Hi All, I am applying for Contributory Parent (Class UT – Temporary) (subclass 173) visa for my Mother who is a Widow and dependent on me and I have certain questions related to Form 47PA which I have posted below. Could you please answer if you know the information? 1) A statement after question 37 says " If you do not have a partner, go to Part G" My mother is a Widow but she had a partner(Husband) earlier. So does she need to fill Part F – Details of partner 2) Part H – Dependent children aged 18 years or over and other dependants My mother has 2 children, Me and my sister, both of us are Australian Permanent residents and not dependent on her and already migrated to Australia. So i am assuming I need not fill these details correct? And thus Me and my sister also do not need to fill form 47A correct? 3) This one is related to Question 70 Payment: The base charge is $2370. The second instalment as per reference 19k is $29130 (payable before grant of visa) Question 70 talks about "Subsequent Temporary Application Charge(if applicable)" : Is this same as the second instalment? If yes then does that mean I have to pay both $2370 and $29130, a total of $31500 at the time of lodging this Visa? Or is it fine if I pay $2370 at the time of lodging the application and pay the second installment of $29130 just before the grant of the visa? Questions on Document Checklist 1) Certified copies of birth certificates of all your children. My and My sister dont have birth certificates but we have passport that shows our our birth dates and Mother's name in the last page. Will this suffice? 2) Certified copy of birth certificate of all applicants. Passport? My mother doesnt has a birth certificate but has a passport which shows date of birth. Will this suffice? 3) Marriage Certificate: My mother doesnt has Marriage Certificate. However she and her husband has passport and both have the spouse names mentioned in them. Will this suffice? 8) Evidence or Relationship to sponsor: Again the only evidence is passport with the sponsor's passport has mother name. Will this suffices. Thanks.

I am working on my child's PR visa, subclass 101, and got to know that i need to get my police checks done as part of 'Protection of children'. the line under Protection of children says, Where the child is aged under 18 years, sponsors (and, if applicable, their partners) of child visa applications lodged on or after 27 March 2010, are required to provide an Australian National Police Check and/or foreign police certificate(s) as part of the process of assessing the application. Now i have been staying in USA since more then a year and I was in India before that. so this means i need to get a police clearance certificate from both USA and India. Now this may take 3,4 months. So the question is, Can i file the application now and send the police check certificates later once I have them? I remember when i had applied for my PR visa (subclass 175 ), I had done police checks only after my Case Officer had asked me to do so. However with child PR, it appears that police check documents have to be sent along with the application. So please let me know if anyone knows if I can send the police check details later?

Yes I am the same person and i am in process of filling up all the details, i am almost done with 47CH and now got to do form 40 and other documentation, so you may see more questions from me , thanks for the help from everyone in advance. I tried to search a lot on DIAC site regarding where to apply but found no information. However i have come across Australian embassy address in Washington and there is a phone number as well. I plan to call them tomorrow and I will see if they can help. If they do then i will update this thread so it may help others and close this topic
  5. Hi All, I am an Indian citizen and me and my wife hold Australia PR visa. We are presently in USA and our child was born here and she has a USA passport. I now need to apply for my child's Australia PR(subclass 101). Any idea where do i lodge her application? Do i need to lodge it in USA or post the application to Australia, secondly how do i pay for the Visa fees?

  7. Thanks , a lot of this helps. I am still not clear on 2 questions. Let me provide more details to them 27 Give details of child's other family members. They mean siblings I see no code for Mother and Father. the relation ship codes listed are M = Married E = Engaged F = De facto S = Separated D = Divorced W = Widowed N = Never married or been in a de facto relationshio Do i need to provide mother and father information here? If yes then what relationship status I select? The form clearly states Parents(including step parents) so looks like I need to provide parent information. However the drop down for Relationship has only the above codes and hence its confusing. They have a separate section for Brothers and Sisters in the form so the sibling is definitely out. 32 Has the child, or any dependent family members (migrating with the child or not) previously been to Australia, held or currently hold a visa for travel to, or stay in, Australia? Me and My wife hold a PR and have travelled to Australia. So do we specify our name here OR we do not fall under dependent family member? The child has never travelled too or lived in Australia so that would be no and if no other dependents that are travelling with you have either that is a no - So are you saying parents need not give their information under this question?

Other names the child has been know ==> I am keeping all of the above blank as nothing is applicable, i hope leaving blank is fine. Or shall i say NA , which stands for Not Applicable 18. Do you Agree to department communicating by fax or email ==> I have said yes and given my email id, is that ok? 19 Childs main language ==> shall i leave blank or say none because child is 9 months old 20 How well does child communicate in English ==> i have checked "Not at all" . i mean there is nothing else i can check for this option 21 Other languages the child reads, understands, speaks and writes fluently ==> shall i leave blank or say none because child is 9 months old 23 If applying from outside Australia: What is the value of money, goods and assets which the child intends to bring to Australia? ==> What do i write here? shall i write what i will be bringing because child wont be bringing anything as she is infant. Or shall i leave this blank. 27 Give details of child's other family members.   9. did you mean I can try and get her on a Standard visitor Visa , which is for 3 months and which generally comes with 'No further Stay' clause and then apply for her Contributory Aged Parent Visa onshore?
  10. Ok that's a big difference I agree, but I cant find a way to apply her visa onshore, because as you pointed out earlier, getting her to Oz on a visitor visa and then applying for a PR is kind of violation of the intention of the visitor visa which is meant for tourism purpose.
  11. ok thanks Adam, so the Aged Contributory Visa is out of question as she would not be onshore. Secondly, if the Visitor Visa is only for genuine temporary entrant then I would not want to get her in on a temporary Visa and then apply for a PR. So I am left with just one choice. First apply her off shore Contributory parent Visa (subclass 143 or 173) and then get her to Australia on a visitor Visa (subclass 600 sponsored parent visa) so she can stay with me for 12 months while her PR is being processed. Hopefully this process is allowed as I am not hiding anything from DIAC and my intentions are clear. Which is to get her to Australia using a Permanent Residency Visa , however since this would take 12 to 24 months, I would get her on Visitor Visa since she is dependent on me and so that she can stay with me while her PR is in progress. I wish I could get this confirmed from DIAC officially. Let me try and find any helpline number where I can call and confirm whether such a process is allowed i.e. get her to Oz on a visitor visa while her PR processing is in progress.

I did not list her as dependent because I was told only Spouse and Children can be listed as dependent and parent can only get PR under the parent category and that too only when one of the child has stayed in Australia for 2 years. regarding the another way you said, yes I agree as that's risk free but I wish to move ASAP so that I can settle down earlier. Secondly she doesn't has any issues if she has to stay away for 6 months or so, and that's why I keep asking whether I can get to Australia on Visitor Visa (subclass 600) after I apply her PR visa offshore. that way she can stay with me for 12 months on Visitor Visa while her PR is being processed in parallel

The Biggest problem with Contributory Aged Parent visa (subclass 884 or 864) is the first requirement [h=3]Requirements[/h]Visa Summary Requirements You might be able to get this visa if you: are in Australia when then say you are in Australia, does this mean when my mother is in Australia. Now only other way my mother can be in Australia is on Tourist Visa(subclass 600, however, Tourist Visa has a 'No Further Stay' condition, and any Visa that has a No Further Stay condition doesn't let you apply for another Visa. So how do I apply this Visa for my mother if the requirement says she has to be in Austarlia? However if this means that the child has to be in Australia then I understand that my sister, A PR holder who would be completing 2 years of Stay in Oz in January, can file this Visa from Onshore. Coming back to my original requirement. Let me frame my question in more detail. Me and my sister are Australia Permanent Residents. My sister will complete her 2 years in Oz this January and I also plan to go to Oz in next 6 months. My mother is widow and completely dependent on me and my sister. My mother is currently staying with me. Now if I too go to Oz then she will be left behind alone. So I am looking at ways she can stay with me in Oz while her PR is being processed. I know I can apply for her PR (subclass 143 or 173) but this takes 12 to 24 months and I am hence looking for means so that she can stay with us in Australia while her PR is being processed. I can think of 2 possibilities although do not find any official documentation stating whether this is allowed. Possibility 1 My sister applies for her Visitor Visa (subclass 600) now. However I do not call her to Oz. Then in January, my sister applies for her PR as my sister completes 2 year in australia (subclass 143 or 173) . Once this PR is applied, I then get her to visit Australia on her Visitor Visa so she can stay with us for 12 months while her PR processing is happening in parallel. She then leaves Australia at the end of her 12 months stay on Tourist Visa and returns back to India. She then stays in India for 6 months and comes back to Oz either on tourist or PR whatever comes earlier. If PR doesn't come in 6 months and she comes back to Oz on tourist and if PR gets granted after she comes here, then she leaves back for India and comes back on PR. Possibility 2 If I can get her to Australia on such a Visa that lets me file for her PR onshore and then later lets me file for her bridging visa so she doesn't needs to leave Oz at all. However only non-PR that would let her come to Australia is a Visitor Visa, and Visitor Visa has a 'No Further Stay' applied on it, which means I cannot apply for any other Visa while she is in Australia. So Possibility one is the only possibility I see however I am not sure if applying PR after she gets a Visitor visa is allowed. and secondly, can I get her to travel to Oz on Visitor while her PR processing is in progress? Third possibility you said was I apply for her contributory Aged PR (subclass 884 or 864) however the first requirement says you have to be in Australia. Now I am not sure you means the child or the parent. Could you please help if you are aware of answers to any of these. I do not want to risk my Mothers PR chances as she is completely dependent on me and my sister and both of us wish to settle in Australia along with her.
