do you say guys? She will apply for MRT as well.

She applied both together. CO even didnt gave her chance to clearify the real story of RM as immigration gave reason that the owner is able to manage the restaurant and he doesnt need new staff as a manager.

I have been following this blogs quite long time now. I need some advice if you guys can assist me. I have lodged RSMS for nomination and application on 6th Jan 2016. It seems like that would take another atleast 1 month to get the response from IMMI.
Now my question is my student visa is getting expired in this month and unfortunately I failed in 1 subject in my last semester. So, should I apply to extend my student visa? I understood that i would be automatically switch into Bridging visa and I can complete my study during my Bridging visa but i do not know what would be the decision of RSMS application. So just for safe side i wanted to complete my study so even if i get unfavorable decision from immigration then I could have option to apply for subclass 485 after completing study. But my lawyer said that if I apply for student visa now then there is high chances of rejecting student visa application because I have allready applied for RSMS so can officer can reject my student visa application on the basis of non GTE ( Genuine Temporary Entrant) case.
So friends, please advice what should I do? Should I lodged student visa application or not?

hi mate, i think i should share my experience with you as i had a similar (but not exactly same) situation before. I applied 187 on dec 2015 (still waiting result) and my student visa was expiring on march. So i applied 485 visa in feb (my MA was not expecting me to apply 485 as he was preety sure about my 187) to be in safe side as nobody knows what will be the decesion on 187. I got 485 approval on april 2016. Now, i have visa for atleast 1.5 years regardless of decesion on 187.

I worked for my employer for three years before being granted my rsms visa. So my two years started when the visa was issued. If someone is offshore the two years starts when they actually start work.
Your employer can't just say you don't need to work there any more as both you and they agreed with immigration that your visa was tied into you working there for two years from visa grant. Either side who pulls out has to have a valid reason.
Thats what i am saying. Either A valid reason whoever pulls out or better understanding between you and your employer so that employer doesnt complain in written to immi.

hi bro, i asked my ma and also immigration aswell,
all they said is you have to complete 2 years, coz after you finish 2 years if your business owner wants get someone new for 187 visa, all immigration gona ask for as a prove of completing your 2 years of working, is payslip/ group certificate , so that 2 years off payslip is all you need to prove that you was there for 2 years. In immi website its never say a thing that it has to be from your visa approved date, its only for applicant from offshore coz they wont be able to be in the country without a visa,
it cant be wrong i believe, coz i found it from immi staff, still if someone know anything about this please share, thanks
Well if that is the case then what about the applicant who works for the sponsoring company more than 2 years ago before applying visa?can they leave asap after visa approval? In most cases, they cant coz contract letter binds them fr 2 years to work for them. However, if the employr agrees, no body can harm anybody. Thats what i think? But what you are saying is okey for those who are from transition stream ie.e 457 to 187 applicants.

2 years from the day of approval that's what immi recomand, coz the ppl from offshore can start from the visa approved date,
its for onshore applicant if they start early they finish after 2 years from start date.
I dont think you are correct. As far as i know, no matter onshore or offshore, 2 years counts only after visa approval. But if your employer is hapy to let you go, there wont be any problem

He was wondering whether your nomination has approved yet? Coz they ask only for afp so what about nomination?

yeah it's better to ask your MA and if your medical have expired then it's better to do it again before CO allocation to save time. Moreover, I couldn't find you in spreadsheet. According to your previous posts it seems that you also lodged your file in Dec. Please add your timeline in spreadsheet otherwise share with us i will do it for you.

It is 100% a wise decesion if you get your police cert and medicals done before the case officer touch your file. If everything seems okey for him, then its better for you that he can decide your file outcome. There is 0%chance to waive these mandatory requirements now a days. Please do not listen to your migration agent atleast i this matter. I was in the same position a year ago and i did the same that i explained above and got my PR straight away 9 days after my medical had been done. If i was late for 9 days not doing medical, then pretty sure i have to wait another 3-4 months to get my application finalized. So please accept my suggestion in this particular issue. Please go for it and convince your MA to add renewed certificates of medical and police clearance in your application. Thankyou
